The applicant is proposing that this development be
accessed by a gated private street.
• Allow the cul-de-sac street to exceed 1,000 feet in length (Section 5.03.1, Subdivision Ordinance
No. 483, as amended) and to be approximately 1,600 feet in length.
• A variance is being requested to waive the requirement per Section 5.03.K.1 of the Subdivision
Ordinance that the existing dead-end street located in the Cross -Timber Hills Addition,
specifically Wood Creek Lane, will not be connected to this development.
• Private streets are not permitted in new residential subdivisions (Section 5.04 Subdivision
Ordinance No. 483, as amended). A variance request has been added to the RPUD
Development Regulations. If approved as requested, private streets are subject to the
requirements of 5.05, Subdivision Ordinance No. 483, as amended.
• The applicant is requesting a variance to waive the requirement per Section 5.06 of the
Subdivision Ordinance to construct sidewalks along the internal street frontages as well as along
N. Peytonville Avenue.
• Allow residential Lot Coverage of 40%. \
• Allow detention area to exceed 25% of open space area if a storm wate
is reached.

DETENTION AREA NOTES:
1. THE DETENTION AREAS ARE BEING PROPOSED WITHIN THE
LIMITS OF THE EXISTING TRIBUTARY TO HIGGINS BRANCH. AS
A RESULT, CONVEYANCE OF THE 100—YEAR STORM EVENT
WITHIN THE EXISTING TRIBUTARY WILL NEED TO BE EVALUATED
WITH THE FINAL SITE DESIGN. AS PROPOSED, DETENTION
AREA #1 CAN BE PROVIDED WITHIN AN AREA OF 21,346 SF
WHILE MAINTAINING A NORMAL WATER SURFACE ELEVATION TO
CREATE AN ACCESSIBLE AMENITY. THE PROPOSED 21,346 SF
DETENTION AREA IS SITUATED WITHIN 97,426 SF OF OPEN
SPACE. AS A RESULT, THE DETENTION AREA OCCUPIES
21.917 OF THE PROPOSED OPEN SPACE. HOWEVER, DURING
STORM EVENTS THIS CAPACITY WILL BE UTILIZED FOR
CONVEYANCE PURPOSES WHILE MAINTAINING THE REQUIRED
ON —SITE DETENTION 30 AS NOT TO CREATE A NEGATIVE
IMPACT ON THE DOWNSTREAM DRAINAGE SYSTEM,
2. THE POTENTIAL DETENTION AREA #2 IS AN AREA THAT CAN
BE UTILIZED TO COMPENSATE FOR THE ADDITIONAL STORM
WATER BEING GENERATED BY THE OFF —SITE PFY70NVILLF
AVENUE DRAINAGE SYSTEM, AS IDENTIFIED ON THIS EXHIBIT,
THERE IS APPROXIMATELY 30,000 CIF OF STORM WATER
STORAGE CAPACITY. DURING THE FINAL SITE DESIGN, THE
PROPOSED JANE'S PLACE DEVELOPMENT MAY UTILIZE ONE OR

• Noting that the only real concerns that we have are with respect to the
drainage as presented and that more information is needed with regard
to the actual numbers on retention/detention and the flow of the water.
• Noting specifically that there were no comments on lot size or the
development other than the entrance and absent drainage, there was
good feedback.
• Noting that there is concern about the eventual outlet and the length of
the piping as well as the drainage on the westernmost portion of the
property.
February 3, 2026; Approved (6-0) subject to revised Staff Report dated February 3, 2026, and subject to revised
Development Plan Review Summary No. 4, dated February 3, 2026, noting the following:
• Allowing a cul-de-sac street to exceed 1,000 feet in length (Section 5.03.1, Subdivision Ordinance No. 483, as
amended) and to be approximately 1,500 feet in length
• Granting a variance to waive the requirement per Section 5.03.K.1 of the Subdivision Ordinance that the
existing dead-end street located in the Cross -Timber Hills Addition, specifically Wood Creek Lane, will not be
connected to this development and restricting any such connection from Wood Creek to this development and
that same restriction will apply in the event Post Oak Trail is found to have previous documentation noting a
connection.
• Approving a variance allowing a private gated street (Section 5.04, Subdivision Ordinance No.483, as
amended) and further requiring that the private gated street is subject to the requirements of Section 5.05,
Subdivision Ordinance No. 483, as amended.
• Allowing residential lot coverage of 40% as proposed.
• Allowing detention area to exceed 25% of open space area only if a stormwater oversizing agreement with the
city is reached, which includes additional detention capacity.
• Denying the variance to waive the sidewalk requirement per Section 5.06 of the Subdivision Ordinance.
Rather, directing staff to work with the applicant on the appropriate escrow amount to be held for future
sidewalk, subject only to the sidewalk area along N. Peytonville Avenue.
