Freeman Abstract No. 525 TRACT 5D04 Survey / Cert No.144691634 Dated June 24, 2025 Ms. Sandy Endy, P.E. On January 6, 2026, our builder Patrick Gray (V. Patrick Gray Custom Homes) received correspondence from the City of Southlake ("city") notifying us of the requirement to add a 5' sidewalk to 906 Shady Lane due to us recently re -platting the property. Additionally, you informed us that a variance request could be submitted to the city or pay an escrow fee in lieu of constructing the sidewalk. This correspondence is intended to formally request a variance to Not Construct the 5' sidewalk based on the following issues: 1. There are no other sidewalks on the entire west side of Shady Lane, therefore this sidewalk would just be located solely on our property, but no other properties along the entire street. It would serve no purpose or value and it would not be used due to the segmented and isolated nature. Additionally, since other properties do not have to be re -platted, there will be no instrument that the City has to force other residences on the western side of the street to install additional sidewalks that would make this one continuous, thereby creating a sidewalk that serves no benefit, value or purpose. (See attached aerial photograph) 2. There is an existing sidewalk on the eastern side of Shady Lane directly across from 906 Shady Lane that does provide pedestrians with a safe walking path and achieves the City's objective. 3. If a sidewalk were to be constructed on just 906 Shady Lane property, it would only be in front of our house and would terminate in the City of Southlake Sewer Lift Station ("lift Station"). Due to security and safety concerns, it would not be advisable to direct walking traffic, if it were to exist, into that site location. 4. There are no safety crosswalks or intersections in the vicinity or on Shady Lane which creates an unsafe condition for both pedestrians and drivers alike and trying to route pedestrian traffic to cross in the vicinity of 906 Shady Lane is increasing unnecessary risk to public safety. Please note that we have proactively worked with the City to correct a historical plat and zoning issue by re -platting since the prior owners had failed to consolidate the two plots into 1 despite having constructed permanent residence that traversed both properties. In consideration, we formally request the City to reconsider and approve this variance request not to mandate that a sidewalk be installed on the 906 Shady Lane Property.
