Item 9 - Staff ReportCase No. ZBA26-0012 S T A F F R E P O R T August 21, 2026 CASE NO: ZBA26-0012 PROJECT: 1319 Oakhurst Drive – Variance to Side Yard and Rear Yard Setback EXECUTIVE SUMMARY: Cory Anthony, on behalf of Richard and Jeanne Briggs, is requesting a Variance to Sections 15.1, 14.5(c), and 14.5(d) requiring a minimum side yard setback of 15 feet and a rear yard setback of 40 feet, on property described as Lot 9, Block 3, Continental Park Estates Addition, and located at 1319 Oakhurst Drive, Southlake, Tarrant County, Texas. Current Zoning: “SF-20B” Single Family Residential District. SPIN Neighborhood #10. REQUEST: The purpose of this request is to seek approval of variances to Zoning Ordinance No. 480, as amended, Sections 15.1, 14.5(c), and 14.5(d), which require a minimum side yard setback of 15 feet and a rear yard setback of 40 feet in the “SF-20B” zoning district. The approximately 0.73-acre property contains an existing residence with an attached covered patio that encroaches into the required rear yard setback and an attached carport that encroaches into the required side yard setback. The applicant proposes to construct an approximately 1,939-square-foot addition to the residence and approximately 965 square feet of attached garage space, for a total addition of approximately 2,904 square feet. The project also includes minor patio reconfigurations. While the proposed additions comply with the required setbacks, the requested variances are necessary to recognize the existing nonconforming encroachments as part of the proposed expansion. Based on the provided plans, the existing side yard setback is approximately 6 feet from the property line to the existing carport, while the rear yard setback is approximately 12 feet 4 inches from the existing structure to the property line. As a result, the requested variances would allow a reduction of approximately 9 feet in the required side yard setback and 27 feet 8 inches in the required rear yard setback. The property currently contains an existing shed and carport located within the required side yard setback. Following the proposed additions, the total lot coverage will be approximately 22.1% (7,016 square feet), excluding covered patios and porches. To authorize in specific cases variances from the terms of this ordinance as will not be contrary to the public interest, where due to special conditions, a literal enforcement of the provisions of this ordinance would result in unnecessary hardship and where the spirit of the ordinance is observed and substantial justice is done. A variance shall not be granted by the Board of Adjustment except in accordance with the following: 1. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district; 2. That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this ordinance; 3. That the special conditions and circumstances do not result from the actions of the applicant; 4. That granting of the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures, or buildings in the same district.
