Subject: Variance Request – Subdivision Ordinance No. 483 (as amended) and
Master Pathways Plan
I, Mario Montemayor, am the owner of the property located at 1234 Timberline Court,
Tract 1B07C, Harrison Decker Survey, Abstract No. 438 Addition. I respectfully submit
this formal request for a variance to Subdivision Ordinance No. 483, as amended, and the
Master Pathways Plan, in connection with the construction of a new single-family
residence on the aforementioned property.
The applicable ordinance requires the installation of a sidewalk along the property
frontage. However, the street where the subject property is located does not currently
include sidewalks for any of the existing homes. As such, the installation of a sidewalk
solely on this property would create an inconsistency with the established neighborhood
character and aesthetic continuity of the area.
The surrounding properties reflect a uniform streetscape that is not designed with
pedestrian pathways, and the addition of a sidewalk in this instance would be visually out
of context with the existing environment. Maintaining consistency with the
neighborhood’s established character is an important consideration in preserving the
overall aesthetic integrity of the area.
In light of the above, I respectfully request your kind consideration and approval of this
variance. Granting this request would allow the proposed development to remain
harmonious with the existing neighborhood conditions while complying with the intent of
preserving community character.
