STAFF PRESENT: Sandra L. LeGrand, City Secretary; Karen Gandy,
Zoning Administrator; Jean Bryson, Building Secretary.
Agenda Item # 2 Approval of the Minutes.
With no objections the Chairman deemed the minutes of the May 30,
1991 approved.
6 Agenda Item # 3 Administrative Comments.
Sandra L. LeGrand, City Secretary administered the Oath of office
to Arthur Sorenson, Joe Bentley, Robert Downard, and Karen Reynolds.
Karen Gandy announced there are no cases pending for June 27th
meeting.
Agenda Item # 4 ZBA Case # 128 Request for a Variance.
ZBA Case # 128, a request for a variance to the side yard
encroachment in the SF-20A zoning district, requiring a
fifteen-foot (151) side yard. The existing side yard per the forms
i~ survey is 13.8 feet. Current zoning is "SF-20A", Single Family-20A
Residential District. The location is 305 Chapel Downs Drive,
legally described as Block 1, Lot 10, Oak Hill Estates.
The owner/applicant is Perry Homes.
A presentation was made by Karen Gandy, Zoning Administrator,
reported that three letters were sent to property owners within 200
feet with no response.
Public Hearing.
Jean Bryson, Building Secretary; stated that the plot plan
submitted when permitting showed a fifteen foot (15') side yard and
the building department did not note the side yard encroachment on
the forms survey when received from American Surveying Company of
Dallas, Inc. April 16, 1991.
David Baxter, Perry Homes representative, stated that he was not
aware of the encroachment until he received a copy of the forms
survey on May 14, 1991 and he immediately notified Lee Roberts,
Chief Building Inspector for the City. The house at this time was
in cornice stage.

Agenda Item #4 continued.
There was no opposition to the request.
Public Hearing Closed.
After a lengthy discussion with the applicant, David Baxter the
following concerns were stated:
1. Rear yard set-back not shown on form survey.
2. Is the garage attached or detached?
A motion was made to table ZBA Case # 128 until May 27, 1991
meeting.
Motion: Downard
Second: Bentley
Ayes: Bentley, Downard, Joyce, Johnson, Sorenson
Nays: None
Vote: 5-0 to table
Karen Reynolds was unable to vote.
Item # 5 Meeting Adjourned.
With no opposition Mr. Sorenson deemed the meeting adjourned.
