MEMBERS ABSENT: Arthur Sorenson, Chairman, Joe Bentley, and Patty McCarty, Alternate #2. STAFF PRESENT: Karen Gandy, Zoning Administrator and Jean Bryson, Building Secretary. Agenda Item # 2 Approval of Minutes. With no objections the chairman deemed the minutes of April 11, 1991 approved. Agenda Item #3 Administrative Comments. PP Mrs. Gandy reported there were no cases pending. Agenda Item #4 Case # 120, Request for a Special Exception. Case # 120, a request for a Special Exception Use permit for a family quarters per Ordinance No. 480, Section 44.12 (n). The property is located at 1040 Thousand Oaks Court, being legally described as Block A, Lot 2, Carmel Bay Addition. The owners are Mr. and Mrs. Manuel Gurule; the applicant is Vector Associates, Inc. A presentation was made by Karen Gandy, Zoning Administrator. Mrs. Gandy reported that nine (9) letters were sent to property owners within 200 feet with one (1) response in favor of the variance. Public Hearing. Hani Ghorayeb 4201 Wingren Drive #104 Irving, Texas representing Vector Associates, Inc., asking for a Special Exception Use for family quarters as shown on the revised site plan. Mr. Ghorayeb presented a display drawing of the structure. A two story building, the upper level being the family quarters and the lower level being a boat house. The structure will be located behind the principal dwelling. There was no opposition to the request. I^ Public Hearing Closed. A motion was made to grant the Special Exception Use Permit for family quarters located at 1040 Thousand Oaks Court, being legally described as Block A, Lot 2, Carmel Bay Addition. A separate building with a floor area not exceeding 1000 square feet and is located behind the principal dwelling. 2. The quarters share a common street access with the r. principal dwelling. 3. All utilities share the same meter as the principal dwelling. 4. A separate septic system from the principal dwelling. Case # 121, a request for a variance to the front and rear yard setbacks as required by Ordinance No. 480, Section 15.1, SF-20 B Ik& Zoning District. The request is to allow the original setbacks of twenty-five (25') in the front and rear yards when Dove Estates was E developed in 1970. The property is located at 2980 Lake Drive and is legally described as Block 1, Lot 7, Dove Estates. Owner/Applicant is Charles G. Giffin, Jr., dba Giffin Homes. A presentation was made by Karen Gandy, Zoning Administrator, 15 letters were sent to property owners within 200 feet to date there has been no response. fto Public Hearing. Terry Stillwagon, 601 Turtle Dove Grapevine, representing Giffin Homes stating the setback create a hardship on this lot which is only 111" deep and the proposed structure is typical of the other structures in Dove Estates. There was no opposition to the request. Public Hearing Closed. A motion was made to grant Case #121 a variance allowing 25' front setback and a 25' rear yard setback. Mr. Minder stated the finding, that special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or building in the same district. That literal interpretation of the provisions of this ordinance would deprive Board of Adjustments Meeting Page 3 April 25, 1991 Agenda Item # 5 continued. the applicant of rights commonly enjoyed by other properties in the same district under the terms of this ordinance. That granting of the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures, or buildings in the same district. Case # 122, a request for a variance to the yard setbacks as required by Ordinance No. 480, Section 15.1, SF-20 B Zoning District, The request is to allow the original setbacks of twenty-five feet (25') in the front and rear yards and ten percent (10%) of the width of the lot for the side yard per Ordinance No. 161, A-2 Zoning District in place when Dove Estates was developed in 1970. The property is located at 1380 Burney Lane and is legally described as Block 2, Lot 6, Dove Estates. The owner/applicant is Hinds and Stone Enterprises, Inc. A presentation was made by Karen Gandy, Zoning Administrator. Mrs. Gandy reported that 15 letters were sent to property owners within 200 feet. One written response opposing the request and when informed of the actual request the opposition was rescinded. Two telephone call inquiring about the request, both offered no opposition. Public Hearing. James Stone Arlington representing Hinds and Stone Enterprises, Inc. requesting a variance allowing the original setbacks for Dove Estates. There was no opposition to the request. Public Hearing Closed. A motion was to grant Case # 122 a variance as request to allow the original setbacks of twenty-five feet (251) in the front and rear yards and ten percent (10%) of the width of the lot for the side yard per Ordinance No. 161, A-2 Zoning District in place when Dove Estates was developed. A presentation was made by Karen Gandy, Zoning Administrator. Mrs. Gandy reported that 16 letters were sent to property owners within 200 feet. To date there have been no written responses received. Public Hearing. Robert Joles, representing, Dreamscape Homes, Inc. stated in order to build on Lot 36, Block 2 of the Dove Estates Addition a variance was need to all setbacks. There was no opposition to the request. Public Hearing Closed.
