Item 4C AudioItem 4C on the consent agenda is for approval of Ground and Water Tower Leases for Bicentennial Park and Florence water towers with Clearwire. 1 The approval of the two Ground and Water Tower Lease agreements with Clearwire support the City’s focus areas of Performance Management and Service Delivery, and Partnerships and Volunteerism. The specific corporate objectives that are met by the approval of the lease agreements include: Collaborate with select partners to implement service solutions; Pursue innovative service delivery options; Optimize use of technology; and Maximize return on investments. 2 First, I would like to briefly provide some background information on Clearwire. •The Clearwire corporation is headquartered in Kirkland, Washington. •They are currently working on building the first nationwide mobile internet network. •The company’s trademark, 4G wireless internet, service is called CLEAR. •The company has numerous investors including: •The Sprint Nextel Corporation •Comcast •Time Warner Cable •And Google. 3 Here is a map from Clearwire’s website showing their current coverage area. 4 The 4G wireless internet equipment which Clearwire desires to locate at the Bicentennial Park and Florence Elevated Storage Tank properties includes: •3 panel antennas; and •6 small microwave dishes •For a total of up to 9 antennas per site. •This quantity is typical of our cellular leases as well. The panel antennas are approximately 3.5 feet tall; And the dishes are 15.3 inches in diameter. All antennas will be painted to match the tower’s concrete pedestals. 5 Both lease agreements are the City’s standard template that has been reviewed and approved by City Attorney Cara White. The standard terms of the lease agreement include: •An initial 5 year term with up to four additional 5 year renewals. •The first year’s rent for each lease is $30,120 with a 3% escalation clause; therefore, the City will receive a lump sum of $60,240 for the 1 st year, and an additional 3% per year thereafter. •The construction drawings for both sites are exhibits to the lease as is customary and have been reviewed by Public Works staff, Deltatek Engineering, and the tank manufacturer, Landmark Structures to ensure: •Safety •Compliance with City Code •Structural integrity of the tank •No impact to existing tenants; and •Aesthetics 6 Staff recommends that City Council approve the two Ground and Water Tower Lease Agreements with Clearwire. 7 8
