EXECUTIVE
SUMMARY: Turner Phillips of Willow Tree Custom Homes, on behalf of Jason McMaster, is
requesting approval of a Plat Revision for 1275 and 1285 Shady Oaks Drive,
being a revision of Lots 2B2AR and 2B1, Block 1, Burnett Acres Addition.
Current Zoning: “SF-2” and “SF-1A” Single Family Residential District. SPIN
Neighborhood #5.
DETAILS: The purpose of this request is to seek approval of a Plat Revision to modify the
existing lot lines and abandon utility easements that are not needed.
Currently, the site consists of one lot of approximately 5.38 acres and one lot of
approximately 4.0 acres. The proposed revision will create Lot 2B1R, consisting
of 8.376 acres, and Lot 2B2AR1, consisting of 1.003 acres.

BACKGROUND INFORMATION

PROPERTY SITUATION: 1275 and 1285 Shady Oaks Drive
LEGAL DESCRIPTION: Lots 2B2AR and 2B1, Block 1, Burnett Acres Addition, City of
Southlake, Tarrant County, Texas.
LAND USE CATEGORY: Low Density Residential
CURRENT ZONING: “SF-2” and “SF-1A” Single Family Residential District
HISTORY:
The property was annexed into the City in 1956.
A plat was approved for Lot 2B1 on March 1, 1983.
A plat Revision for a portion of Lot 1, Block 1, Arnold Estates and Lot
2B2A, Block 1 Burnett Acres in Burnett Acres was approved in March of
1984.
“SF-1A” zoning was placed on the property in Burnett Acres with the
adoption of the current Comprehensive Zoning Ordinance No. 480.
A change of zoning to “RE” for Arnold Estates was approved by City
Council on January 2, 1990.
City Council approved a preliminary plat for Arnold Estates on
December 19, 1989.
A final plat for Arnold Estates was approved by City Council on February
20, 1990.
City Council approved a zoning change and concept plan from “RE”
Single Family Residential Estate District and “SF-1A” Single Family
Residential District to “SF-2” Single Family Residential District (ZA07-
0152).
A plat revision was filed with Tarrant County on February 12, 2009 for
Lot 2B2AR (ZA06-046).
A Zoning Change and Concept Plan to reconfigure the SF-2 and SF-1A
zoning boundaries around the properties was approved on June 2, 2026
(ZA26-0015).
SOUTHLAKE
COMPREHENSIVE PLAN: Future Land Use Plan
The Southlake Future Land Use Plan designates the subject property as
Low Density Residential.

Low Density Residential Purpose: The purpose of the Low-Density
Residential land use category is to provide for and to protect low
intensity detached single-family residential development that promotes
the openness and rural character of Southlake.
Definition: The Low-Density Residential category is for detached
single-family residential development at a net density of one or fewer
dwelling units per acre. Net density is the number of dwelling units per
net acre, which excludes acreage in all rights-of-way, easement, and
lots designated for public or private streets. Other suitable activities are
those permitted in the Public Parks/Open Space and Public/Semi-Public
categories. The Low-Density Residential category encourages the
openness and rural character of the City of Southlake.
Mobility Master Plan
The Master Thoroughfare Plan designates Shady Oaks Drive as a
“C2U” 60’ collector.
The Pathways Plan calls for future multi-use sidewalk minimum 8-foot
multi-use paved trail along the east side of Shady Oaks Drive and a
sidewalk of 5-foot minimum width along West Highland.

1. The following changes are needed according to the Subdivision Ordinance, as amended,
Sections 3.01, 3.03, & 8.01.
2. Place the City case number “ZA26-0058" in the lower right-hand corner of the plat. Remove
“ZA2026-0015”.
3. Revise the title block as follows:
a. Change the title to “Plat Revision”
b. Provide or revise the courthouse filing note as follows and place above the title block:
“Filed as Instrument # , Date .”
4. The following changes are needed with regard to the legal description: (name of survey and
abstract number; county and state; total acreage; calls match boundary, boundary in
heavy line) (reference to Lots and Blocks in previously filed subdivision OK with plat
record and confirmation that boundary is identical to previously filed plat)
a. The acreage in the legal description is mislabeled as 9.389 acres.

5. The following changes are needed with regard to adjacent properties within 200' to include
properties across any adjacent R.O.W.:
a. Show and label the name of the record owner & corresponding deed record
(volume & page) (Denton Co. may use clerk file number) for all unplatted tracts
.......... within 200 feet of this property.
b. Show and label the lot lines as dashed, lot & block numbers, street names, and
existing easements, and subdivision name and plat record (volume & page) (or
cabinet & slide, or cabinet & page) for all platted properties ........... within 200 feet
of this property.
6. Add the following notes to the face of the final plat:
a. Compliance with the provisions of the City’s Storm Drainage Policy does not
relieve a person of the responsibility of complying with all other applicable laws,
including, but not limited to, Section 11.086, Texas Water Code.
b. It is the property owner’s (or Home Owners Association) responsibility to maintain
all drainage easements and detention/retention structures on the property (within
the subdivision). (As amended per Ord. No. 483-R)
7. The following changes are needed with regard to easements:
a. Provide a letter from the utility company stating that they consent to the utility
easements being abandoned.
8. A sidewalk is required along the lot frontage of Shady Oaks Drive.
9. Show and label the 40' front yard building line.
10. Provide the Public Easement Abandonment note and signature blocks on the plat per

TREE CONSERVATION COMMENTS:
1. On the Tree Conservation Plan show the proposed temporary living quarters building as
proposed with the Zoning Board of Adjustments case ZBA26-0018.
* The proposed existing tree cover preservation complies with the existing tree cover
preservation requirements of the Tree Preservation Ordinance 585-E. There is 34.15% of existing tree
cover on the two properties and a minimum of 60% of the existing tree cover is required to be
preserved. A total of 67.80% of existing tree cover is proposed to be preserved, 23.37% is proposed
to be removed, and 8.83% is proposed as Marginal/Borderline to be preserved.
Except as provided by subsection 7.2.b. of the Tree Preservation Ordinance, a Tree Conservation
Analysis or Tree Conservation Plan shall be approved if it will preserve existing tree cover in
accordance with the percentage requirements established by Table 2.0. If the property has previously
received a tree permit related to development, the percentage of existing tree cover at the time the
first such permit was issued shall be used to calculate the minimum existing tree cover that must be
preserved under this section.

development. Alteration or removal of any of the existing trees shown to be preserved on the
approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and the zoning as
approved by the Southlake City Council. Please ensure that the layout of all structures, easements,
utilities, structures grading, and any other structure proposed to be constructed do not conflict with
existing trees intended to be preserved.

GENERAL COMMENTS:
1. The existing creek shall be located within a dedicated drainage easement. The drainage
easement located on the original 1275 Shady Oaks shall be extended to the northern most property
line of 1285 Shady Oaks.
2. Please add the following notes to the Plat:
a. Drainage Easements shall have no permanent structures, fences, and/or other
obstacles, as defined in the Subdivision Ordinance.
b. The property owner shall be responsible for maintaining the existing creek within the
dedicated drainage easement, as required by the Storm Drainage Ordinance 605.

The following should be informational comments only
* All plats filed must have an original signed and stamped Tax Certificate submitted with it from
each taxing unit with jurisdiction of the real property, indicating that no delinquent taxes are
owed and that taxes for the current year have been paid. After September 1st, a certificate
showing that the taxes for that year are paid, but that the taxes for the upcoming year have yet
to be calculated is required. (House Bills 1563 & 3101). A copy of this information may be
obtained from the Tarrant County Tax Assessor/Collector’s Office located at 100 E.
Weatherford St. in Ft. Worth (across from the old red courthouse). There is a service charge of

* Prior to approval of a final plat, the applicant must submit percolation tests and septic system
feasibility analysis for the proposed lots. Should this identify potential problems, the number of
lots may be required to be reduced in order to provide sufficient area for a functional septic
system or other innovative system as allowed by the Tarrant County Health Department.
* Please submit a revised pdf "check print" prior to submitting the paper copy with original
signatures.
* The applicant should be aware that prior to issuance of a building permit, all required fees
must be paid. This may include but not be limited to the following fees: Park Fee, Roadway
Impact Fee, Water & Sewer Impact and Tap Fees, and related Permit Fees.
* In addition to the City of Southlake impact fees, please be aware that through the wholesale
water customer contract with the City of Fort Worth, all new water connections are required to
pay the City of Fort Worth impact fee. The City of Fort Worth impact fee assessment is based
on the final plat recordation date and building permit issuance. The applicant is encouraged to
review the City of Fort Worth's assessment and collection of Impact Fees Guide to determine
the fee amount.
* For Tarrant County filing, original signatures and seals will be required on one 24” x 36”
blackline paper copy prior to filing the plat. The copy will not be accepted if any erasures or
original ink, other than signatures or seals, appear on the plat. The paper copy must have a
minimum ½ inch space between the paper edge and border.
* Public sanitary sewer is not available to these lots. A permit for and on-site sewer facility from
Tarrant County Health Department must be received prior to issuance of a building permit.
