PROJECT: 1459 Flamingo Circle – Variance to Setback Reduction
EXECUTIVE
SUMMARY: Scott and Hayley Chitwood are requesting approval of variances to Zoning
Ordinance No. 480, as amended, Sec. 9.5.c requiring a side yard of not less than
25 feet and Sec. 9.5.d requiring a rear yard of not less than 40 feet, on property
described as Lot 44, Block 2, Dove Estate Addition, and located at 1459 Flamingo
Circle, Southlake, Tarrant County, Texas. Current Zoning: “SF-20B” Single
Family Residential District. SPIN Neighborhood #2.
DETAILS: The purpose of this request is to seek approval for variances to allow side and
rear yard setback reductions to build an addition to an existing home.
The applicant is requesting the following variances:
- Zoning Ordinance No. 480, Sec. 9.5.c requires a side yard of not less than
25 feet; the applicant is requesting side yards of 5 feet and 10 inches.
- Zoning Ordinance No. 480, Sec. 9.5.d requires a rear yard of not less than
40 feet; the applicant is requesting a rear yard of 24.5 feet.
The Dove Estates subdivision was originally platted in 1971 under the City of
Southlake Ordinance No. 161-18, which designated the zoning as “A-2” Single
Family District. Following the adoption of the City of Southlake Zoning Ordinance
No. 480, as amended, Section 15, the property is zoned “SF-20B” and is
considered legally nonconforming to current setback requirements. With Zoning
Board of Adjustment Case ZBA-135, a motion for approval was granted for
several lots (not including the subject property) to allow a variance to all setbacks
required in the “SF-20B” zoning district under Zoning Ordinance No. 161. This
approval allows a minimum front and rear setback of 25 feet and minimum side
setbacks of 10% of the lot width on each side.
A comparison of the original “A-2” regulations with the current “SF-20B”
regulations is shown in the chart below.

CURRENT ZONING: “SF-20B” Single Family Residential District
HISTORY: The property was annexed into the City in 1957.
The property was rezoned from ‘AG’ to ‘A-2’ One-Family District and a final
plat for Dove Estates (ZA70-3) was approved May 26, 1970. The plat for
Dove Estates was filed on February 17, 1971.
The property was given the “SF-20B” Single Family Residential District
zoning designation with the adoption of Ord. No. 480 September 5, 1989.
UTILITIES: The property is served by an existing 4-inch water line and a 6-inch
sanitary sewer line adjacent to the property. The water line is located on
Flamingo Circle and the sewer line runs to the west and south of the
property.
STAFF COMMENTS: To authorize in specific cases variances from the terms of this ordinance
as will not be contrary to the public interest, where due to special
conditions, a literal enforcement of the provisions of this ordinance would
result in unnecessary hardship and where the spirit of the ordinance is
observed and substantial justice is done. A variance shall not be granted
by the Board of Adjustment except in accordance with the following:
1) That special conditions and circumstances exist which are peculiar to
the land, structure, or building involved and which are not applicable to
other lands, structures, or buildings in the same district;
2) That literal interpretation of the provisions of this ordinance would
deprive the applicant of rights commonly enjoyed by other properties
in the same district under the terms of this ordinance;
3) That the special conditions and circumstances do not result from the
actions of the applicant;
4) That granting of the variance requested will not confer on the applicant
any special privilege that is denied by this ordinance to other lands,
structures, or buildings in the same district.
