BOARD OF ADJUSTMENTS MEMBERS PRESENT: Art Sorenson, Chairman; Members: Joe Bentley, Robert Downard, Ernest Johnson and Bill Stoner, Alternate #2, MEMBERS ABSENT: John Scoggan, Vice Chairman and Dennis Minder, Alternate # 1. CITY STAFF PRESENT: Michael Barnes, Director of Public Works; Karen Gandy, Zoning Administrator; City Attorney, Betsy Elam and Jean Bryson, Building Secretary. Agenda Item #2 Approval of the Minutes With no comments or amendments to the minutes, Mr. Sorenson, Chairman deemed the June 4, 1990 approved. Agenda Item #3 Administrative Comments Mrs. Gandy reported the next scheduled meeting will be July 9th at 7:30 P. M. Mr. Sorenson ask that on the agenda for July 9th meeting a discussion of a possible change of Meeting Day for Board of Adjustments meetings. Agenda Item #4 Case # 96 Request for a variance Case # 96 is a request for a variance to the required forty (40') foot rear yard setback in the SF-10 B zoning district. The property is located at 3139 Southlake Park Road, being legally described as Lots 10, 11 and a portion of 12, Block 4, Southlake Park Estates. The owner/applicant is Charlie Skupin. A presentation was made by Karen Gandy, Zoning Administrator, who stated that the applicant proposes an attached garage which must meet the 40-foot rear yard setback of the district. It was suggested that Mr. Skupin build a detached garage which could be as close as five (5' ) feet to the rear and side property lines in the rear yard of his property. Mr. Skupin indicated that he preferred the proposed design due to he and his wife's age and health condition. This design would require a ten -foot encroachment in the rear yard setback. There were eight (8) letters sent to property owners within 200 feet. To date there has been one response being a favorable one from Mrs. Scamardo. Agenda Item # 4 continued Public Hearing: Charlie Skupin, 3139 Southlake Park Road, owner and applicant stated that his wife is handicapped and becaused of their age; I there is a need for the garage to be attached and located on the 0 rear of the property. No opposition was expressed. Public Hearing Closed: Mr. Bentley stated the findings that requirement of the applicant for a variance have been met and that the reasons set forth in the application justify the granting of this variance. This is a minimum variance to make possible reasonable use of the land and in granting this variance it will be in harmony and the general intent of this ordinance. 60 Motion was made to grant Case # 96 the Variance to the forty (40' ) foot rear yard setback. fir►, Motion: Bentley Second: Johnson Ayes: Bentley, Downard, Johnson, Stoner, Sorenson Nays: None Vote: 5-0 to Grant Agenda Item # 5, Case # 97. Request for site plan approval r. ,W Case # 97 is a request for site plan approval for a building permit for the following: 1) 40' x 30' metal building (driver's lobby, office) 2) 30' x 50' metal building (storage) 3) 80,000 bbl tank (48' high, 1101) The owner/applicant is Diamond Shamrock Refining and Marketing Company. The property is Zoned I-2 and is located on Hwy. 26 at arr Brumlow Avenue, being legally described as Lot 1, Brumlow Industrial District. am am stated presentation was made by Karen Gandy, Zoning Administrator, who stated there were seven (7) letters sent to property owners within w 200 feet. To date, there has been one (1) response from Mr. Wright requesting that the tank be built South of the existing tanks to +o protect the single family residence along Brumlow Avenue. on The City Engineer finds that the site plan meets the requirements w C of the ordinance with the exception of a buffer yard to be addressed along Brumlow Avenue. The Fire Department reviewed the 00 plan and has stated that all requirements have been met. to ti. Board of Adjustments Meeting page 3 June 11, 1990 Agenda Item #5 continued Public Hearing John Levitt, of John Levitt Engineers, Southlake, representing Diamond Shamrock requesting an approval of the site plan. Mr. Levitt stated that he is in agreement with the Buffer Yard requirements on Brumlow Avenue. Mrs. Gandy described the requirements as a maximum of 30 feet, 2 canopy trees and 4 or 5 under story trees in every 100 foot run. Mr. Sorenson ask about the pond being drained. Mr. Levitt said the pond is being drained and is to be filled in and leveled. This will not change the drainage of the property. Rodney Reese, Superintendent, Diamond Shamrock; stated that the ground around the pond has a constant seepage and at the request of the Fire Department of an access road in this area it was decided that the pond needed to be eliminated. Henry Frost, Vibra Whirl and Southlake Fuels, Northeast of Diamond Shamrock, spoke in favor of the removal of the pond and the site ea C plan. Joe Wright, 1640 South Brumlow, was in opposition of the request for an access to Brumlow Road. Asked that the trees be left around the tank for buffer. Due to size of the tank he ask that the tank be located South of the existing tanks. +� Wanda Stowe, 1710 South Brumlow, lives directly across from Shamrock and is concerned about the draining of the pond. She ask that the proposed tank site be moved for safety reasons in case of an explosion. Lemaine Wright, 1540 South Brumlow, has the same concern as his so neighbors. He stated that Diamond Shamrock does keep a clean operation he is concerned with the new tank, fire hazard, excess to Brumlow. He would like that the request for the Brumlow entrance be kept for fire and emergency only. Public Hearing Closed Mr. Stoner ask about the drainage study and will the drainage improve with the draining of the pond. Mr. Levitt stated that it should stay the same. Mr. Johnson was concerned with the run off. Mr. Levitt stated that the lot will drain the same with the run off to the East through Diamond Shamrock property. Ih 0" ka Board of Adjustment Meeting page 4 June 11, 1990 Agenda Item # 5 continued Mr. Stoner ask if there would be a pump and what kind of fuel will be stored in the tank. Mr. Levitt stated that there would be a pump and that there would be diesel fuel stored in the tank. Mr. Johnson asked if the drainage of the pond was because of the Fire Departments request for an entrance onto Brumlow for Emergency only. Mr. Reese answer was yes however, the Fire Department wanted an access road around the entire property for easy access and with the seepage of the pond area this created the idea of draining the pond. Mr. Reese also stated that Diamond Shamrock had purchased 50 gallons of foam that is stored in our warehouse that is available to the Fire Department. The Fire Department requested a second entrance in case of flood so they would have adequate access. Mr. Reese said that the tank may catch on fire however, it should not explode. Mr. Bentley, had environmental concern due to the mix use area. Mr. Downard stated that he thought that the tank could be moved Southeast and he was favorable of keeping the pond. Mr. Sorenson described the buffer yard needs. Public Hearing re -opened. ++ Mr. Wright stated that he did not think that the removal of the pond would change the drainage one way or another however he would like for the pond to remain for buffer reasons only for him and his r neighbors. „11 Mr. Reese state that Diamond Shamrock would leave the pond. IN Public Hearing Closed. ON Motion was made to grant Case # 97 a request for site plan approval di with proviso of the pond (stock tank) and trees are retained and including buffer yard "E". Board of Adjustments Meeting page 5 June 11, 1990 Agenda Item #6 Case #98 Request for a variance Case #98 is a request for a variance to the yard setbacks as require by Ordinance No. 480, Section 15.1, SF 20 B zoning district. The request is to allow the original setbacks per Ordinance No. 161, A-2 district which was the zoning ordinance in place at the time Dove Estates was developed in 1970. The owner/applicant is Republic of Texas Mortage Brokers, Inc. 1R Gallagher Custom Homes, Inc. has the lots under contract. The lots in question are: Block 1: Lots 13, 19, 22, 23, 24, 25, 26, 28, 30, 31 Block 2• Lots 10, 21, 23-29, 31, 34, 39, 41-43, 55, 56 Block 3: Lots 3, 4, 5 A presentation was made by Karen Gandy, Zoning Administrator. Mrs. 19 Gandy stated that Dove Estates was originally zoned under Ordinance No. 161 as A-2 residential. The City Council re -zoned the 40 development to SF-20 B in September 1989. ii There were eight -four (84) letters sent to property owners in Dove 4W C Estates and other properties within 200 feet of the subdivision. To date, there have been twelve (12) written responses, eleven (11) in favor and one (1) opposed, Mr. Pruett of 1115 Harbor Oaks. Mary Arnold had concern that the front setback not be less than 25 feet and the side yard not less than 9 to 10 feet. Mr. Stoner asked Mrs. Gandy if the Dove Estates Plat was on file 40 and her answer was yes. r Mr. Downard ask if this accounts for all vacant lots in Dove Estates. Mrs. Gandy answer was no there are still several. Mr. Downard ask the City Attorney are there any reservation to this. Betsy Elam, City Attorney, stated that this is valid issue if you have the right to have mass variance, it is our opinion that you do ,j have the right however, she stated that you do have to look at each case individually. The lots of record are already plated and should 40 not have to be replated. It is not reasonable to require each lot have its on application. Public Hearing Mike Suviski, President of Gallagher Custom Homes, currently we have 30 lots, and it is our request to return the lots to the original setback rules that applied to Dove Estates. Cal Baker, 12770 Coit Road in Dallas, Republic of Texas Mortgage spoke in favor of this request. Board of Adjustment Meeting so e•-� page 6 June 4k, 1990 Agenda Item #6 continued Bryan Edwards, 1559 Flamingo Circle in Dove Estates, spoke in favor of the request. Chris Jones, 804 Middle Circle, prospective homeowner, spoke in a favor of the request. Marla Looney, 2901 Tumbleweed, Grapevine, Remax 114 spoke in favor of the request and presented a layout to the board. John Miliara, 715 N. Main, Irving spoke in favor of the request. Mr. Miliara is a property owner in this area. No opposition was expressed Public Hearing Closed Mr. Bentley stated there is a hardship and needs to be addressed; #A however Council rewrote the Ordinance and that a variance can be granted. He made reference to Page 33-4 and Section. 33.9 and the record to show that 40% and can be adjusted by the Building Official and any variance made by this board would be from the adjusted line that is possible already. Mr. Bentley stated the findings as the applicant has met the requirement of this section. And in their application their reason r is justified the granting of the variance and the variance is a minimum requirements that will make reasonable use of the land and will not be injurious to the neighborhood Motion was made to grant Case #98 request for a variance to yard setbacks as noted in the attached sheets to the minutes and lots listed on memorandum for Case #98. Dwellings, one -family. b. Any use permitted in "A-1" One -Family District. c c. Buildings on corner lots, where interior lots have been planned or sold fronting on the side street, may project not more than ten (10) feet in front of the line established for buildings by the front yard require- ments for the interior lots on the side street, provided this regula- tion shall not be interpreted to reduce the buildable width of a corner lot in separate ownership at the time of the passage of this ordinance, to less than twenty-eight (28) feet, and provided that the side yard regulations above shall be observed. Rear Yards: The depth of the rear yard shall be at least thirty (30) iw percent of the depth of the lot, but such depth need not be more than twenty-five (25) feet. Width of Lot: The minimum width of a lot shall be sixty (60) feet Ii at the building line and ninety (90) feet at the front property line, provided that where a lot has less width than herein required, in sep- arate ownership at the time of the passage of this ordinance, this regulation will not prohibit the erection of a one -family dwelling. Lots bordering streets on curves or contours shall be 60 feet in width at the building line. Lot Area per Family: Every dwelling hereafter erected or altered shall provide a lot area of not less than seventy-five hundred (7500) square "^ feet per family, provided that where a lot has less area than herein required in separate ownership at the time of the passage of this ordi- nance, this regulation shall not prohibit the erection of a one -family dwelling. Where a public or community sewer is not available and In use for the disposal of all sanitary sewage, each lot shall provide not less than ten thousand (10,000) square feet per family: ON Floor Area: Each dwelling unit hereafter erected, constructed, recon- structed or altered in said "A-2" One -Family District shall have a floor area, excluding basements, open and screened porches, and garages, of not less than two thousand (2,000) square feet. 10. on "*w 28. Same as "A-1" One -Family District. ` HEALTH REGULATIONS: If the permitted use is not to be served immediately y a water utility occupancy shall be prohibited until water satisfac- tory for human consumption is available from a source on the land, or a public utility source, in adequate and sufficient supply for human use and operation of a septic tank and system. REASON FOR APPEAL: (describe in detail) Recently. in September of 1989, the F City of Southlake re -zoned the above lots to fall under the SF20B zoning which calls for 35 ft. front setbacks, 15 ft. side setbacks, „ *moll and 40 ft. rear setbacks unless on a cul-de-sac, in which case the rear setback is 35 feet. These setback requirements have made the above lots unbuildable in that most lots are only 90 x 111. Currently these lots are under contract to Gallagher Custom Homes, Inc. Mr. Gallagher plans to build -out the subdivision and will find it impossible with the current restrictions. Therefore, we request that the setback requirements on the above lots be varied back to Ai the setback requirements as contained in the previous zoning ordinance approved when the subdivision was originally platted in 1970. "A-2" ONE -FAMILY DISTRICT r USE REGULATIONS: In "A-2" One -Family Districts no building, structure, and or promises will be used and no building or structure shall hereafter rah be erected, constructed, reconstructed or altered, except for one or more of the following uses: a. Dwellings, one -family. b. Any use permitted in "A -I" One -Family District. c. Any accessory use permitted in the "A-1" One -Family District with the following variations: (1) One private garage when located not less than fifty (50) feet back from the front lot line and no less than ten (10) feet back from any other street line, nor less than eighteen (18) inches from the side line, or located in a ie compartment as an integral part of the main building; pro- vided, however, that each entrance to such garage shall be W not less than twenty-five (25) feet back from the lot line to it faces. LJ ZE HEIGHT AND AREA REGULATIONS: in said One -Family District the height of buildings, the minimum dimensions of lots and yards, and the minimum lot area per family permitted on any lot, -shall be as follows: Height: Buildings or structures shall not exceed thirty-five (35) feet, and shall not exceed -two -and one-half (2-1/2) stories in height. Front Yards: Any building hereafter'constructed shall provide for a front yard, the minimum depth of which shall be at least twenty- five (25) percent of the depth of the lot, -but the depth of such front yard need not be more than twenty-five (25) feet. im Side Yards: There shall be a side yard on each side of a building not less than ten (10) percent of the width of the lot; except that such side yard shall not be less than five (5) feet, and need not be more than fifteen (15) feet.
