PROJECT: 4488 Soda Ridge Variance to Minimum Side Yard Setback
EXECUTIVE
SUMMARY: On behalf of Trevor Stitt, Black Door Renovation is requesting approval of a
Variance to Zoning Ordinance No. 480, as amended, Section 11.5.c requiring a
side yard of not less than 20' on property described as Lots 9 and 13, Block B,
Lakewood Ridge Addition (recently platted as Lot 9R, Block B, Lakewood Ridge
Addition), an addition to the City of Southlake, Denton County, Texas and located
at 4488 Soda Ridge Rd. and 4489 N. White Chapel Blvd., Southlake, Texas.
Current Zoning: "SF-1 A" Single Family Residential District.
REQUEST: The purpose of this request is to seek approval of a Variance to Zoning Ordinance
No. 480, as amended, Section 11.5.c requiring a side yard of not less than 20' to
allow the existing home and proposed additions as shown on the plot plan. The
home appears to have been under construction or constructed before the property
was annexed into the City in 1988. The existing home was constructed
approximately 12' from the north property line. Two additions to the principal
residence are proposed. One addition is to the south side of the existing home with
a proposed side yard setback of approximately 15' (5' encroachment). A covered
patio is proposed to be added to the rear of the home with a setback of
approximately 17' (3' encroachment) from the north property line.

LEGAL DESCRIPTION: Lot 9R, Block B, Lakewood Ridge Addition
LAND USE CATEGORY: Low Density Residential
CURRENT ZONING: "SF-1K Single Family Residential District.
HISTORY: The following is the history of the property to the best of our knowledge
and belief:
- A plat for Lakewood Ridge Addition was filed in 1977.
- The existing home on the property was built in 1988 (Source: DCAD).
- The property was annexed into the City in 1988 and given the "AG"
Agricultural District zoning designation.
- The property was given the "SF-1 A" Single Family Residential District
zoning designation with the adoption of Ord. No.480 September 5, 1989.
- A Plat Revision (ZA21-0001) for Lot 9R, Block B, Lakewood Ridge
Addition to combine Lots 9 and 13, Block B, Lakewood Ridge Addition
was approved on February 23, 2021 and filed April 26, 2021.
UTILITIES: A 12" water line exists in N. White Chapel Blvd. and an 8" water line
exists in Soda Ridge Rd. to serve the property. City sewer is not
available to the property. The existing home uses a septic system.
DRAINAGE: An existing pond divides the property. Drainage from the east and west
portions of the property is to the pond.
STAFF COMMENTS: The Board may grant a variance from the literal enforcement of the
zoning ordinance:
a. Where the spirit of the ordinance is observed and substantial
justice is done;
b. Where the Board finds that granting the variance will not be
contrary to the public interest, and;
c. Where, due to special conditions, a literal enforcement of the
provisions of this ordinance would result in "unnecessary
hardship."
A hardship is considered "unnecessary" where the applicant
demonstrates:
1. That special conditions and circumstances exist which are
peculiar to the land, structure, or building involved and which are
not applicable to other lands, structures or buildings in the same
district;

2. That the literal interpretation of the provisions of this ordinance
deprives the applicant of rights commonly enjoyed by other
properties in the same district;
3. That the special conditions and circumstances that exist are not
the result of the actions of the applicant;
4. That the granting of this variance does not confer on the
applicant any special privilege that is denied by the zoning
ordinance to other lands, structures or buildings in the same
district;
5. That the reasons stated in the application justify granting the
variance and that the variance will be the minimum necessary to
make possible the reasonable use of the land, building or
structure, and
6. That the granting of the variance will be in harmony with the
general purpose and intent of the zoning ordinance and will not
be injurious to the neighborhood or otherwise detrimental to the
public welfare.

Describe EXACTLY HOW, and TO WHAT EXTENT your request will DIFFER from the
REQUIREMENTS of the ordinance, as described ABOVE. (Use REVERSE, or additional sheets

We are building an addition to the existing structure, and we would like to encroach on the 20'
South side setback by approximately 5'to fit the addition where it needs to go to be even with the
existing house and avoid the water shed on the property created by the natural topography of the
lot and surrounding property. Additionally,we would like to encroach up to 3'on the North side
setback at the rear-right corner of the existing home to maintin a straight line with the existing home.
Note that the existing home was built and platted with a 12'setback per the requirements at the
time the home was built.
In order for your request to be granted, the Board of Adjustment must case FOUR out of five
votes in support of your application.
In order for the Board members to vote in support of your application, you must prove several
things by your application.
Your application must clearly show that your property has UNIQUE CONDITIONS and
CIRCUMSTANCES which separate it from other typical properties with the same zoning; and
explain how these unique conditions and circumstances make it UNREASONABLE or UNFAIR

to apply the STANDARD ordinance requirements to YOUR property, unlike the way they are
applied to all other properties.

The variance requested is to accommodate the best layout for the addition given the extreme
topographical challenges of the site as well as the existing layout of the home in order to allow the

Also, the Board must be convinced that granting such a variance would not constitute an
UNFAIR GRANT OF SPECIAL PRIVILEGE to you, granting privileges that are otherwise denied
by the ordinance.
In other words, why would granting this variance be ONLY FAIR, and NOT MORE THAN FAIR,
to you, since others are prevented from doing what you are requesting:
These variances would be only fair, and not more than fair, because they accommodate the
preexisting site and home's layout,as well as assisting us to achieve the desired floor plan based
on the topographical challenges of the site.
Finally, the Board must be certain your request is in harmony with the public welfare, and will
not in any way be injurious or detrimental to your neighbors and their property rights.

EXPIRATION OF GRANTED REQUEST.
ZONING BOARD OF ADJUSTMENT RULES OF PROCEDURE, Section 7.1
Any special exception or variance granted or authorized by the Board shall authorize the
issuance of a building permit and/or a Certificate of Occupancy, as the case may be, for a
period of one year from the date of the favorable action of the Board unless said Board shall
have in its action approved a different period of time and has so shown such specific period of
time in the minutes of its action. If the building permit and/or Certificate of Occupancy shall not
have been applied for within said one year period or such extended period as the Board may
have specifically granted, then the special exception or variance shall be deemed to have been
waived and all rights thereunder terminated. All applications for a request which have been
denied shall be deemed to be denied with prejudice unless stated otherwise in the Board's
written decision.

We both object strenuously to the proposed zoning variations proposed.We purchased our property
knowing that all homes had at least 1.5 acres lots. We live across the street from the main lot,and
we would not like to look at the proposed variation. With 1.5 acres,there should be plenty of room
without having to impose on our neighbor's 40 foot offset from his property. It hurts our property
values.To have the lot across the street full ofa house with a front facing garage,would make it look
small.There are plenty of different ways on a 1.5 acre lot to modify the proposed home plans,
without making the neighborhood look poorly designed and planned.lf a structure is going to be
built directly onto North White Chapel,we would like to know that,because there is no room for
another structure on that parcel.Also,that would appear to be a second variation request. We do
not think anything should be constructed on the little piece of land across the pond,even though it
appears that a new driveway has been installed there in the last week.Even if this proposal is
granted,the actual modification should specify where the modification ends. We are afraid that
every single inch of land(ten feet of it)would be used to exceed the current levels of offset. We
need to know how far the variation will actually extend.
