ZBA Minutes 2026-02-26 Zoning Board of Adjustment Meeting Minutes – Feb. 26, 202 6 Page 1 of 4 ZONING BOARD OF ADJUSTMENT MEETING: February 26, 2026 LOCATION: 1400 Main Street, Southlake, Texas Regular Session - City Council Chambers of Town Hall Members Present: Board members: Jeff Medici - Chairman, David Treichler - Vice Chairman, Trey Verbick - Place 3, Heather King - Place 4, Ryan Peabody - Alternate1, and Frank Bernardo - Alternate 2. Members Absent: Board members: Clinton Snead - Place 1, Mark Harris - Alternate 3, and Al Karmali - Alternate 4. Staff Present: Deputy Director of Planning Jennifer Crosby, Planner Cyndi Cheng, and Board Secretary Denia Reyes. REGULAR SESSION: 1. Call to Order: Chairman Medici called the Regular Session to order at 6:33 P.M. 2. Approval of the Minutes: Chairman Medici opened the discussion of the minutes of the Zoning Board of Adjustment meeting for January 15, 2026. A motion was made to Approve the minutes of the Zoning Board of Adjustment for meetings January 15, 2026. Motion: Verbick Second: King Ayes: Verbick, King, Peabody, Treichler, Medici Nays: None Abstain: None Vote: 5-0-0 Motion: Approved Zoning Board of Adjustment Meeting Minutes – Feb. 26, 202 6 Page 2 of 4 3. Administrative Comments: Deputy Director of Planning Jennifer Crosby announced that the next meeting scheduled is April 16, 2026. 4. Consider: ZBA26 -0001, Variances to Zoning Ordinance No. 480, as amended, Sec. 9.5.c requiring a side yard of not less than 25 feet and Sec. 9.5.d requiring a rear yard of not less than 40 feet , on property described as Lot 44, Block 2, Dove Estate Addition, and located at 1459 Flamingo Circle. Current Zoning: “SF -20B” Single Family Residential District. PUBLIC HEARING Planner Cyndi Cheng presented details of the case with a slide show presentation to the Board. Scott and Hayley Chitwood are requesting approval of variances to allow side and rear yard setback reductions to build an addition to an existing home. The applicants Scott and Hayley , once sworn in, presented testimony, and answered questions from the Board. Chairman Medici asked if there were those in the audience who wished to speak in support of the request. There being none, Chairman Medici asked if there were those in the audience who wished to speak in opposition to the request. There being none, Chairman Medici closed the public hearing and opened the item for discussion from the Board. Consider: ZBA26-0002, Special Exception Use per Zoning Ordinance No. 480, as amended, Section 44.12(2), for an accessory structure of a size greater than permitted and Section 44.12(6), for a reduction in the required setback from property lines for a residential accessory building, on property described as Tract 8Q, John L. Whitman Survey Abstract No. 1593 and located at 2848 Brookwood Lane. Current Zoning: “SF -1A” Single Family Residential District. PUBLIC HEARING Brett Horton is requesting a Special Exception Use (SEU) for an approximately 550-square-foot covered patio in addition to an existing garage. The existing garage is approximately 622 square feet, for a combined total size of 1,172 square feet. The current setback of the accessory structure is 25.5 feet from the rear yard. The covered patio is architecturally cohesive with the existing garage roof. Planner Cyndi Cheng presented details of the case with a slide show presentation to the Board. J im Horton (father of the applicant), once sworn in, presented testimony, and answered questions from the Board. Chairman Medici asked if there were those in the audience who wished to speak in support of the request. There being none, Chairman Medici asked if there were those in the audience who wished to speak in the opposition to the request. There being none, Chairman Medici closed the public hearing and opened the item for discussion from the board. A motion was made to Table case ZBA26-0002 to the next meeting on April 16, 2026, and requested 5 pieces of information: 1. That we understand what the penalty is for someone that proceeds on a project with a stop work order. 2. Analysis by staff of the neighborhood charact eristics & character so we can get a general understanding of what the neighborhood character is, and whether this is consistent with it or not. 3. A person from Code Enforcement attends the meeting to give us specific information about: • How they were notified. • Why did they investigate the case in the first place. • What the procedures would be from this point on in terms of interaction with the applicant. 4. Property owner must be present at this meeting. 5. Staff notify the neighbors who submitted testimony for tonight so they can discuss with us their perception of the situation.
