Agenda Item # 2 Approval of Minutes
With no comments or amendments to the minutes, Mr. Sorenson,
Chairman deemed the minutes approved.
Agenda Item # 3 Administrative Comments

Agenda Item # 4 Case #80 Request for a variance to the side yard
Request for a variance to the side yard requirement as established
by Ordinance No. 480, Section 14.5 (c) and a request to build in
the drainage and utility easement. Zoning on the property is
Single Family 20.OB, Owner, Robert C. Rankin, Location: 1203 Scenic
Drive, legally described as Lot 13R, Block 2, Continental Park
Estates.
A presentation was made by Karen Gandy, Zoning Administrator, who
stated SF 20.B Zoning requires a side yard of 15 feet, 14 letters
were sent to property owners within 200 feet and 3 favorable
responses (the Grabeels, Kreaps, and Crenshaw) no unfavorable
response.

Mr. Bentley asked Mrs. Gandy is there a 13R1 and 13R2 and where the
property line lies in reference to the drainage utility easement
and is the 40' on 13R1 or is it on 13R2?

Mrs. Gandy stated that there is a 13R1 and 13R2 and, she asked that

di Mr. Rankin presented the board with pictures and a drawing of the
property. Mr. Rankin stated, the location of the property line
1,M one pin is in the water and one is underneath the culvert at the
drive. To his knowledge he never owned 13R2. It is owned by Mr.

Agenda Item #4 Continued
Mr. Barnes stated that he had been to the site, staff does not
object to the request of Mr. Rankin. The retaining wall is there
and the drainage ditch as defined has proved to be adequate; if a
variance to the side yard is granted, Mr. Rankin was informed that
if the retaining wall ever failed and the building was damaged,
this would be his expense. The wall does provide adequate drainage.
Mr. Rankin, stated that because of a large tree, the lake view for
neighbors, the small area for outside recreation he is limited for
a location for this storage building. There are no utilities in the
easement and the wall has been adequate during high water.
4 The public hearing resulted in no comments.
Mr. Bentley stated that he believes that this is a two part issue.
1. Variance to the side yard
2. Building in the drainage easement. (a staff decision)
A motion to table the finding for building in a drainage easement
until such time city staff and city attorney can clarify the
question.

A motion was made to grant the request for a variance to the side
yard requirement as established by Ordinance No. 480
Mr. Bentley defined the findings.
The requirements have been met by the applicant for the side yard
requirements as stated. Variance is a minimum variance for
reasonable use of the land. Granting the variance will be in
harmony with this ordinance and will not be detrimental to the
neighborhood.

III A presentation was made by Karen Gandy, Zoning Administrator, who
stated the location of the property is North side of Highway 26
across from East Brumlow Avenue, current zoning I-2, 60 letters
were sent to property owners within 200 feet, 1 response from
Explorer Pipeline in favor of the request.

Mr. Sorenson stated the findings that this special request is
permissible for this ordinance, the location of the activities are

SF-20A SINGLE FAMILY RESIDENTIAL DISTRICT
14.1 PURPOSE AND INTENT - The purpose and intent of the SF-20A
Single Family Residential District is to provide for
compatible land, building, and structure uses primarily
oriented to moderately low density residential purposes,
open space uses, and select community facility uses.
Moderately low density detached single family residential
dwellings and development, along with the aforedescribed
uses, comprise the principal elements of the district.
14.2 PERMITTED USES
a. Agricultural Uses - Agricultural uses whose products
r are grown primarily for home consumption, such as
domestic gardening, berry or bush crops, tree crops,
e flower gardening, orchards, and aviaries.
W b. Residential Uses - Single family detached dwellings.

C. Community Facility Uses
1. Public, semi-public and private parks;
2. Recreation and open space including playgrounds,
parkways, greenbelts, ponds and lakes, botanical
gardens, pedestrian paths, bicycle paths,
equestrian bridle trails, nature centers, bird
and wildlife sanctuaries;
3. City hall, fire and police stations and other
iii municipal uses; and
4. Other uses of a similar nature and character.
14.3 ACCESSORY USES - In addition to those accessory uses
specifically authorized in Section 34 of this ordinance,
any use may be established as an accessory use to a
permitted use when it complies with the conditions for an
accessory use as defined in this ordinance.

14.4 SPECIAL EXCEPT N USES - Special exception uses may be
approved by the Board of Adjustment as specifically
authorized in Section 44.12 of this ordinance, subject to
full and complete compliance with any and all conditions
required in Section 44.12, together with such other
conditions as the Board of Adjustment may impose. Any use
accessory to an approved special exception use shall be

* SF-20B SINGLE FAMILY RESIDENTIAL DISTRICT
15.1 PURPOSE AND INTENT - The purpose and intent, permitted
uses, accessory uses, special exception uses, development
regulations and concept plan requirements for the SF-20B
district shall be identical -to the SF-20A district as set
forth in Section 14 of this ordinance, except that in the
SF-20B district, the minimum floor area of the main
residence shall be one thousand five hundred (1,500)
square feet.
