Price, P.E., Director of Public Works Subject: Resolution 09-060, Approve a Local Project Advance Funding Agreement for funding of FM 1709 median irrigation and landscaping with TxDOT Action Requested: Resolution 09-060, Approve a Local Project Advance Funding Agreement (LPAFA) for funding of FM 1709 median irrigation and landscaping with TxDOT. Background Information: TxDOT allows cities to participate in transportation projects when federal funds are used. These transportation projects implement local projects for public purposes to meet the challenges of protecting and enhancing communities and the natural environment and advancing the nation's economic growth and competitiveness. The Master Advance Funding Agreement (MAFA) serves as the master agreement and only needs to be approved once but serves as the basis for multiple individual projects and may be amended as needed. The MAFA addresses issues common to funding and construction of all transportation projects. The City Council approved the MAFA on June 2, 2009. In addition to the MAFA, TxDOT requires a Local Project Advance Funding Agreement (LPAFA) for each individual project to address project specific matters. The LPAFA is required to be approved by resolution (No. 09-060) of the City Council. A copy of the approved resolution will be included in the LPAFA agreement submittal to TxDOT. This LPAFA covers the Median Irrigation and Landscaping along FM 1709 from Pearson Lane at the west city limit line to Nolen Drive at the eastern end of FM1709. The proposed improvements within the medians will incorporate design concepts from the City's Urban Design Study which was approved by the Planning & Zoning Commission and the City Council in 2008. At the time of the agenda memorandum deadline, TxDOT was still in the process of finalizing the LPAFA. As such, the LPAFA is not included in this document for the Council's review. The final version of the LPAFA will be provided to you at the Council Meeting. While this is not preferable, staff feels that previous action taken by the City Council provides the staff with the necessary direction to move forward with this project. The approval of the LPAFA is a requirement of the TxDOT process in order to construct the FM 1709 median irrigation and landscaping. The cost outlined in the LPAFA will be based upon the construction cost estimate provided to TxDOT by the city's consultant, Jacobs as well as a TxDOT Construction Oversight and Inspection cost that is standard to all local projects constructed by TxDOT. Financial Considerations: The construction cost of the FM 1709 median irrigation and landscaping as part of the FM 1709 median project will be $1,134,620. This cost is based on the Opinion of Probable Cost prepared by the City's consultant, Jacobs Engineering. The total cost to the City of Southlake including the 13% TxDOT Construction Oversight and Inspection charge of $147,500 will be $1,282,120. The specific corporate objectives that are met by this construction project include: Provide travel convenience within city and region, Collaborate with select partners to implement service solutions, Provide attractive and unique spaces for enjoyment of personal interests, and Invest to provide and maintain high quality public assets. Citizen Input/ Board Review: N/A Legal Review: This is a standard TxDOT agreement. This agreement has been reviewed by the City Attorney. Alternatives: The City Council may approve or deny the agreement. Mayer, Jr., P.E., City Engineer Cheryl Taylor, P.E., Civil Engineer RESOLUTION NO. 09-060 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, AUTHORIZING A LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION ADDRESSING FUNDING PARTICIPATION LEVEL AND PROJECT SCOPE FOR THE CONSTRUCTION OF LANDSCAPING AND IRRIGATION WITHIN THE MEDIANS ALONG FM 1709 FROM PEARSON LANE TO NOLEN DRIVE WITHIN THE CITY LIMITS OF SOUTHLAKE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Texas Department of Transportation provides for the development of, and funding for the construction of medians along FM 1709 from Pearson Lane to Nolen Drive within the city limits of Southlake; and WHEREAS, The City of Southlake desires to install irrigation and landscaping within the medians along FM 1709 from Pearson Lane to Nolen Drive within the city limits of Southlake; and WHEREAS, the Southlake City Council strongly supports the efforts of the Texas Department of Transportation in developing a system of highways in cooperation with local governments. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. That all matters stated in the preamble of this resolution are true and correct and are incorporated herein as if copied in their entirety. SECTION 2. That the City Council of the City of Southlake approves entering into this Local Transportation Project Advance Funding Agreement for development and construction of landscaping and irrigation within the medians along FM 1709 from Pearson Lane to Nolen Drive within the City of Southlake. SECTION 3.
