Item 4A2 SPECIAL CITY COUNCIL MEETING MINUTES: APRIL 23, 2008 LOCATION :1400 Main Street, Southlake, Texas Council Chambers in Town Hall CITY COUNCIL PRESENT : Mayor Pro Tem Carolyn Morris, Deputy Mayor Pro Tem Virginia M. Muzyka and Councilmembers Laura K. Hill and John Terrell. CITY COUNCIL ABSENT :Mayor Andy Wambsganss, Gregory Jones, and Vernon Stansell. STAFF PRESENT :City Manager Shana Yelverton, Assistant City Manager Ben Thatcher, Director of Finance Sharen Jackson, Chief of Fire Services Robert Finn, Chief of Police Services Wade Goolsby, Director of Planning and Development Services Ken Baker, Administrative Secretary Lorrie Fletcher, Director of Public Works Robert H. Price, City Attorney Tim Sralla, City Attorney Bryn Meredith and City Secretary Lori Payne. Agenda Item No. 1. Call to order. The work session was called to order by Mayor Pro Tem Morris at 6:08 p.m. The Executive Session was held at the end of the meeting. Agenda Item No. 4. Discussion and public input on the following items: a. Ordinance No. 480-RRR, Amending the Comprehensive Zoning Ordinance No. 480, as amended, as it pertains to oil and gas drilling and production. b. Amendment to the City’s Master Comprehensive Plan as it pertains to oil and gas drilling production, oil and gas production pad sites and natural resource extraction activities. c. Ordinance No. 880-A, Amending Section 9.5, Article IV, of the Southlake City Code regarding oil and gas well drilling and production. d. Road Repair Agreement Mayor Pro Tem Morris stated that staff will show a couple of videos relating to oil and gas drilling. She then allowed the public to comment on the oil and gas issues. The following persons spoke on the oil and gas issues: Joe Wright, 1640 South Brumlow Avenue, Southlake, Texas; Billy Bradbury, 3816 Benbrook Highway, Fort Worth, Texas; UNOFFICIAL SPECIAL CITY COUNCIL MEETING MINUTES, APRIL 23, 2008 Page 1 of 3 Del Gabaldon, 2968 Mesa Verde Trail, Grapevine, Texas; Jennifer Kessman, 711 Greymoor Place, Southlake, Texas; Zoe Courtney, 912 Raven Court, Southlake, Texas; Bob Catino, 935 Peytonville Court, Southlake, Texas, spoke on behalf of the North Peytonville Mineral Rights Owner’s Coalition; Lori Fergus, Saxon Trail, Southlake, Texas; James Miller, 2405 North Carroll Avenue, Southlake, Texas; Chip Reid, 715 Greymoor Place, Southlake, Texas; Tom Mathews, 2875 Exchange, Southlake, Texas; Mike Brian, 800 Independence Avenue, Southlake, Texas; Dale Crane, 1469 Sunshine Lane, Southlake, Texas; Emily Galpin, 1481 Post Oak Trail, Southlake, Texas; Joe Wright, 1640 South Brumlow Avenue, Southlake, Texas; Tom Allen, 9 Village Circle, Westlake, Texas; Brad Duerstone, 1360 North Sunshine, Southlake, Texas; Gary Nesbit, 2406 Emerald Circle, Southlake, Texas; Dan Emmer, 345 West Bob Jones Road, Southlake, Texas; and Rick Borkowsky, 1201 Cypress Creek Circle, Southlake, Texas. Mayor Pro Tem Morris called for a break at 7:54 p.m. and reconvened the meeting at 8:21 p.m. Public comments continued and the following persons spoke: Del Gabaldon, 2968 Mesa Verde Trail, Grapevine, Texas; and August Schilling, 1260 Taylor Street, Southlake, Texas. Council discussed the issues and suggestions raised by the speakers. Agenda Item No. 2. Executive Session: Pursuant to the Open Meetings Act, Chapter 551 of the Texas Government Code, Section 551.071, consultation with attorney, an Executive Session may be held to seek advice from the city attorney as to the posted subject matter of this meeting. Mayor Pro Tem Morris announced City Council would be going into Executive Session pursuant to the Texas Government Code Section 551.071, consultation with attorney. City Council adjourned for Executive Session at 8:44 p.m. Executive Session began at 9:10 p.m. and ended at 10:25 p.m. Agenda Item No. 3. Reconvene: Action necessary on any item discussed in Executive Session. Mayor Pro Tem Morris reconvened the special meeting at 10:28 p.m. Councilmember Terrell stated that Council wants to move these items forward with a few modifications at the second reading to include: adding a distance notification the greater of 200’ from the property boundary or 1,000’ from the actual pad, the pipeline or the access road; including in any variance request that it be signed off on by the surface UNOFFICIAL SPECIAL CITY COUNCIL MEETING MINUTES, APRIL 23, 2008 Page 2 of 3 owner; and recommending that a city-wide public information or gas summit presentation be put together by city staff to allow the gas companies and the public to come together for presentations at that time. Agenda Item No. 5. Meeting adjourned.
