Item 9C Department of Planning & Development Services S T A F F R E P O R T December 31, 2008 SP 08-268 CASE NO: Sign Variance for Scooter’s Chevron PROJECT: REQUEST: Barnett Signs, on behalf of Scooter’s Chevron, is requesting a variance to Sign Ordinance No. 704-C to allow LED accent lighting. Scooter’s Chevron is located at the northwest corner of E. S.H. 114 and Kimball Avenue and the address is 2150 E. S.H. 114. The applicant is proposing LED accent lighting under the gas station’s canopy. Only the lighting, not the actual LED strips, will be visible from the roadway. Sign Ordinance No. 704-C specifies that lights that draw attention to a service or business are a type of sign. Because the ordinance prohibits any sign not specifically permitted by the ordinance and the ordinance does not specifically allow LED accent lighting, the proposed accent lighting requires variance approval.
