Action
Requested: Approve an Encroachment and Joint Use Agreement for storm
shelters within a drainage easement for Novus Academy located at
2250 E. Continental Boulevard.
Background
Information: The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for the installation of storm
shelters within a drainage easement for the Novus Academy
development located at 2250 E. Continental Blvd. This agreement
will allow the developer to place storm shelters within the existing
parking spaces along the north side of the property within a 15-foot
drainage easement.
The drainage easement was dedicated to allow for cross lot drainage
through a private storm system. Drainage from 940 S. Kimball and
2150 E. Continental is captured in a private curb inlet and into the
private storm system that runs along the northern boundary of 2250
E. Continental and outlets into the existing detention pond. The
storm shelters will be located directly on top of the private 24-inch
storm pipe, and between two curb inlets. The storm shelters will not
alter the existing drainage path and will not impact the existing storm
infrastructure. There is no public infrastructure within the 15-foot
drainage easement.

Considerations: This is a no cost agreement.
