MEMBERS PRESENT: Fred Joyce, Chairman; Joe Bentley Vice Chairman;
Karen Reynolds, William Towler and Sharon Hobbs, Alternate #1.
MEMBERS ABSENT: Dennis Minder.
STAFF PRESENT: Karen Gandy, Zoning Administrator; Jean Bryson,
Secretary.
Agenda Item # 2 Approval of the Minutes.
With no objections, Mr. Joyce deemed the minutes of the June 10,
1993 regular meeting approved.
Agenda Item # 3 Administrative Comments.
Karen Gandy reported there is one case for the July 15th meeting .
Agenda Item # 4 ZBA CASE #177, Variance.
Case # 177, variance request of three feet (3') into the required
thirty feet (30') front yard per the provisions of Ordinance No.
480, Section 30.5. The location is 203 Sheffield, being Lot 2
Block 2, Stone Lakes Phase I. The owner/applicant is Southlake
Properties Joint Venture.

A presentation was made by Karen Gandy, Zoning Administrator. Ms.
Gandy stated that Eight (8) letters were sent to property owners
within 200 feet with one (1) response in favor of the request. Mr.
Jobe submitted a signed form from twenty (20) property owners in
the subdivision in favor of the request that includes all property
owners within the 200 feet.
Public Hearing.
Southlake Properties Joint Venture was represented by Phil Jobe.
Mr. Jobe said the buyer wanted to install a pool that creates a
need for a variance to save the trees.
There was no other person wishing to speak either in favor or in
opposition to the request.
Public Hearing Closed.
A Motion to Grant a Variance ZBA Case # 177:
That the BOARD OF ADJUSTMENT of the CITY of SOUTHLAKE, TEXAS,
pursuant to the findings set forth in this case, HEREBY GRANTS
AUTHORITY to VARY the terms of the ZONING ORDINANCE as it relates
to the property located at 203 Sheffield Court; in Southlake,
Texas and being legally described as Lot 2, Block 2, Stone Lakes
Phase I; such Variance to be granted as follows:

A. The terms of the zoning ordinance are varied only in regard to

B. Furthermore, the terms of the zoning ordinance are varied only
to the extent necessary to permit construction of a residence as
depicted in the applicant's plot plan, with encroachment into the
required and plotted front yard not to exceed 3.0 feet, and only to
the extent necessary as indicated in the plot plan; and
C. Finally, the Variance is permitted, and shall be enforced,
constructed, operated, maintained and/or otherwise implemented with
reference to the following ATTACHMENTS, which are hereby
j incorporated into this motion:

The findings were stated by Joe Bentley.
The evidence presented by the applicant demonstrates that a literal
enforcement of the terms of the zoning ordinance on the property in
PW question would impose an unnecessary hardship, in that the
peculiar shape of the lot, combined with the location of the lot on
the corner of a cul-de-sac street, and combined with the desired
aesthetic goals of the city and the builder/owner create a
situation which acts to limit significantly the utilization of the
lot by making garage access unreasonable and by unfairly reducing
usable yard area in the rear of the lot;
and that the general purpose and intent of the ordinance is to
promote desirable and aesthetically pleasing designs and
development, which the proposed plan achieves to a greater degree
than an alternative plan requiring no ordinance would achieve;
and furthermore, that special conditions and circumstances exist
which are peculiar to the land, structure or buildings involved
which are not applicable to other lands, structures or buildings in
the same district; and that these special conditions and
circumstances do not result from the actions of the applicant; and
that granting a variance will not confer upon the applicant any
special privilege that is denied by the zoning ordinance to other
lands structures or buildings in the same district; and
furthermore, that the requirements of the zoning ordinance
regarding a variance have been met by the applicants; and that the
reasons set forth by the applicant justify the granting of a
variance, which is the minimum variance that will make possible the
reasonable use of the land, structure or building; and finally,
that granting of a variance will be in harmony with the general
purpose and intent of the zoning ordinance and will not be
injurious or otherwise detrimental to the public welfare.

Agenda Item # 5 ZBA CASE #178 An Appeal
Case # 178, an appeal of the Administrative official's
interpretation regarding the parking of a commercial vehicle in the
"SF-lA" Single Family lA Residential District. The location is 209
Westwood being legally described as Lot 23, Block 1, Woodland
Heights Addition. The owner applicant is Phillip T. Norman
A presentation was made by Karen Gandy, Zoning Administrator. Ms.
Gandy stated that nine (9) notices were sent to property owners
within 200 feet. There were twelve (12) responses six (6) within
the 200 feet 4 in favor and 2 opposed; Six (6) outside the 200 feet
all opposed.
Public Hearing.

comparison of size of vehicles to the board but was not entered
into evidence. Mr. Norman presented six (6) letters in favor of
the request (1 within the 200 feet and 5 outside the 200 feet)
ri After a lengthy discussion Mr. Norman requested Case # 178 be
tabled.
A motion was made to table Case #178 at the request of the
applicant until the July 15th meeting.
