Ilr Agenda Item # 2 Approval of the Minutes. 40 With no objections, Mr. Joyce, deemed the minutes of March 25, 1993 to approved. W Agenda Item # 3 Administrative Comments. Aw Karen Gandy reported that the next regular meeting would be June w. 10, 1993. r The Chairman requested a Board of Adjustment Procedures Discussion Item for June 10th meeting. 4i *WOO, Agenda Item # 4 ZBA CASE # 173 Special Exception Case # 173, Special Exception Use Permit for a portable building for additional classroom space per Ordinance No. 480, Section 44.12 (7). The location is 2501 W. Southlake Blvd., being Lot 3 J. G. Allen No. 18 Addition. The Zoning is "CS" Community Service i The owner/applicant is Southlake Church of Christ. A presentation was made by Karen Gandy, Zoning Administrator. Ms. Gandy stated that eight (8) letters were sent to property owners within 200 feet with no response. Public Hearing. John Francis, Deacon, Building and Grounds; requested a Special Use Permit for a portable building to be used for additional classrooms for a period of 3 years. The building would be 36' X 60' with skirting around the building. Mr. Francis stated the Church was starting to work on a master plan. There was no other person wishing to speak either in favor of in opposition to the request. Public Hearing Closed. Board of Adjustment Meeting page 2 May 27, 1993 Agenda Item # 4 continued. After a discussion a motion was made to grant Case # 173, Special Exception to the terms of the Zoning Ordinance as it relates to the property located at 2501 W. Southlake Blvd. in Southlake, Texas and being legally described as Lot 3, J. G. Allen No. 18 Addition; such a Special Exception to be granted as follows: A. Pursuant to the zoning ordinance, Section 44.12 (7). B. Thereby permitting the following: A portable building (additional classroom) 36' x 60' with skirting around the building. C, Furthermore, the following conditions, and/ or restrictions are hereby imposed to ensure continued harmony with the general purpose and intent of the zoning ordinance, and so that there will not be any resulting injury nor detrimental effect to the public welfare: 1. The location of the structure shall be essentially as depicted in the plot plan; and 2. The construction shall be according to specification in the Building Description; D. Finally the Special Exception is permitted, and shall be enforced constructed operated, maintained and/or otherwise implemented with reference to the following attachment, which are hereby incorporated into this motion: Attachment # Description One Plot Plan Two Building Description it Motion: Minder Second: Reynolds Ayes: Minder, Reynolds, Hobbs, Joyce Nays: None Vote: 4 - 0 to Grant Agenda Item # 5 ZBA CASE # 174, Variance. Case # 174, Variance to Ordinance No. 480, Section 8.5 (b) which requires a minimum front yard setback of thirty feet (301) for i~ properties zoned "CS" Community Service. The location is 1280 E. Highland Avenue, being Lot 4, F. Throop No. 1511 Addition. The owner/applicant is Carroll Baptist Church. A presentation was made by Karen Gandy, Zoning Administrator. Ms. Gandy stated that nine (9) letters were sent to property owners within 200 feet and one (1) favorable response was received. Eli Melton, 1680 Brumlow, represented the Carroll Baptist Church and stated the request is to rebuild on the existing foundation. Prior to issuance of the building permit, the City required that the property be platted and in doing so the encroachment was 41 discovered. Only minimal encroachment would have occurred had the City not required platting and the dedication of approximately seventeen feet (17') of additional R.O.W. The City Council approved the plat as shown in the submitted exhibit with the understanding that the Board of Adjustment would be reviewing the variance application. David Druman, 1589 S. Gravel, a church member for a number of years and wishes to build on existing site to hold cost to a bear minimum. Bob Stith, 1280 E. Highland, is pastor of the church. He stated the building would be an asset to the community. There was no other person wishing to speak either in favor or in IN opposition to the request. di Public Hearing Closed. After a lengthy discussion Case # 174 pursuant to the finding set forth in this case, grants to vary the terms of the Zoning Ordinance as it relates to the property located at 1280 E. Highland Avenue in Southlake, Texas and being legally described as Lot 4, F. Throop No. 1511 Addition. Such variance to granted as follows: A. The terms of the zoning ordinance are varied only in regard to Section 8.5 (b); and B. Furthermore, the terms of the zoning ordinance are varied 17 feet the extent necessary to rebuild the church as submitted with the variance application and depicted in the plot plan (attachment One); and C. Finally, the variance is permitted and shall be enforced, constructed, operated, maintained and/or otherwise implemented with reference to the following attachment, which are hereby ,.rr Attachment # Description One plot plan X11 Board of Adjustment Meeting page 4 May 27, 1993 Agenda Item # 5 continued. Motion: Minder Second: Hobbs Ayes: Reynolds, Minder, Hobbs, Joyce Nays: None Vote: 4 - 0 to Grant The finding: The evidence presented by the applicants demonstrates that a literal enforcement of the terms of the zoning ordinance on the property in question would impose an unnecessary hardship in that the existing foundation combined with the setback requirements on this lot by the ordinance, result into additional cost to remove the existing slab and construct a new slab; and that the general purpose and intent of the ordinance is is to promote desirable im development, and the submitted proposal is considered to highly desirable. Agenda Item # 6 ZBA CASE #175, Variance Case # 175, variance to Ordinance No. 480, Section 11.5 (c) which requires a minimum side yard setback of twenty feet (20') for } structures constructed in the "SF-IA" Single Family-lA Residential district. The location is 2603 S. Quail Run Court, being Lot 9, Block B, Quail Creek Estates. The owners/applicants are Richard J. and Mary L. Horton. Karen Gandy reported that the applicants ask that Case # 175 be tabled until June 10th meeting. A motion was made to table Case # 175 for the June 10, 1993 meeting.
