ZONING DISTRICT, AS DEPICTED ON THE APPROVED
DEVELOPMENT PLAN ATTACHED HERETO AND

ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A
PENALTY FOR VIOLATIONS HEREOF; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE
OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Southlake,Texas is a home rule City acting under its Charter
adopted by the electorate pursuantto Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Texas Local Government Code; and,
WHEREAS, pursuantto Chapter211 of the Local Government Code, the City hasthe
authorityto adopt a comprehensive zoning ordinance and map regulating the location and use
of buildings,other structures and land for business, industrial, residential and other purposes,
and to amend said ordinance and map for the purpose of promoting the public health,safety,
morals and general welfare, all in'accordance with a comprehensive plan; and,
WHEREAS, the hereinafter described property is currently zoned as "AG" Agricultural
District under the City's Comprehensive Zoning Ordinance; and,

WHEREAS, a change in the zoning classification of said property was requested by a
person or corporation having a proprietary interest in said property; and,
WHEREAS,the City Council of the City of Southlake,Texas, at a public hearing called
by the City Council did considerthe following factors in making a determination as to whether
these changes should be granted or denied:safety of the motoring public and the pedestrians
using the facilities in the area immediately surrounding the sites; safety from fire hazards and
damages; noise producing elements and glare of the vehicularand stationary lights and effect
of such lights on established characterof the neighborhood;location,lighting and types of signs
and relation of signs to traffic control and adjacent property; street size and adequacy of width
fortraffic reasonably expected to be generated by the proposed use around the site and in the
immediate neighborhood; adequacy of parking as determined by requirements of this
ordinance foroff-street parking facilities; location of ingress and egress points for parking and
off-street loading spaces, and protection of public health by surfacing on all parking areas to
control dust; effect on the promotion of health and the general welfare; effect on lightand air;
effecton the over-crowding of the land;effecton the concentration of population,and effecton
transportation, water, sewerage, schools, parks and other public facilities; and,
WHEREAS, the City Council of the City of South lake,Texas,further considered among
otherthingsthe character of the districts and their peculiarsuitabilityfor particularuses and the
view to conserve the value of the buildings,and encourage the most appropriate use of the
land throughout this City; and,
WHEREAS, the City Council of the City of South lake,Texas, does find that there is a
public necessityforthe zoning changes,thatthe public demands them,that the public interest
clearly requires the amendments,and that the zoning changes do not u n reasonably invadethe
rights of those who bought or improved property with reference to the classification which

existed at the time their original investment was made; and,
WHEREAS,the City Council of the City of South lake,Texas, does find that the changes
in zoning lessen the congestion in the streets, helps secure safety from fire, panic,and other
dangers, promotes the health and the general welfare, provides adequate light and air,
prevents the over-crowding of land, avoids undue concentration of population,and facilitates
the adequate provision of transportation, water, sewerage, schools, parks and other public
requirements; and,
WHEREAS, the City Council of the Cityof Southlake,Texas, has determined that there
is a necessity and need for the changes in zoning and has also found and determined that
there has been a change in the conditions of the property surrounding and in close proximity
to the tract or tracts of land requested for a change since the tract or tracts of land were
origin ally classified and therefore feels that the respective changes in zoning classification for
the tract or tracts of land are needed,are called for, and are in the best interest of the public at
large, the citizens of the city of South lake,Texas,and helps promote the general health,safety
and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No.480,the Comprehensive Zoning Ordinance of the City of Southlake,
Texas, passed on the 19th day of September, 1989, as origin ally adopted and amended, is
hereby amended so that the permitted uses in the hereinafter described areas be altered,
changed and amended as shown and described below:
Being described as Tracts 1A and 1A03, James J. West Survey Abstract No.
1620 to the City of Southlake, Tarrant County, Texas, being approximately 40
acres, and more fully and completely described in Exhibit "A" from "AG"
Agricultural Districtto "ECZ" Employment Center Zoning District as depicted on
Ordinance No. 480-837
the approved Development Plan attached hereto and incorporated herein as
Exhibit"B", and subjectto the following conditions:
October 21, 2025; Approved (5-1) subject to the Staff report dated October
13, 2025, and the Zoning Change and Development/Site Plan Review
Summary No. 5, dated October 13, 2025, and noting the following:
Approving variances to the Driveway Ordinance No. 634 for stacking depth
where a minimum 100-feet is required:
- For Driveway 4, 26-feet is provided; and applicant agrees to work with the
adjacent Lambert Homes on secondary access, as discussed this evening.
- For Driveway 5, 58-feet is provided.
- For Driveway 7, 33-feet is provided.
Approving a zoning change and development/site plan changing the zoning
from "AG Agricultural District to "ECZ" Employment Center Zoning District,
as presented with the following stipulations:
For the commercial portion of the development
As it pertains to commercial buildings:
- Thatthe building heightforall commercial buildingswill be a minimum of 18
feet and a maximum of 65 feet.
- The only building permitted to exceed this heightthreshold will be the hotel
at a maximum of 84 feet so long as it is within 1,100 feet of the northern
boundaryof State Highway 114 butno closerthan 300feetfrom W. Kirkwood
Boulevard as specified in the submitted development standards by the
applicant.
- The articulation depicted on the renderings will be carried through on the
construction plans submitted for permit.
As it pertains to the Specific Use Permit:
- That the future Hotel,entertainment ven u e,or retail/restaurant will only be a
permitted use provided that a Specific Use Permit with a Site Plan and
elevations be submitted and approved by the City Council at a future date.
As it pertains to circulation on the site:
- That traffic calming measures such as parallel parking, landscape islands
and enhanced paving at pedestrian crossings along Promenades A & B be
installed subjectto approval from our Public Works Director.
-Approvingthe golfcartparking spaces as depicted on the development plan.

As it pertains to Lot 1 (or the Hotel Lot):
- The future hotel within the development will be a full-service ,hotel as
described in the City's Future Land Use Plan and the DevelopmentStandards
provided by the applicant.
- Also, noting again that an entertainment venue or traditional retail and
restaurant, and that any such uses would require a future SUP and Site Plan
approval.
As it pertains to Lot 2:
- A 10-foot masonry wall will be installed adjacent to the loading dock area
along with tall evergreen shrubs; Noting that tall is notated at ft. at maturity
- A 6-foot masonry screen wall and continuous row of tall (4 ft at maturity)
evergreen shrubs will be installed adjacent to W. Kirkwood Blvd. as depicted
on the Landscape Plan to provide additional screening.
- Notinga continuousrow of tall (4 ftat maturity)evergreen shrubsaroundthe
detention pond to provide screening from State Highway 114 as depicted on
the Landscape Plan.
As it pertains to Lot 3:
-Allowing the use ofa drive-thru to be onlyfora financial orbanking use,with
the drive through canopyalso serving as a fullyfumished outdoorpatio on the
2nd level of the office building.
- On the pad site adjacent to N. White Chapel,a continuous row of tall (4 ft at
maturity) evergreen shrubs is to be installed to provide screening along N.
White Chapel and the shared drive with Lambert Homes as depicted on the
Landscape Plan.
For the Residential portion of the development
As it pertains to all homes:
- Noting the setbacks for all residential lots will be 25-feet in the front, 8-feet
for the side, and 30-feet forth e rear.
- No more than two front home elevations shall be similar and shall be
separated by at least 4 homes on the same street.
- No more than 7 homes will be granted forward facing garages and thatthe
7 forward facing garages are allowed on lots 2-14 on the south portion of the
residential per the "Garage Orientation" plan dated October 21, 2025.

As it pertains to homes on Lot 4:
- Lot 4 detached single family residential lots shall have a minimum lot width
of 83 feet, a minimum lot depth of 145 feet and a minimum lot area of 12,000
square feet.
As it pertains to homes on Lot 5:
- Lot 5 detached single family residential lots shall have a minimum lot width
of 80 feet, a minimum lot depth of 125 feet and a minimum lotarea of 10,000
square feet.
-The applicantis granted a reduction of 12 feet additional space,west of Lots
18 and 19, to be taken from the internal park area, and to be added to the
width of Lots 15—22 residential as depicted on the "Garage Orientation"plan
dated October 21, 2025.
For the Phasing of the Project
- The development will be constructed per the phasing plan presented this
evening.
For the Maintenance of the development:
- The applicant agrees to submitting CC&R's to the City prior to final plat
recording for City Attorney review ensuring maintenance in perpetuity of all
open space and amenities in the commercial and residential portions of the
development and filed in the County records as described in the Open Space
Standards and Management Letter.
Miscellaneous
-The applicantagrees to adjustthe planned 56live oaks to no more than 50%
live oak in the commercial developmentwith the remaining being an assorted
variety of variations of oaks
- Delivery times to the commercial portion of the application will be the same
as what was approved for Central Market.
- Construction traffic on this application will be limited to State Highway 114
entrance and exit, except for the improvement related to Whites Chapel and
the approach to the Kirkwood tie-in.
- Removing Gas Stations as an approved use.

ZONING CHANGE & DEVELOPMENT/SITE PLAN REVIEW SUMMARY

1. All driveways/points of ingress/egress must comply with the Driveway Ordinance No. 634, as
amended). Driveway Ordinance No. 634 - stacking depth variance where a minimum 100' is
required, approximately 26' is provided on Driveway 4, 58' on Driveway 5, 33' on Driveway 7.
(Variance Requested)
Any additional turn lanes needed will require an additional 12' of ROW with an
appropriate stacking lane and transition.
2. Provide minimum lot area, width and depth for each residential section in the development
standards and on the development site plan. Use square footage as the unit of measure on
area. The typical shown or stated do not appear to match what is intended in the area
identified on Sheet C102 and identified as the Lot 4 Area.
3. Ensure and correct as needed the exterior building and roof materials to be consistent with the
materials labeled on the exterior elevation plans and renderings. Clearly identify commercial
core and residential. Each must be consistent with the elevations and the renderings as
presented prior to issuance of a building permit.
4. Provide the following required by the City Council's 15l reading approval:
a. Construction Phasing Plan and timeline.
b. Identify non-street facing residential garage lots.
C. Identify optional gas station location.
Buildings 1 and 13 have not included all information needed for a Site Plan approval as part of
the overall Development Plan. Site Plan approval by P &Z and City Council will be required for
these buildings prior to issuance of a Building Permit
EV charging stations are only permitted after approval of a Specific Use Permit in accordance
with Section 45 of the Zoning Ordinance No. 480, as amended.
Shopping carts must be screened of view in accordance with Section 34.1(x).
Separate sign permits are required as none are approved under this plan. A Master Sign Plan
is encouraged for this development and is achieved through a separate permit approval by
Sign Board and City Council. Building facades indicating murals and/or artwork need to be
identified in a Master Sign Plan or through a Mural Plan. Any sculptures or other similar art
structures must comply with adopted art policies and receive an appropriate building permit
prior to installation or construction.
Tree Conservation/Landscape Review
TREE CONSERVATION COMMENTS:
1. The existing trees around the Shivers house are not included within the overall tree survey.

There are trees that fall within the building pad area of the proposed restaurant, but there are
others that are within landscape area between the proposed restaurant building and the N.White
Chapel Blvd. right-of-way.One (1) or two (2) of the trees are dead, but the others seem to be
healthy.
* Approval of the tree preservation plan shall be based on the criteria for non-standard zoning
districts, ECZ specifically, as noted below. For comparative purposes, if the development was
proposed as standard zoning it would not comply with the existing tree cover preservation
requirements of the Tree Preservation Ordinance. There is 3.5% of existing tree cover and a
minimum of 70%would be required to be preserved.A maximum of 11.9% of existing tree cover
is proposed to be preserved.
* Except as provided by subsection 7.2.b. of the Tree Preservation Ordinance, a Tree
Conservation Analysis or Tree Conservation Plan shall be approved if it will preserve existing
tree cover in accordance with the percentage requirements established by Table 2.0. If the
property has previously received a tree permit related to development, the percentage of existing
tree cover at the time the first permit was issued shall be used to calculate the minimum existing
tree cover that must be preserved under this section.

*The minimum percentage of existing tree cover to be preserved shall exclude any area in
public rights-of-way as approved by City Council.
For property sought to be zoned for the Downtown zoning district or a planned development
zoning district, including an S-P-1 Site Plan, S-P-2 Site Plan, Transition, Rural Conservation,
Planned Unit Development, or Employment Center zoning district, the City Council shall
consider the application for a Conservation Analysis or Plan in conjunction with the
corresponding development application (as established in Table 1.0). The Planning and Zoning
Commission shall review the application and make a recommendation to the City Council
regarding the application. The City Council shall approve the Plan or Analysis if the Council
finds that the Plan or Analysis provides for the:
i. placement of building pads, parking areas, driveways, streets, and utility easements so
as to maximize the preservation of environmental features of the property including
mature tree stands, natural creeks and ponds, and significant grades;
ii. maximizes the preservation of tree cover preservation areas indicated on the
Environmental Resource Protection Map;
iii. maximizes the preservation of existing tree stands with the potential to buffer residential
areas from the noise, glare, and visual effects of nonresidential uses;
iv. maximizes the preservation of existing trees, if any, adjoining a natural or man-made
drainage creek;

V. maximizes the preservation of existing protected trees along rural roadways and other
streets as identified and prioritized in the Street Typology designation; and
vi. mitigation of altered trees through proposed tree replacement procedures pursuant to
this Ordinance.
Please be aware that all existing trees shown to be preserved on the City Council approved Tree
Conservation Plan must be preserved and protected during all phases and construction of the
development. Alteration or removal of any of the existing trees shown to be preserved on the
approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and the
zoning as approved by the Southlake City Council. Please ensure that the layout of all structures,
easements, utilities, structures grading, and any other structure proposed to be constructed do
not conflict with existing trees intended to be preserved.
LANDSCAPE COMMENTS:
The Development Standards proposed to be exempt from the Landscape Ordinance and
Bufferyards regulations. The landscaping is proposed as shown.

Public Works/Engineering Review
GENERAL COMMENTS:
1. The sidewalks are not shown on the Site Plan.
2. The driveway that extends from the proposed round-a-bout to SH 114 was changed to a private
drive, however, it still looks and feels like a public street. Please revise the drive to look more
like a private driveway into a shopping center rather than a publicly maintained street. Some
suggestions may be to add a chicane or meander the drive through the parking area in lieu of
doing a straight line, or adding head-in or angled parking with appropriately spaced landscape
islands along the drive.
3. This review is preliminary. Additional requirements may be necessary with the review of the
civil construction plans.
Entrances off SH114 shall require approval from TxDOT.
Ensure that communication is done with NuStar since their gas line runs along the SH114
f rontage.
UTILITY.COMMENTS:
The lift station that services this project area is nearing its firm capacity for peak wet weather
flows based on the North Service Area Wastewater Master Plan Update by Freese and Nichols,
Inc., dated January 2025. Trademark's engineer provided a projected a peak wastewater flow
of 0.151 MGD for the proposed development, which is approximately 35.1% of the additional
0.43 MGD pumping capacity required. Staff are reviewing options for expanding the capacity of
the Loch Meadows Lift Station by adding a third pump, which would require an assessment to
confirm pump sizing and necessary improvements.
Water services maintained by the City shall be installed within a public ROW,or dedicated water
line easement. Please show the proposed waterline easements, where necessary.
Public sewer lines shall be located within public ROW,or dedicated sewer easements. Please
show the proposed sewer easements, where necessary.

* An existing 12-inch water line is located in E. Kirkwood Blvd that has a break between the
Metairie subdivision and N. White Chapel. There is also a 12-inch water line along the SH114
frontage road. The proposed development will completing the 12-inch water line in E. Kirkwood
and extend the 12-inch water line along the SH114 frontage. An 8-inch internal water line loop
is also proposed for the development. An 8-inch sanitary sewer will connect to the existing 8-
inch sanitary sewer stub off N. White Chapel.
DRAINAGE COMMENTS:
* There is an existing storm inlet on N. White Chapel just north of the proposed driveway that will
require relocation within the installation of the right turn deceleration lane. Please be aware that
the location shown on the storm plan is not correct,and this inlet was moved further north to be
directly across N. White Chapel from the just north of the Carillon Parc drive.
* The existing inlet near the intersection of N. White Chapel and E. Kirkwood will need to be
relocated with the continuation of E. Kirkwood.
* Public storm drain will be required to be located within public ROW or a dedicated drainage
easement.
* The proposed detention pond shall be located within a dedicated drainage easement.
* Ensure that there is adequate clearance between the proposed storm pipe connection to the
TxDOT infrastructure and the existing gas line.
* TxDOT approval will be required for the storm connection to their infrastructure.
* The property drains both west toward the SH114 frontage road and east toward N. White
Chapel, with a natural high point near the center of the property in existing conditions. The
proposed drainage design, done by Kimley Horn,will capture runoff in a storm drain system that
outlets into a proposed detention pond near the SH 114 frontage road and ultimately outlet into
the TxDOT storm system. The drainage areas along the SH 114 Frontage Road will follow
existing conditions and flow directly towards the SH 114 Frontage Road. A small portion of the
proposed southern drive onto N. White Chapel will follow existing conditions and flow into the
N. White Chapel storm system.
TRAFFIC IMPACT ANALYSIS:
4. TIA pg. 10 (PDF pg. 16): Table 1 —Trip Generation shows the Office portion of the development,
ITE code 710, as a separate land use. The Office gross lease area should be included with the
Shopping Plaza land use, ITE code 821, as it is a typical tenant for that land use. Alternatively,
all elements of the Shopping Plaza land use can be separated into their individual land uses. In
either case, provide justification in the report for the methodology that is chosen.
5. TIA pg. 28 (PDF pg. 34): The Conclusions and Recommendations section indicates that a one-
lane roundabout performs favorably at Kirkwood Blvd. and Drive 1. However, this section of
Kirkwood Boulevard is identified as an A4D Arterial on the City of Southlake's Master
Thoroughfare Plan, and must therefore meet all standard requirements for arterial roadways in
the City of Southlake. The roadway will be 4-lane divided within a 100' right-of-way(ROW),and
any intersection proposed to be a roundabout will be a two-lane roundabout. This configuration
has been revised in the site plan dated July 28, 2025, but has not been updated in the TIA.
Please revise the applicable sections of the report, exhibits, and analyses to reflect the two-lane
roundabout.

Fire Department Review
GENERAL COMMENTS:

An automatic fire sprinkler system shall be installed in any residential structure that exceeds
6,000 square feet, excluding porches and patios.
An automatic fire sprinkler system shall be installed in A-2 occupancies (restaurants) where
one of the following conditions exists: 1. The fire area exceeds 5,000 square feet 2. The fire
area has an occupant load of 100 or more.
The required backflow protection (double check valve)for the sprinkler systems in the _
commercial development can be located on the riser if the riser is within 100 feet of the water
main, measured linearly along the length of the pipe. If the riser is further than 100 feet from
the main, the double check valve shall be in a vault. Riser rooms shall be a minimum of 5'X5'
if the double check is not located on the riser, or a minimum of 6'X6' if it is located on the riser.
(Riser room locations &water main for commercial development not indicated on plans)
Firefighter air replenishment system (FARS) shall be provided in new buildings that are 5 or
more stories in height.
FIRE HYDRANT COMMENTS:
Fire Department Connections for sprinkler systems must be within 100 feet of a fire hydrant,
and within 50 feet of fire department fire lane access.
Hydrants required at maximum spacing for R-3 Occupancies is 400 feet for subdivisions with
un-sprinklered homes or 600 feet for subdivisions with all homes sprinklered.
Fire hydrants are required at a maximum spacing of 300 feet for commercial locations that
contain both sprinklered and unsprinklered buildings.
FIRE LANE COMMENTS:
Fire apparatus access needs to be provided within 150 feet of all exterior portions of the
perimeter of buildings on a "hose-lay" basis for un-sprinkled buildings and 250 feet for
sprinklered buildings. (Hose lay exceeds 250 feet to all exterior portions from a fire lane for
Building A-2 and Building A-3 if barrier or fencing would prevent access from the street)
Fire apparatus access needs to be an all-weather surface, asphalt or concrete, 24 feet wide
and able to support the imposed loads of fire apparatus. (Minimum of 85,000 pounds GVW).
Dead-end fire apparatus access cannot exceed 150 feet.
Fire access roads in residential subdivision must beat least 31 ft.back of curb to back of curb.
(Standard street width )
Fire apparatus access requires a minimum 30 foot inside turn radius and a minimum 54 foot
outside turn radius. (Turns throughout the residential development measure less than this
requirement. )
The entry/exit access control devices that impede the designated fire access road on the
residential subdivision must be equipped with an Opticom for opening the gate electronically,
as well as a means for manual opening of the gate. Where the fire apparatus access road
consists of a divided roadway at the access gates, the gate width must not be less than 12
feet.

Manual emergency access gates must be provided with a Knox padlock to secure.
General Informational Comments
No review of proposed signs is intended with this site plan. A separate building permit is required
prior to construction of any signs.
Building permit(s) are required prior to commencement of any work.
All mechanical equipment must be screened of view from right-of-ways and residential
properties in accordance with the Zoning Ordinance No. 480, as amended.
All lighting must comply with the Lighting Ordinance No. 693, as amended.
All development must comply with the Drainage Ordinance No. 605 and the Erosion and
Sediment Control Ordinance No. 946, as amended.
The applicant should be aware that prior to issuance of a building permit a Plat must be
processed and filed in the County Plat Records, a fully corrected site plan, landscape plan,
irrigation plan, and building plans, must be submitted for approval and all required fees must be
paid. This may include but not be limited to the following fees: Park Dedication Fee, Roadway
Impact Fee, Water& Sewer Impact and Tap Fees, and related Permit Fees.
In addition to the City of Southlake impact fees, please be aware that through the wholesale
water customer contract with the City of Fort Worth, all new water connections are required to
pay the City of Fort Worth impact fee. The City of Fort Worth impact fee assessment is based
on the final plat recordation date and building permit issuance. The applicant is encouraged to

SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City
of Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described
shall be subject to all the applicable regulations contained in said Zoning Ordinance and all
other applicable and pertinent ordinances for the City of Southlake, Texas. All existing
sections, subsections, paragraphs, sentences,words, phrases and definitions of said Zoning
Ordinance No. 480-837
Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and
affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in
accordance with the comprehensive plan for the purpose of promoting the health, safety,
morals and the general welfare of the community. They have been designed, with respect to
both present conditions and the conditions reasonably anticipated to exist in the foreseeable
future; to lessen congestion in the streets; to provide adequate light and air; to prevent over-
crowding of land; to avoid undue concentration of population; and to facilitate the adequate
provision of transportation, water, sewerage, drainage and surface water, parks and other
commercial needs and developmentof the community. They have been made after a full and
complete hearing with reasonable consideration among other things of the character of the
district and its peculiar suitability forth particularuses and with a view of conserving the value
of buildings and encouraging the most appropriate use of land throughoutthe community.
SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall notrepeal anyof the provisions of said ordinances exceptin
those instances where provisions of those ordinances are in direct conflictwith the provisions
of this ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable' and
that if the validity of the zoning affecting any portion of the tract or tracts of land described
herein shall be declared to be invalid,the same shall notaffect the validity of the zoning of the
balance of said tractor tracts of land described herein.

SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcementof any of the provisions of this ordinance shall be
fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances
affecting zoning which have accrued at the time of the effective date of th is ordi nance;and,as
to such accrued violations and all pending litigation, both civil and criminal,whether pending in
court or not, undersuch ordinances,same shall not be affected by this ordinance butmay be
prosecuted until final disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance in its entirety on the City website together with a noticesetting outthe time and place
fora public hearing thereon at least ten (10) days before the second reading of this ordinance,
and it this ordinance providesfor the-imposition of any penalty,fine or forfeitu refor anyviolation
of any of its provisions, then the City Secretary shall additionally publish this ordinance in the
official City newspaper one time within ten (10) days after passage of this ordinance, as
required by Section 3.13 of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effectfrom and after its passage and publication
as required by law, and it is so ordained.

Building Articulation Buildings must incorporate strong vertical proportions through use of window
groupings,siding orientation,and tall,narrow fenestration.Facades over 150feet in
length shall incorporate projections such as porches,recessed entries,or changes in
material to break up wall planes.At least one major fa4ade element shall provide
covered outdoor space oriented to the street or public realm,whichever is closest.
Exterior Materials Permitted materials include painted brick,wood or fiber-cement lap siding,wood or
fiber-cement board-and-batten siding,wood accents,engineered wood products
with integral finish(such as Hardie or equivalent fiber-cement),cast stone,cast
stone veneer,painted structural steel,and factory-finished metal.Colors shall be
drawn from a palette of light neutrals,off-whites,and muted earth tones,with
limited use of dark contrasting trim.Natural finishes such as stained wood are
encouraged at entries and porches and as accents.Limited use of cast-in-place
concrete allowed for accents.
Roof Materials Slate,synthetic slate,factory-finished standing seam,architectural metal panel,or
similar quality architectural materials will be required on visible roofs and limited to
dark,slate gray,light gray/tin or other earth tone/neutral colors.Clay tile and
concrete tile is prohibited.Shingle is not preferred but may be used sparingly and
must be dark gray.
Prohibited Materials Prohibited materials include unfinished concrete block,unfinished concrete,precast
concrete,vinyl siding,and EIFS or other stucco skin systems except when used
sparingly fortrim.Highly reflective or tinted glass curtainwalls,neon or bright
metallic colors,and other bright synthetic finishes are prohibited.Corrugated
fiberglass or plastic panels are not permitted as siding or roofing.Painted or
limewashed brick is preferred,but dark,tan or redish/clay brick may be used where
consistent with the approved palette.Ceramic tile is prohibited unless expressly
approved for use as an accent material.
Windows and Doors Windows shall be vertically proportioned.Simulated divided light windows shall use
exterior muntins permanently affixed to the glass surface.Garage and service doors
facing the public realm shall be recessed or detailed to match the primary building
style.
Awnings A covered occupiable porch(for seating or gathering),excluding building entries or
shelters,must be a minimum depth of sic(6)feet.Porches shall be constructed as
integral components of the building and shall not appear as afterthought
appendages.Columns or supports shall be simple in form and constructed of
treated wood,painted metal,cementitious wrap,or masonry consistent with the
approved exterior material palette.Decorative brackets,ornate trim,or stylistic
elements inconsistent with the permitted architectural character are prohibited.
Porch ceilings shall be finished with wood,painted board,or similar high-quality
material.
Awnings,where provided,shall be rectangular in form and constructed of canvas or
standing-seam metal mounted to steel or aluminum framing.Awnings shall be
limited to neutral or dark solid colors consistent with the overall color palette of the
building.Striped,scalloped,or highly ornamental awnings are prohibited.Awnings

Open Space Standards:
All open space areas shall be fully landscaped with appropriate materials to be
healthy, thriving and sustainable, and shall be irrigated in a manner appropriate to
the needs of such landscape materials and the local environment.
The internal park within the residential area shall contain walking trails, benches
and/or a gathering area, along with canopy and accent trees, shrubbery and ground
cover consistent with the Southlake Landscape Ordinance.
Open Space Management Plan:
Intended Usage: The common open space areas of the project are intended for the
quiet enjoyment of the customers, tenants and occupants within the development.
All sidewalks are intended for pedestrian traffic, shall be kept in good condition, and
accessible to the occupants and customers.
The Single-Family Open Space shall be maintained by the property owners or the
Property Owners Association (POA) and the Commercial Open Space shall be
maintained by the property owners or a Commercial Property Management Company
(Commercial PM) with credible experience operating a grocery anchored mixed use
project.The POA shall have the ability to assess fees required for the maintenance of
the open space areas and other POA activities. The Commercial PM shall be
responsible for collecting Common Area Maintenance fees from Commercial tenants.
The POA shall be responsible for the maintenance and operation of the open space
within the Single-Family development. The expenses required to maintain the
common areas at a quality level shall be estimated annually by the POA Board, and
dues shall be determined and assessed on each property owner in an equitable fashion
at such a rate as necessary to maintain such a level of quality. Authority to enforce
these requirements, and to place a lien on the property if such dues are not paid, shall
be in the form of written Deed Restrictions and Covenants, agreed to by all property
owners at purchase, and shall run with the single-family land.

Provisions shall be made, in the POA bylaws and Deed Restrictions,that in the unlikely
event the POA fails to maintain all or a portion of the Single-Family Open Space in
reasonable order and condition, the City of Southlake may, but is not required to,
assume responsibility for such maintenance and take corrective action, including the
provision of extended maintenance. The costs of such maintenance may be charged
to the POA or individual property owners that make up the POA, and may include
administrative costs and penalties which shall become a lien on all property in the
development.
