Carroll Avenue BOARD OF ADJUSTMENT MEETING June 25, 1992 7 P.M. i~ MEMBERS PRESENT: Arthur Sorenson, Chairman; Joe Bentley, Robert Downard, Fred Joyce, Karen Reynolds, Alternate # 1; and Sharon Hobbs, Alternate #2. MEMBERS ABSENT: Dennis Minder STAFF PRESENT: Karen Gandy, Zoning Administrator and Jean Bryson, Building Secretary. Agenda Item # 2 Approval of the Minutes. With no objection, Mr. Sorenson, Chairman; deemed the minutes of May 28, 1992 meeting approved. With no objection, Mr. Sorenson, Chairman; deemed the minutes of June 11, 1992 meeting approved. Agenda Item # 3 Administrative Comments. iW Karen Gandy reported there were 2 ZBA Cases for the July 16th meeting. ,.s'' Mr. Sorenson opened the floor for nominations for Vice Chairman. Mr. Downard nominated Joe Bentley. With no other nominations motion was made Mr. Bentley be elected by acclamation. Motion: Joyce Second: Reynolds Ayes: Downard, Joyce, Reynolds, Hobbs, Sorenson Nays: None Vote: 5-0 Agenda Item # 4 ZBA CASE # 151 Special Exception Use Permit. ZBA CASE # 151, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (6) for in-home swimming lessons. The location is 1414 Whispering Dell Court, being legally described as Block 1, Lot 27, Whispering Dell Estates. The owner/applicant is Nancy Moffat. A presentation was made by Karen Gandy, Zoning Administrator. Mrs. Gandy reported that seven (7) letters were sent to property owners within 200 feet and that four (4) responses had been received. One (1) response in favor of and three (3) response not in favor of the request. (One negative response outside of the 200-foot area, but within the neighborhood.) Public Hearing. Nancy Moffat, owner/applicant, stated that since 1982 she had been teaching swimming at 1414 Whispering Dell Court and had no complaints until the summer of 1991. Mrs. Moffat further stated that she came to City Hall in 1982 and in 1985 and asked if she needed a permit or license to teach swimming at her home and was told no. Mrs. Moffat said, since the City of Southlake does not have a public pool she considers this as a public service and that she had dropped her classes from seven (7) to four (4) students per 30-minute class. She teaches 4 days a week for six (6) weeks during June and July. Mr. Edwin L. Doggett, 1416 Whispering Dell Ct., spoke in opposition of the request. Mr. Doggett owner of the adjoining property stated that due to the noise and the traffic he was opposed to the granting of the request. Public Hearing Closed. After a lengthy discussion a motion was made to grant Case # 151 the request for a Special Exception Use Permit for in-home swimming lessons per Ordinance No. 480, Section 44.12 (6) for one (1) year, expiration date being June 30, 1993 with the following restrictions: 1. Swimming lessons taught for no more than forty-five (45) consecutive days. 2. Swimming lessons no more than 4 days per week. 3. No swimming lessons given on weekends (Saturday & Sunday). 4. Swimming lessons will not begin before 9 A.M. 5. Swimming lessons no later than 5 P.M. except for fourteen (14) consecutive days during the 45-day period, the activity shall be permitted after 5 P.M., but not later than 7 P.M. 6. Maximum of five (5) students receiving instruction at any one time. 7 No non-resident instructors. Irl 8. Applicant will provide a letter to each patron requesting cooperation in parking and traffic patterns to minimize congestion and obstruction to visibility by suggesting . preferred parking locations and traffic patterns. Motion: Bentley Ayes: Bentley, Joyce, Reynolds, Sorenson Nays: Downard Vote: 4-1 to grant Mr. Downard had concern with the objection from the property owners. ill Agenda Item # 5 Meeting Adjourned. with no objections, the chair deemed the meeting adjourned.
