PROJECT: 865 N. Pearson Lane – Special Exception Use for a Setback Reduction
EXECUTIVE
SUMMARY: Virginia Lemke is requesting a Special Exception Use per Zoning Ord. No. 480, as
amended, Section 44.12(6) for a setback reduction for an accessory structure, on
property described as Lot 2, Block 1, The Woods Addition, and located at 865 N.
Pearson Lane, Southlake, Tarrant County, Texas. Current Zoning: “SF-1A” Single
Family Residential District. Applicant and Property Owner: Virginia Lemke. SPIN
Neighborhood #11.
REQUEST: The purpose of this request is to seek approval of a Special Exception Use to reduce
the required rear yard setback for a detached patio cover. In the “SF-1A” zoning
district, accessory structures exceeding 500 square feet are required to meet the
principal structure setback standards from adjacent lots.
The property is approximately 1.57 acres. The applicant proposes to construct a
detached patio cover measuring approximately 1,063 square feet (36 feet 8 inches by
29 feet) over an existing concrete patio. The proposed patio cover would have a
height of 10 feet and be approximately 23 feet 9 inches from the rear property line.
The required rear setback is 40 feet, resulting in a setback reduction of approximately
16 feet 3 inches.
Per Zoning Ordinance No. 480, as amended, Section 44.12.6, a Special Exception
Use is required for a setback reduction for an accessory structure.

CURRENT ZONING: “SF-1A” Single Family Residential District
HISTORY: The property was annexed to the City in 1988.
A Final Plat (ZA96-142) was approved on November 7, 1996.
The existing home was built in 2002.
A Variance (ZBA26-0009) for a setback reduction for the addition of an
attached patio cover was denied on June 11, 2026.
UTILITIES: The property is served by a 12-inch and 30-inch water line main and an 8-inch
sewer line main along N. Pearson Lane.
STAFF COMMENTS: The application and exhibits are provided in this Staff Report.
The findings necessary for the Board to approve a Special Exception Use are
below:
1) No special exception shall be granted unless the Board finds that the
requested exception is specifically permitted by the zoning ordinance.
2) That the location of the proposed activities and improvements is
clearly defined on the concept plan or plot plan, and
3) That the special exception is wholly compatible with the use and
permitted development of adjacent properties either as filed or subject
to such limitations and requirements as the board deems to be
necessary to protect adjacent properties.
