SUBJECT:- Board of-Adjustment Case-#83- - - - - - - - - - - - - - - - - -
Board of Adjustment Case No. 83 is a request for a Special Exception Use
permit for the operation of a concrete batching or transient mix plant
per Ordinance No. 480, Section 44.12 Q j).
The owner/applicant is the Southlake Joint Venture.
The location of the proposed site is Block 1, Lots 13 - 16, Timber Lake
Addition. This is located on the south side of West Southlake Blvd. in
the 600 - 900 Block. A copy of the approved Final Plat is attached with
the location of the proposed plant hatched and highlighted.
This development is zoned PUD (Planned Unit Development) for residential
use. This request will allow the completion of the paving operation within
Timber Lake, Section I, Phase I.
There was one (1) letter sent to the property owner within 200 feet of the
proposed site. To date, he has not responded to this notification.

Board of Adjustment Cases 84, 85 and 86 request site plan approval for three (3) building projects proposed for Fina's petroleum operation on
Highway No. 26. This request is authorized by Ordinance No. 480, Section
44.12 (pp).
The three (3) requested building permits are:. l) an additive injection
skid installation, 2) a canopy installation over the pipeline receiving
manifold, and 3) sixteen (16) crosswalks to allow safe access across
pipe racks.
The owner/applicant is Fina Oil and Chemical Company.
the terminal operation is located at 3000 Highway 26 West across frcm
Grapevine High School. The property is legally described as Tracts 3A,
3B1, and 3B2, C.B.McDonald Survey, Abstract No. 1013.
The current zoning is Industrial-2 with a Special Exception Use for a
petroleum operation.
There were six (6) letters sent to property owners within 200 feet.
To date, no responses or inquiries have been received.

Agenda Item # 2 Approval of Minutes
With no comments or amendments to the minutes, Mr. Sorenson,
Chairman deemed the February 26, 1990 minutes approved.
■ Agenda Item # 3 Administrative Comments
Mr. Sorenson presented a work sheet of items that the board had
some difficulties to be discussed and possibly considered for
presentation to council.
Mrs. Gandy commented and presented material on the next meeting for
March 26th for Special Exception Use for the operation of a
concrete batching or transient mix plant.
Agenda Item # 4 Case # 83 Special Exception
* Case # 83 a Request for a Special Exception Use Permit for the
operation of a concrete batching or transient mix plant per
Ordinance No. 480, Section 44.12 (jj) to be located on the south
side of West Southlake Blvd. Lot 13-16 Block 1 of the Timber Lake
Addition. The owner and applicant is Southlake Joint Venture.
A presentation was made by Karen Gandy, Zoning Administrator, who
stated that the property is located in Phase I of the Timber Lake
Addition, in the 600 to 900 block Southlake Blvd. it is zoned PUD
or Plan Unit Development with residential use only. This will be
for the paving operation of Phase I, Section 1, of the Timber Lakes
Addition. Only 1 letter to property owners within 200 feet was
required to be sent. A letter was sent to Mr. Kennedy with no
response.
Bryan Marcus represented the owner, The Nelson Corporation.
Mr. Marcus asked for a modification, extending the area of the
original request to be considered, that would be located across the
street from the site requested and would be available for paving
operations for Phase I and Phase II of the Timber Lakes Addition.
The construction would require 6 months for Phase I and 6 months
for Phase II.

Mr. Johnson was concerned if the 300 ft. was measured from the
center of FM 1709 to the original site request. Mr. Marcus answer
was yes. What is the inconvenience to the contractor with the
original site? Mr. Marcus replied the lots in question would be
developed lots that would be ready and for sale and because of the
utility easement.
Mr. Bentley questioned the time element and the permit obtained
from the Texas Air Quality Control Board. Mr. Marcus replied that
the application had been requested and the permit should be
obtained in the next week to ten days. The request was for a two
move-in permit for 1 year. This would allow for the operation to be
taken down and moved. The duration for each Phase of work would be
approximately 1 month for plant operation.
Mr. Sorenson ask Mrs. Gandy, if she was aware of the modification,
would additional notification letters be needed and did the
advertised legal include a specific location. Mrs. Gandy replied
that yes, as of this date she was aware of the the asking for a
modification, no there will not be any additional letters only Mr.
Kennedy, and yes the advertised legal did include the specific
location of the requested site.
After reviewing, it was determined that the property would not
have been legally advertised and it is not favorable to grant the
modification as presented.
Mr. Marcus requested that the board consider Case # 83 as
originally requested Block 1 Lots 13-16 of the Timber Lake Addition.
The Public Hearing resulted in no comments.
Mr. Bentley stated the findings that this special exception is
specificly permitted by this ordinance, the location of the
proposed activities and improvements are defined on the site plan,
the special exception is a permissible usage and is compatible with
adjacent property.
A motion to grant Case # 83 for the special use as requested for a
temporary batch plant, operation for sixty (60) days, not to exceed
past December 31, 1990. The 60 days will commence on notification
to the department of public works.

Request for a site plan approval for three (3) building projects

stating, the terminal operation is located at 2400 Highway 26 West
across from Grapevine High School. The property is legally
described as Tracts 3A, 3B1, and 3B2, C. B. McDonald Survey,
Abstract No. 1013. The Current zoning is Industrial-2 with a
Special Exception Use for a petroleum operation. There were six
(6) letters sent to property owners within 200 feet. To date, no
00 responses or inquiries have been received.

Mr. Sorenson ask is the railroad right of way in the City of
Southlake or City of Grapevine. Mrs. Gandy stated that the City Of
Southlake boundary is on the Northern side of the railroad.
Glen Millsap P. O. Box 2159 Dallas, Texas was present as a
representative of the Fina Corporation.
Mr. Millsap described as a concrete pad 48 ft. x 15 ft. added a
12,000 gallon horizontal tank, 2 pumps, motors and some injection
equipment. The purpose of the skid is to inject additive into our
gasoline lines at the loading dock prior to to retail sales. The
additive is to decrease engine deposits. The tank is 8 feet in
diameter and 32 feet long, it sits on 10 ft, steel beams and it is
mounted on a prefabricated skid. The injectors will be in a rack
mounted on the skid. The skid, tank, pumps, motors, and injection
equipment comes a package but will be installed and mounted on the
concrete pad.
The Public Hearing resulted in no comments.
The City Engineer, Greg Lass review had 1 comment.
1. Proposed finish grades, directional flow arrows and
existing drainage structures are not shown on this plan.

specifically granted because the special use was previously
granted. The location of the proposed activities and improvements

structure, that provides weather protection for employees.
The Public Hearing resulted in no comments.

Mr. Millsap stated that Fina would like to put crosswalks over the
pipeline receiving manifold (within the tank form) from the pump
' station down and outside the contained area. This allows safe
access for employees during daily rounds.
Mr. Sorenson asked if this plan was approved by OSHA. Shelly
Hacker, of the Fina Corporation, reply was that all of OSHA
requirements were used in the designing of the crosswalks by the
' engineers and is stamped by the professional engineers.
The Public Hearing resulted in no comments.

SUBJECT: Site Plan requirements for Special Exception Use
A recent question raised by Chairman Sorenson regarding
the Special Exception Use requirement for a site plan
prompted me to seek an opinion from City Attorney, Allen
Taylor. Mr. Sorenson asked if pre-approved plats,
concept plans, and development site plans would satisfy the
site plan requirement.
,w Mr. Taylor conveyed by telephone that as long as the
pre-approved document substantially met the site plan
checklist then the applicant should not be asked to resubmit i
another site plan. If we required them to resubmit, it
could be construed "that the City was more interested in f
6 form rather than substance."

Being a tract or parcel of Land out of the C. B. McDonald Survey, Abstract
#1013, situated in the City of Southlake, Tarrant County, Texas, and more
particularly all of that certain 19.050 Acre Tract as described in Volume
3707, page 47, Deed Records, Tarrant County, Texas, and a part of Tract #3, as
described in a,correction warranty deed recorded in Volume 7053, page 903,
Deed Records, Tarrant County, Texas, and both tracts being described as One
Tract, as follows:
BEGINNING at a 1/4" iron pin set in concrete for the northwest corner of said
18.050 Acre Tract, said iron pin being by deed description South 00 degrees -
12' East 425.0 feet from the northeast corner of the H. Decker Survey;
THENCE South 89 degrees -•44' - 51" East along the north line of said 18.050
Acre Tract at 648.44 feet passing a 3/4" iron pin at a fence corner, in all
959.96 feet to a 1/4" iron pin set in concrete for the northeast corner of

Mr. Carlton:
Attached are three (3) sets of certified plans for a new additive injection
skid installation at Fina's Southlake terminal. With this letter, Fina is
requesting approval for the applicable permits so that we may proceed with
installation.
This skid unit will be prefabricated at the manufacturer's shop. The new
storage tank will have a UL 142 label and the skid will be placed adjacent to
a similar existing skid.
I have had Fina's fire insurance carrier check into the fire protection
requirements of this type of installation (see attached letter). We will
insure that there is local fire protection available for the new installation.

Dear Glen:
This letter addresses the proposed 12000 gallon additive tank
addition.
Tank's such as this containing combustible liquid do not require
,,,m.,, special protection and standard industry practice does not invest
in providing fire protection systems outside of standard hand held
or wheeled dry chemical extinguishers. The infrequency of truck
unloading (twice per 3 months) does not warrant special provisions
either.
Standard protection features such as diking, over-pressure/vacuum
protection etc... as Fina is well familiar in providing is of primary
importance.
