Background
information: This is Tarrant County's standard joint election cantract that
sets out the procedures for conducting the general Election
and the Special Election. Tarrant County will utilize the
services of Robert Flaherty far Election Judge once again
and Lee Hamilton for Alternate Election Judge. Tarrant
County will appoint election clerks, provide training, provide
equipment, prepare supplies, and coordinate election
returns.

The contracting political subdivisions desire to use the County's electronic voting system and to compensate the Count far such use and to share in certain other expenses connected with joint elections in accordance with Y
the applicable provisions of Chapters ~ and 279 0€ the Texas Election Code, as amended.

I. ADM1hlITRA~"ION

Code and this agreement. The Tarrant Caun#y Elections Administrator shall coordinate, supervise, and handle all as acts

of its election. The Elections Administrator shall provide advisory services in connection with decisions to be made end
actions to be taken by the af#icers of each participating authority as necessary.
it is understood that other political subdivisions may wish to participate in the use of the County's electronic eating system and polling places, and ~t ~s agreed that the Elections Administratar may enter into other contracts far election
services far those purposes on terms and conditions generally similar to those set forth in this contract. !n such cases,
casts shall bepro-rated among the participants according to ectian ~l of this contract.
At each polling location, joint participants shall share voting equipment and supplies to the extent passible. The
participating parties shall share a mutual ballot in those polling places where jurisdictions overlap. ~lowever, in na instance
shall a voter be permitted to receive a ballot containing an office or proposition stating a measure on which the eater is
ineligible to vote. Multiple ballot styles shall be available in those shared polling places where jurisdictions do not overlap.
11. LEGAL p~CUMENTS
Each participating authar~ty shall be responsible for the prepara#ian, adoption, and publication of all required elect~an orders, resolutions, notices, and any other pertinent documents required by the Texas Election Cade andlar the
participating authority's governing body, charter, or ordinances.
Preparation of the necessary materials for notices and the official ballot shall be the responsibility of each participating authority, including translation to languages other than English. Each participating authority shall provide a
copy of t#~eir respective election orders and notices to the Tarrant County Elections Administrator,
The Elections Administratar shall prepare a submission, on behalf of all participating authorities, to the United Mates Department of Justice far preclearance of the joint election procedures and pulling places, pursuant to the Voting
Rights Act of ~ 86b, a amended. The Elections Administrator will provide to each participating authority a photocopy of
the joint submission and any correspondence from the Department of Justice.
The joint submission prepared by the Elections Adrr~inistratar will of include subrr~ission of information for any special elections held by the participating authorities. Participating authorities are hereby notified and encouraged to
prepare their own submissions to the United States Department of Jus#ice for special election procedures, ar any changes
that are specific to their own political subdivision,

voting rrghts rssues known to rt that virouid preclude or delay Department of Justice preclearance of the joint
election.
The Electrons Administratar will file an amended submission to the United States Department of Justice in the
event that any polling places are changed after the original submission is Pied, including changes resulting from the
withdrawal of one or mare participating authorities pursuant to ectian ill of this contract.
111. V~TII~ ~.~CATI~NS
The Elections Administratar shall select and arrange for the use of and payment far all election day voting
locations. Voting locations will be, whenever passible, the usual voting location far each election precinct in elections conducted by each participating city, and shall be compliant uvith the accessibility requirements established by Election
Cade ectiun 4~.a34 and the Americans wi#h disabilities Act ~ADA~. ~"he proposed voting locations are listed in
Attachment A of this agreement. In the event that a eating location is not available or appropriate, the Elections
Administrator will arrange for use of an alternate location with the approval of the affected participating authorities. The Elections Adrrrinistrator shall notify the participating authorities of any changes from the locations listed in Attachment A.

If palling places for the May 'l a, 2U05 joint election are different tram the palling places}used by a participating
authority in its most recent election, the authority agrees to past a nat~ce no later than May g, 2008 at the entrance to any
prev,ous palling places in the turisdictian stating that the palling location has changed and stating the political subdivision's
palling plane names and addresses in e#fect far the May 10, 2005 election. This notice shall be written in bath the Bngiish and par~~sh languages.
IV. ELECTiOIV JUDCEB, CLERIC, AND OTHER ELECTJON PERDNNEL
Tarrant County shall be responsible for the appointment of the presiding judge and alternate judge for each palling
lacat~on, The Elections Adm~n~strator shall make emergency appointments of election officials if necessary.
Upon request by the EJectians Administrator, each participating authority agrees to assist ire recruiting palling place officials who are bilingual fluent ire bath English and Spanish}. In car~pliance with the Federal Voting Rights Act of 1 X55,
as amended, each palling place canta~n~ng more than 5~1o Hispanic population as determined by the 2a0a Census shall

The Elections Administrator shall notify all election judges of the eligibility requirements of Subchapter C of Chapter 32 of the Texas Election Cade, and wrll take the necessary steps to insure that all election judgesappointed for
the Joint Election are eligible to serve,
The Elections Adrr~inistratar shall arrange far the training and compensation of all election judges and clerks, The Elections Administrator shall arrange for the date, time, and place for presiding election judges to pictC up their election
suppi~es. Each presiding election nudge will be sent a letter from the EJectians Administrator notifying him of his
appaintmer~t, the time and location of training and distribution of election supplies, and the number of election clerks that
the presiding judge may appoint,
Each election judge and cleric will receive cornpensatian at the hourly rate established by Tarrant County pursuant
to Texas Election Cade section 32.091. The election judge will receive an additional surn of 2x.00 for picking up the
election supplies prior to election day and far returning the supplies and equipment to the central counting station after the polls close.
Election judges and clerks who attend voting equipment training andlar procedures training shall be compensated
at the same hourly rate that they are to be paid an election day,

The Elections Adrninistratar shall arrange for all election supplies and eating equipment including, but not limited
ta, official ballots, sample ballots, eater registration lists, and all farms, signs, maps and other materials used by the
election judges at the voting locations. The Elections Administrator shall ensure availability of tables and chairs at each
palJ~ng place and shall procure rented tables and chairs far those polling places that do not have tables andlar chairs.
At each palling location, joint participants shall share voting equipment and supplies to the extent passible. The
participating parties shall share a mutual bailat in thane precincts where jurisdictions overlap. However, in no instance
shall a voter be permitted to receive a bailat containing an offce or proposition stating a measure on uvhich the voter is

members to constitute the EVBB. The Elections Administrator shall determine the number of EVBB members required to efficiently process the early voting ballots.
Vlll. CENTRAL CO~#NTINO TATI~N AND ELECTION RETURNB
The Elections Adrninis#ratar shall be respansibie for establishing and operating the central and remote countin
stations to receive and tabulate the va#ed ballots in accordance with the rovisians of the Texas EI ~ g p ect~an Code and of this
agreement.

releasing unofficial cumulative totals and precinct returns from the election to the joint parkicipants, candidates, press, and general public by d~strtbut~on of hard copies at the central counting sta#ion and by pasting to the Tarrant County web site.

~C. RUNOFF ELECTI~~i
Each participating authority shall have the option of extending the terms of this agreement through its runoff election, if applicable. In the event of such runoff election, the terms of this agreement shell autarnatically extend unless
the participating authority notifies the Elections Administrator in writing vuithin business days of the original election.
Each participating authority shall reserve the right to reduce the number of early voting locations and~or election day voting locations in a runoff eleotian, if necessary, any voting changes merle by a participating authority between the
original election and the runoff election shall be submitted by the autharity making the change to the United states
Department of Justice far the preclearance required by the Federal Voting Rights Act of 196, as an7ended.
Each participating authority agrees to order any runoff election~s~ at its meeting far canvassing the votes from the
lVlay ~ 2gg8 election and to conduct its drawing for ballot positions at ar immediately following such meeting in order to
expedite preparations far its runoff election.
Xl. E~,ECTION E~PENE AtVD ALL~CATI~]N OF CST
The participating authorities agree to share the costs of administering the Joint Electian~ Allocation of casts,
unless specifically stated otherwise, is mutually agreed to be shared according to a formula ~uhich is based an the average cost per election day palling place ~uni# casts as determined by adding together the overall expenses and dividing the
expenses equally among the fatal number of polling places. Costs far palling places shared by more than one participating
autharity shall be pro-rated equally among the participants utilizing that palling place.
The participating authorities agree that far billing purposes, each election day polling place will be evaluated as to
the number of full-time-equivalent {FTE} pallworkers employed, Polling places with mare than FTE pollwarkers will be
considered as one ar more add~t~onal palling places with each full ar park~al multiple of ~ FTE pollworkers canstitu#ing an
additional polling place for purposes of determ~n~ng the average cost formula in the preceding paragraph,
If a participating authority's election is conducted at more than one election day palling place, there shall be na
charges ar fees allocated to the participating authority for the cost of election day polling places in which the authority has
fewer than ~0°Jo of the total registered voters served by that polling place, except that if the number of registered voters in
all of the authority's polling places is less than the b0°lo threshold, the participating authority shall pay a pro-ra#a share of the costs associated with the palling place where it has the greatest number of registered voters,
Costs for Early Voting by Personal Appearance shall be allocated based upon the actual costs associated with
each early vot+ng site. Each participating authority shall be responsible fnr a pro~rata portion of the actual casts associated with the early eating sites located v+rithin their jurisdiction. Participating authorities that do not have a regular {non-
temporary~ early eating site within their jurisdiction shall pay a pro-rata portion of the nearest regular early voting site.

Costs for Early Voting by Mail shall be allocated according to #l~e actual number of ballets mailed to each
participating authority's voters.
Each participating authority agrees to pay the Tarrant County Elections Administrator an administrative fee equal
to ten percent 0°ro} of its to#al billable casts in accordance with section 1, ~ OO~d} of the Texas Election Code.

Any participating eutharity may withdrew from this agreement and the ,faint Election should it cancel its election in accordance with Sections 2,051- 2,05 of the Texas Election Code, The withdrawing authority is fully liable for any
expenses incurred by the Tarrant County Elections Administrator an behalf of the eutharity plus an administrative fee of ten

The Elections Administrator is hereby appointed general custodian of the voted ballots and all records of the Joint
Electron as authorized by Section 271.01a of the Texas Election Code.
Access to the election records shall be available to each participating eutharity as well as to the public in
accordance with applicable previsions of the Texas Election Cade and the Texas Public Infarmatiar~ Act. The election
records shall be stored at the affces of the Elections Administrator or at an alternate facili#y used far storage of coon
records. The Elec#ions Administrator shall ensure that the records are ma'rnt ' wined ~n an orderly manner so that the records are clearly identifiable and retrievable.
Records of the election shall be retained and diseased of in accordance with the provisions of Section Gfi.gSS of
the Texas Election bode, if records of the election are involved in any pending election contest, investigation, liti ation, or open records request, the Elections Administrator shall maintain the records until final renal g

Xlll. RECOUNTS

par#icipate in the use of the County's election equipment and eating places, and it is agreed that the Elections Administrator may contract with such other districts or political subdivisions far such purposes
and that in such event there may be an adjustment of the pro-rata share to be paid to the County by the
participating authorities.
2. The Elections Administrator shall file copies of this document with the Tarrant County Judge and the Tarrant County Auditor in accardartce with Section ~1.D9 of the Texas Election Code.
3. Nothing in this contract prevents any party from taking appropriate legal action against any other pa
andlar other erection personnel for breach of this contra ct or a v~olat~on of the Texas Elect~an Cede.
4. This agreement shall be construed under and in accord with the lauvs of the State of Texas, and all obligations of the parties created hereunder are performable in Tarrant County, Texas.
5. In the event that one of more of the provisions contained in this Agreement shall for any reason be held to
be invalid, illegal, yr unenforceable in any respect, such invalidity, illegality, ar unenforceability shall not
affect any a#her provision hereof and this agreement shat! be construed as if such invalid, illegal, ar unenforceable provision had never been captained herein.
All parties shall corr~ply with all applicable laws, ordinances, and codes of the state of Texas, all local
governments, and any other entities with local jurisdiction.
The waiver by any parley of a breach of any provision of this agreement shall not operate as or be construed as a waiver of any subsequent breach.
8. Any amendments of this agreement shall be of no effect unless in writing and signed by all parties hereto.
Xlll, COST ESTIMATES ANA DEPOSIT QE FUN>~
The total estimated obligation for each participating authority under the terms of this agreement is listed below.
Each participating authority agrees to pay the Tarrant County Elections Administrator a deposit of approxir~atel ?~°lo of
