Price, P.E., Director of Public Works Subject: Award a construction contract for waterline relocation on F.M. 1938 to Pipeworks Construction, LLC in the amount of $112,701 and authorize construction phase contingencies Action Requested: Award a construction contract for waterline relocation on F.M. 1938 to Pipeworks Construction, LLC in the amount of $112,701 and authorize construction phase contingencies. Background Information: This construction project consists of the relocation of the existing 12- inch water line at the Randol Mill Bend in anticipation of the construction of Phase 1 of F.M. 1938. In its current location, the water line would be under the proposed pavement of the new F.M. 1938 roadway at the completion of the Phase 1 construction. The waterline will be relocated to an existing right of way which has been acquired by Tarrant County on behalf of the City of Southlake to accommodate the waterline for F.M. 1938. Also included in this project will be the lowering of a portion of the existing 12-inch water line north of Brown Lane, east of the Randol Mill Bend to accommodate the drainage improvements required for the construction of Phase 1 of F.M. 1938. TxDOT is currently scheduled to take bids for Phase 1 of F.M. 1938 in August 2009. Five (5) bids were received on July 21, 2009. The bids have been reviewed by the design engineer, TranSystems Corporation and the City Staff. The bid amounts are as follows: BIDDER BID AMOUNT BID AMOUNT Pipeworks Construction, LLC $112,701.00 North Texas Contracting, Inc. $129,423.00 AUI Contractors, Inc. $136,775.00 Metro-Plex Underground LLP $158,528.00 Patco Utilities, Inc. $166,104.53 TranSystems Corporation recommends award of the contract to the low bidder, Pipeworks Construction, LLC. City staff concurs with this recommendation. Financial Considerations: The recommended contract award amount is $112,701.00. Staff also recommends that the City Council approve an approximate 10% construction phase contingency of $11,299.00 in addition to the award of $112,701.00 for a total project budget of $124,000.00. Staff recommends funding the project from the following existing CIP accounts: 502699-598804-U 0006 $ 124, 000.00 Strategic Link: The water line relocation links to the City's strategy map relative to the focus areas of Infrastructure and Performance Management and Service Delivery. The specific corporate objectives that are met by this construction project include: Providing high quality customer service; and Investing to provide and maintain high quality public assets. Citizen Input/ Board Review: None Legal Review: This is the standard construction services contract that has been previously reviewed by the City Attorney. Alternatives: The Council may award the contract to Pipeworks Construction, LLC or reject all bids. From the five received bids, Pipeworks Construction, LLC submitted the lowest bid of $112,701.00 for the utility work to be performed under this contract. Patco Utilities, Inc. had a rounding error on item 12 in their bid. This did not change the outcome of the bid. Four of the five bidders included traffic control and mobilization in their base bid items rather than in addition to the base bid items. AUI Contractors bid traffic control and mobilization as intended however this only changed their bid from the third lowest to the second lowest. This misunderstanding of the bid proposal form did not change the overall outcome of Pipeworks Construction, LLC being the lowest bidder for this project. To our knowledge, Pipeworks Construction, LLC has submitted the appropriate documentation with their bid. This information includes but not limited to, the items below: 1. Specification book with completed proposal section 2. Bid Bond TranSystems has spoken with several of the references and received generally favorable reports from all of them regarding the quality of their work, communication, timeliness, cleanliness of the work site and adherence to work schedules. One of the references did mention having problems with Pipeworks Construction's superintendent, these problems were resolved when the superintendent was replaced. This same reference indicated that they would use Pipeworks Construction again as long they did not use the same superintendent. Based on the verified information, TranSystems recommends award of this Contract to, Pipeworks Construction, LLC as the successful low bidder on this project.
