BOARD OF ADJUSTMENTS MEMBERS PRESENT: Art Sorenson, Chairman;
Ernest Johnson, Vice Chairman; Members: Stephen Apple, and Fred
Joyce, Alternate #2.
MEMBERS ABSENT: Joe Bentley, Robert Downard and Dennis Minder,
Alternate #1.
CITY STAFF PRESENT: Michael Barnes, Public Works Director, Karen
Gandy, Zoning Administrator and Jean Bryson, Building Secretary.
Agenda Item # 2 Approval of the Minutes
Mr. Johnson made amendments to pages 5 and 6 of the minutes.
The minutes of the July 9, 1990, Board of Adjustments meeting, were
deemed approved as amended.
Agenda Item # 3 Administrative Comments
Karen Gandy, Zoning Administrator read a letter from Arthur J.
Sorenson requesting ZBA Case #103 and #104 tabled until the first
~r meeting in August.
A motion was made to grant Mr. Sorenson request ZBA Case #103 and
#104 be tabled until the first meeting in August.

Nays: None
Abstained: Sorenson
Vote: 3-0-1 to grant

Mr. Sorenson stated there was a request that the August Meeting be
held on Thursday, August 16, 1990 instead of the regular meeting
date of Monday, August 13, 1990.
The board granted the request that the August Meeting will be
Thursday, August 16, 1990 at 7:30 P. M.
Agenda Item # 4, Case #102, Request for Site Plan Approval

A presentation was made by Karen Gandy, Zoning Administrator, who
stated that the property is located at 2401 Highway 26, being
legally described as 21.61 acres out of the C B McDonald Survey,
Abstract No. 1013 and the P R Splane Survey, Abstract No. 1453.
The property is zoned Industrial-2 (11I-2") with a Special Exception
Use for petroleum use.

There were six (6) letters sent to property owners within 200
feet. To date, there have been no responses or inquiries.
Public Hearing:
Mr. Ben Cortez, Fina Oil and Chemical Company representative,
stated that Fina is upgrading it's existing facilities.

No opposition was expressed.
Public Hearing Closed:
,04000 Mr. Johnson ask Mr. Cortez why tear down a building and build
another. Mr. Cortez stated the building was old and this is part
of the upgrading of existing facilities. The same septic tanks and
field will accomodate the new building.
r Mr. Sorenson stated the finding as, the location of the proposed
activities and improvements are clearly defined on the site plan;
and that the special exception is wholly compatible with the use
and permitted development of adjacent properties.
Motion was made to grant the request for a site plan approval for
the demolition of an existing building and the construction of a
new 11' x 31' building approximately fifty (501) to the South.

Agenda Item 7, Case #105, Request for variance
■ Case #105 is a request for a variance to the rear yard setback of
1" forty (40') feet as required by the SF 20A Zoning District.
A presentation was made by Karen Gandy, Zoning Administrator, who
stated the applicant requests a minimum thirty-five (35') foot rear
yard setback. The location is 907 Shadywood and is legally
described as Block 2, Lot 12, Chimney Hill Addition, Phase I. The
owner is Martin Morgan, President of Holland-Bard Custom Homes.
Public Hearing
Martin Morgan, President of Holland-Bard Custom Homes, stated only
di the garage would be encroaching and that the reason for this
request is to try and save the large oak trees.
No opposition was expressed.
Public Hearing Closed.
Mr. Joyce said that he had visited the site and that he was in
favor of saving the trees. Mr. Apple ask if it was possible that
the garage could be shifted up a little. Mr. Morgan stated that
this would be a problem because of the windows and a tree.
Mr. Sorenson stated the finding that the requirements have been
met by the applicant for a variance. The reasons set forth in the
it application justify the granting of the variance and that the
variance is the minimum variance that will make possible the
reasonable use of the land. In granting this variance will be in
W harmony with the general purpose and intent of this ordinance and
will not be injurious to the neighborhood or otherwise detrimental
to the public welfare.
A motion was made to grant the request for a variance to the rear
yard setback of forty (40') feet as required by the SF 20A Zoning
W District to thirty-five (351) foot rear yard setback at 907
Shadywood; legally described as Block 2, Lot 12, Chimney Hill
Addition, Phase I.

Vote: 4-0 to grant

Dear Mrs Gandy,
This is to confirm elements of our telephone conversations over
the past two weeks, and to request another continuance of my ZBA
cases #103 and #104 until the first meeting in August.
W During preparation of my case presentations, I discovered cause
to suspect the accuracy of the 1986 survey which accompanied the
closing documents on the properties in question.
This past Friday (July 20), the surveyor re-plotted his sightings
and confirmed my suspicions. As a result, I must re-accomplish
some key elements of the presentation and advise my neighbors of
the new facts of the cases.
For this reason, I request that the cases be held until the first
ZBA meeting in August.
