PROJECT: Plat Expiration Variance for Lot 2RB2AR, Block 1, Burnett Acres
REQUEST: Robert J. Gray is requesting approval of a variance to the Subdivision Ordinance No.
483, Section 4.01(I) (Plat Expiration), as amended, extending the validity of Case No.
ZA06-046, Plat Revision for Lot 2RB2AR, Block 1, Burnett Acres.
A Plat Revision which has not been recorded in the County Plat Records within one (1)
year of the date of approval shall expire. The Plat Revision was approved by City
Council on January 15, 2008. The Plat has not been filed and therefore will pass the
expiration deadline. The applicant is requesting to extend the validity of the Plat for an
additional 120 days from the date of City Council action upon this request. Additional
time is needed to acquire lien holder signatures on the plat.

CURRENT ZONING: “SF-2” Single Family Residential District
HISTORY: - A plat Revision for this lot in Burnett Acres was approved in March of
1984;
- “SF-1A” zoning was placed on the property in Burnett Acres with the
adoption of the current Comprehensive Zoning Ordinance No. 480
- A change of zoning to “RE” was approved by City Council on January
2, 1990.
- City Council approved a preliminary plat for Arnold Estates on
December 19, 1989.
- A final plat for Arnold Estates was approved by City Council on
February 20, 1990.
- “SF-2” zoning was approved by City Council on January 15, 2008
- A Plat Revision was approved by City Council on January 15, 2008
(ZA06-046) combining two lots into one
STAFF COMMENTS: A final plat was not filed within one year of its approval date and has
expired. Because the plat has expired, a variance to the plat expiration
is being requested.
