Action

Background
Information: The purpose of this item is to seek City Council approval of a
driveway variance to allow a separate driveway for 2150 E. Dove
Road in lieu of the shared driveway required as part of the plat
showing approval for F. Throop No. 1511, Lots 57R and 58R (2117
and 2150 E. Dove Road, respectively).
On August 20, 2019, City Council approved a plat showing (ZA19-
0040) to reconfigure two existing tracts into two residential lots
conforming to the "SF-1A" Single Family Residential District. As part
of that approval, variances were granted to allow reduced driveway
spacing from adjacent residential and commercial driveways, as well
as non-standard lot configurations, including irregular side lot lines
and a panhandle lot. To address the reduced driveway spacing, City
Council required the two lots to share single driveway access onto
E. Dove Road.
Following the plat approval, a residence was constructed at 2117 E.
Dove Road. At the time, both 2117 and 2150 E. Dove Road were
under one ownership. An entry gate was subsequently installed
within the shared driveway, which was not shown on any of the
approved permit plans. The front fence and gate were inspected with
the house and pool and are required as part of the pool barrier.
However, these inspections were specifically for electrical code

compliance and pool barrier safety only. Now, 2150 E. Dove is under
different ownership and a home is currently under construction.
The requested variance is the result of site constraints created by the
existing gate and gate call box. Their location significantly limits the
area available for constructing a separate driveway connection for
2150 E. Dove Road and creates a restricted turning radius for
vehicles entering the property. In addition, the existing shared
driveway is approximately 12 feet wide and cannot be widened
because of these physical constraints, resulting in operational
conflicts when vehicles are entering and exiting simultaneously.
The proposed driveway for 2150 E. Dove Road would be located at
the same location as the driveway that historically served the parent
tract prior to subdivision and is currently being used for construction
access. The driveway would be approximately 115 feet from the
commercial driveway to the east and approximately 90 feet from the
residential driveway to the west. While the proposed spacing does
not fully comply with current driveway separation requirements, it is
generally consistent with the intent of the original variance approval
and would alleviate operational issues associated with the existing
shared driveway arrangement.
