Carroll Avenue BOARD OF ADJUSTMENT MEETING March 12, 1992 7 P M MEMBERS PRESENT: Arthur Sorenson, Chairman; Ernest Johnson, Vice Chairman; Joe Bentley and Karen Reynolds, Alternate # 2. MEMBERS ABSENT: Robert Downard, Fred Joyce and Dennis Minder, Alternate # 1. STAFF PRESENT: Karen Gandy, Zoning Administrator and Jean Bryson, Building Secretary. Agenda Item # 2 Approval of the Minutes. A motion was made to approve the minutes of the December 12, 1991 Meeting. Motion: Johnson Second: Reynolds With no objections, Mr. Sorenson, deemed the minutes of December 12, 1991 approved. A motion was made to approve the minutes of the January 30, 1992 J Work Session. _ Motion: Bentley Second: Johnson With no objections, Mr. Sorenson, deemed the minutes of January 30, 1992 Work Session approved. Agenda Item # 3 Administrative Comments. There were no administrative comments. Agenda Item # 4 ZBA Case #145 Request for Variance. .. Case #145 request for a variance to minimum forty -foot (40') front yard setback per Ordinance No. 11.5 (b) to approve an existing thirteen -foot (131) encroachment that occurred at the time of construction in 1983. The location of the property is 490 Love • Henry Court and the owner/applicant is Harold and Angela Annis. A presentation was made by Karen Gandy, Zoning Administrator. She • reported that eight (8) notices were sent to property owners within 200 feet and there had been four (4) responses in favor of the request. • Public Hearing. Page 2 Harold Annis, owner/applicant was present and presented the Board with a copy of a plat of the property dated October 4,. 1983 and stated that the case spoke for itself. There was no opposition to the request. Public Hearing Closed. A motion was made to grant the request for a variance for the existing encroachment of thirteen feet (13'), but not to allow further encroachment within the required forty -foot (40') front yard. The findings were stated that special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures or building in the same district. That literal interpretation of rights commonly enjoyed by other properties in the same district requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures or building in the same district. Motion: Bentley Second: Johnson Ayes: Bentley, Reynolds, Johnson, Sorenson Nays: None Vote: 4-0 to grant Agenda Item # 5 ZBA Case #146 Request for Special Exception. A request for a Special Exception Use Permit for an accessory building of a size greater than that permitted in the "SF-1A" zoning district per Ordinance No. 480, Section 44.12 (3) to allow a detached garage to be 1,088 square feet. The location is 1027 Diamond Blvd. being legally described as Block 4, Lot 9, Diamond Circle Estates. The owner/applicant is Doug Strickland. A presentation was made by Karen Gandy, Zoning Administrator. She reported that ten (10) notices were sent to response property favors f thin r 200 feet and there had been two (2) p the request. Public Hearing Doug Strickland owner/applicant was present and chose to not speak. There was no opposition to the request. Public Hearing Closed. Page 3 A motion was made to grant the Special Exception Use Permit for the construction of an accessory building greater than the maximum 1,000 sq. ft. allowed in the "SF-lA" zoning district per Ordinance No. 480, Section 44.12. This approval will allow the "footprint" of the accessory structure to be 1,088 sq. ft. as presented. Motion: Johnson Ayes: Bentley, Reynolds, Johnson, Sorenson Nays: None Vote: 4-0 to grant Agenda Item # 6 Proposed amendments to Ordinance No. 480. A discussion was held on proposed amendment to Ordinance No. 480. Agenda Item # 7 Board of Adjustment Rules of Order, Procedure, and Conduct. A discussion was held on the Board of Adjustment Rules of Order, Procedure and Conduct. Agenda Item # 8 Meeting Adjourned. With no objections the Chair deemed the meeting adjourned.
