Item 4F Department of Planning & Development Services S T A F F R E P O R T April 29, 2009 CASE NO: ZA08-029 PROJECT: Plat Extension for Gateway Church REQUEST: Gateway Church is requesting approval of a plat extension for the Final Plat, proposing seven (7) lots on approximately 188.76 acres located along the north side of SH 114 between Carroll and Kimball Avenues. Section 4.01(I) of Subdivision Ordinance No. 483 states that a Final Plat which has not been recorded in the County Plat Records within one (1) year of the date of approval shall expire and that City Council may extend the expiration date of an approved plat but not to exceed one (1) year. The plat was approved by the Planning & Zoning Commission on May 8, 2008. Final plats for subdivisions requiring the installation of streets and utilities are typically not recorded until these improvements have been installed and are ready to be accepted by the City. This ensures that street rights-of-way and easements are correctly shown based on as-built conditions and also ensures that all new lots of record are properly served by streets and utilities. The Final Plat for this development has not been recorded due to the large scope of this project. Construction of the infrastructure is still in progress. Place the City case number " in the lower right-hand corner of the plat. 2. There are seven lots total. Please correct the number of lots in the title block. (name of survey and abstract 3. The following changes are needed with regard to the legal description: number; county and state; total acreage; calls match boundary, boundary in heavy line) (reference to Lots and Blocks in previously filed subdivision OK with plat record and confirmation that boundary is identical to previously filed plat) a. Please use a heavier line for the boundaries. b. Call number 18 (36.91 feet) between curve with length of 38.32 feet and call with length of 284.84 feet has been left out in legal description. c. Call number 20 (after correction above) does not include the length (907.67) in legal description. d. The length in call 35 (after correction above) on the plan (237.82’) does not match the length in the legal description (220.04’) 4. Add a lien holder statement and signature block with notary to the plat. If there is/are no lien holder(s) then add a statement to this effect. The standard language for these statements is attached. 5. All lots must front on a “street” as defined by the subdivision ordinance, which includes roads, R.O.W., drainage and utilities to support the lots. This plat cannot be filed until public infrastructure is substantially completed and ready to be accepted as specified in the approved developer’s agreement. 6. Show and label the name of the record owner & corresponding deed record (volume & page) within 200 feet of this property. Please label the tract described in a deed to Howard Bruce, et al, in call number 5 on the plan. b. Label all previously approved concept plans, site plans, preliminary or final plats. c. Remove existing zoning and land use designation from adjacent properties. 7. The following changes are needed with regard to easements: a. Although the Subdivision Ordinance requires general utility easement dedication of a min 5’ width where adjacent property is un-platted or platted showing a 5' U.E. and a minimum 10’ width where adjacent property is platted and shows no easement, staff recommends that easements be adequately provided (min. 10’ width) to serve franchise utility distribution and service and that easements be placed in a manner that has the least negative impact on existing Show U.E for Lot 1, Block 2. tree coverage and natural preservation areas. b. Do not center interior easements for water, sanitary sewer, or drainage on common lot lines. Offset so that improvements are in one lot or the other. c. Adequate easements must be provided for utility extensions with subsequent final plats. 8. The following changes are needed regarding Right-of-Way dedications and interior street geometry: a. Insure that the alignment of the proposed arterial allows for an approximate 90 deg. intersection of E. Highland that does not interfere with the residences or street intersections of Highland Estates. * Upon final plat submission and prior to recording, all street ROW dedications must be provided in accordance with Master Thoroughfare Plan for E. Highland Street (70’ – 35’ from est. CL), S. Kimball (88’-44’ from est. CL) and the central arterial streets (100’). This plan proposes a reduction to 80’ for the central arterial extending from E. Kirkwood to SH114. * Please be aware that half or partial dedications are not permitted for new streets. 9. Completely corrected preliminary water, sewer and drainage plans are required with the submittal of a final plat. The preliminary plans for this development have not been revised since the first submittal with the preliminary plat (Plan review dated _/_/_.) Staff does not recommend approval of this plat without submittal and review of the required preliminary engineering plans.
