Alternate # 1; and William Towler, Alternate #2.
MEMBERS ABSENT: None
STAFF PRESENT: Karen Gandy, Zoning Administrator and Jean Bryson,
Secretary.
Agenda Item # 2 Approval of the Minutes.
With no opposition a motion was made to approve the Minutes of
October 15, 1992 Regular Meeting.

Agenda Item # 3 Administrative Comments.
Karen Gandy, Zoning Administrator, reported on January 28, 1993
there are six (6) cases scheduled.
Ms. Gandy discussed meeting with Allen Taylor, City Attorney. The
irr board suggested dates of February 1st or February 22nd at 7 P. M.
Agenda Item # 4 ZBA CASE #161, Variance
Case #161. a variance to Ordinance No. 480, Section 34.2 (e) which
limits the height of an accessory structure to fourteen feet (14).
The proposed height of the storage barn is twenty-three feet, nine
inches (ground to peak of roof) on property legally described as
Block 4, Lot 6, Harbor Oaks Subdivision. The location is 1115
Harbor Retreat.
The owner/applicant is John E. and Ona M. Pruitt.
A presentation was made by Karen Gandy, Zoning Administrator. Ms.
Gandy reported that twenty five (25) letters were sent to property
owners and that no written response had been received.
Public Hearing.
Mr. John Pruitt owner/applicant was present and said the foundation
had been in place since 1988 for the storage barn and construction
was delayed to the loss of his job. In applying for a building
permit he was told of a 1991 Ordinance change.

James G. Humphrey, 1110 Harbor Retreat, said he was in favor of the
variance; in the Harbor Oaks area there are many barns similar in
structure and height to the one that Mr. Pruitt has submitted.
Betty Francis, 1300 White Wing Court, said that she was not in
favor of the variance and that she believed the barn would be used
for a poultry farm and objected to the noise and the smell.
Ms. Francis presented to Ms. Gandy four letters of opposition to
the variance request from Noga Pokala 1302 White Wing Court,
William P. Hess, Jr. 1309 White Wing Court, Cindy and Michael
Miller, 1459 Flaming Circle and Ms. Francis.
Kerry Harrington, 1300 White Wing Court, said the height would
obstruct their view and he was not in favor of the variance.
Marsha Terry, 1479 Flamingo Circle, said she was neutral.
Mr. Pruett addressed the questions of Ms. Francis as to the use of
the barn and he said it was a storage barn.
There was no other person wishing to speak either in favor or in
„ opposition to the request.
' Public Hearing Closed.
A motion was made to grant Case # 161 a four (4') foot variance to
Ordinance No. 480, Section 34.2 (e).
The finding were stated that special conditions and circumstances
exist which are peculiar to the building involved and which are not
applicable to other buildings in the same district. That literal
interpretation of rights commonly enjoyed by other properties in
the same district requested will not confer on the applicant any
' special privilege that is denied by this ordinance to other
buildings in the same district.

ZBA Case #162, Special Exception Use Permit per Ordinance No. 480,
Section 44.12 (1) for family quarters/workshop to be located
approximately 30 ft. North of the primary structure and
""`N' approximately 200 feet South of the North property line. The
habitable area appears to be 289 sq. ft. (17' x 17' ) on the second
floor. The location is 1862 North Peytonville, legally described
as Lot 2R Block 1, Lamp Estates.

The owner applicant is Michael John Costello.
on A presentation was made by Karen Gandy, Zoning Administrator. Ms.
Gandy reported that twelve (12) letters were sent to property
owners within 200 feet and that two (2) responses in favor of the
request were received.
Public Hearing
Jack Bryant, representative and contractor for John Costell said
the family quarter is 289 square feet of living area over a storage
garage/workshop. The septic system was approved by Kirk Fuqua,
Tarrant County Health Department (copy attached), all other
utilites will be on the same meter as the principal dwelling.

David A. Wirtala, 1852 N. Peytonville, said Mr. Costell property is
heavily wooded and the new construction will not be visible from
the street. He is in favor of the request.

A motion was made to grant Case # 162 the request for Special
Exception Use Permit to construct family quarters/garage/workshop.

ZBA Case # 163, a variance to the front yard setback requirement
per Ordinance No. 480, Section 26.5 (b) for property legally
described as 6.3725 acres in the R. D. Price Survey, Abstract No.
922D, Tract 22. The location is 4285 T. W. King Road.
Owner, Dalden Corporation.
Mrs. Karen Gandy, Zoning Administrator, reported the Dalden
Corporation request Case #163 be tabled.
A motion was made to postpone Case # 163 to the January 28, 1993
meeting.
