STAFF PRESENT: Karen Gandy, Zoning Administrator, Jean Bryson, Secretary. k + AGENDA ITEM #1 Call to Order. The meeting was called to order by Joe Bentley, Vice Chairman. AGENDA ITEM #2 Approval of the Minutes. A motion was made to approve the minutes of the Regular meeting January 13, 1994 as amended. With no objections the Chair deemed the minutes approved. A motion was made to approve the minutes of the Regular meeting February 10, 1994. With no objections the Chair deemed the minutes approved. AGENDA ITEM #3 Administrative Comments. Karen Gandy, Zoning Administrator, reported there will not be a meeting on March 24, 1994. *e Agenda Item #4 ZBA Case #196 Variance. ~r Case # 196, Variance to Ordinance No. 480, Section 33.14 requires a minimum lot size of one *A acre for a private sewage disposal system and subsurface drainage field for the proposed Block err 2, Lots 13, 14, 15, and 16, Hallwood Addition. The location is Northwest of Harbor Oaks Subdivision adjacent to Burney Lane. The owners are David George and Betty Jones Foreman. The Applicant is VLMC, Inc. Continuation of Public Hearing. rrr Karen Gandy, Zoning Administrator, stated that Mr. Tim Fleet, President, VLMC, Inc. asked to withdraw Case #196 from consideration. Case # 197 Special Exception use permit for family quarters on property zoned "SF IA" Single Family Residential per Ordinance No. 480, Section 44.12 (1). The applicant proposes a family jy quarters of approximately 768 sq. ft. to be located on the Second floor of an existing barn. The location is 2940 Burney Lane, legally described as Block 2, Lot 7, Harbor Oaks Estates. The owner/applicants are Don S. and Barbara Vaughn. A presentation was made by Karen Gandy, Zoning Administrator. Ms Gandy, reported there were seven (7) letters sent to property owners within 200 feet and there were two (2) responses + in favor of the request. 4" Public Hearing. 4W Mr. Don Vaughn presented to Ms. Gandy the Approval of septic system from the Health Department. Mr. Vaughn stated that the barn was 8 years old, had never been finished and was wanting to finish for guest quarters for their Children when they visit. There is to be no kitchen only sleeping quarters, bath and closets. There was no other person wishing to speak either in favor or in opposition to the request. Public Hearing Closed. Findings were stated by Mr. Bentley. The requested exception is specifically permitted by the Zoning Ordinance, as set forth in Section 44.12(1); and r The location of the proposed activities and improvements are clearly defined on the concept plan or plot plan submitted in this case, or as otherwise required to be submitted; and Furthermore, the evidence before the Board clearly shows that the special exception will be wholly compatible with the use and permitted development of adjacent properties, either as filed or subject to such limitations and requirements as the Board of Adjustment deems to be necessary to protect adjacent properties. ~w aw A motion to grant the special exception request was made. Case # 198 Special Exception Use Permit for the construction of an accessory building of a size greater than 1000 sq. ft. permitted under the accessory building requirements of the "SF-1A" (3). The applicant requests the two-stall horse stable not to exceed 735.0 s.f. (20.16' X 36.42'). The cumulative square footage of all accessory buildings on the property (inclusive of the proposed stable) is approximately 1,515 sq. ft. The location 2940 Burney, legally described as 2.035 acres and being Lot 7, Block 2, Harbor Oaks Estates. The owner/applicants are Don S. and Barbara Vaughn. A presentation was made by Karen Gandy, Zoning Administrator. Im Don Vaughn, owner/applicant stated his request is to build a two stall horse stable to be placed 26 feet from the West property line and 26 feet for the North property line. The property is j surrounded by a six foot privacy fence with 241 trees on 2.035 acres. The proposed stable will not be noticeably visible from the street. There was no other person wishing to speak either in favor or in opposition to the request. Public Hearing Closed. Findings were stated by Mr. Bentley. 4" The requested exception is specifically permitted by the Zoning Ordinance, as set forth in Section 44.12 (3); and The location of the proposed activities and improvements are clearly defined on the concept plan or plot plan submitted in this case, or as otherwise required to be submitted; and Furthermore, the evidence before the Board clearly shows that the special exception will be wholly compatible with the use and permitted development of adjacent properties, either as filed or subject to such limitations and requirements as the Board of Adjustment deems to be necessary to protect adjacent properties. A motion to grant the Special Exception request was made. That the BOARD OF ADJUSTMENT of the CITY OF SOUTHLAKE, TEXAS pursuant to the findings set forth in this case, HEREBY GRANTS a SPECIAL EXCEPTION to the terms of the ZONING ORDINANCE as it relates to the property located at 2940 Burney Lane, in Southlake, Texas and being legally described as Block 2 Lot 7, Harbor Oaks Estates; Such SPECIAL EXCEPTION to be granted as follows: A. Pursuant to the Zoning Ordinance, Sections 44.12 (3); and B. Case # 199 Special Exception Use Permit for the construction of an accessory building of a size " greater than the 1,000 sq. ft. permitted under the accessory building requirements of the "SF IA" zoning district in Ordinance No. 490, Section 44.12 (3). The applicant requests to build a horse barn not exceeding 1,315 S.F. (36.25'). The location is 211 Eastwood, legally described as 2.902 Acres and being Lot 20, Block 1, Woodland Heights Addition. The owner/applicant is Donalynn Schroetke. A presentation was made by Karen Gandy, Zoning Administrator. Ms. Gandy stated there were nine (9) letters sent to property owners within 200 feet and there were three (3) response in favor of the request. There was no other person wishing to speak either in favor or in opposition to the request. Public Hearing Closed. Findings were stated by Mr. Bentley. Pursuant to the Zoning Ordinance, Sections 44.12 (3); and „ B. Thereby permitting the following: Construction of accessory building of aggregate size in excess of 1,000 square feet more specifically, a barn of approximately 1,315 square feet, bring the total aggregate size of accessory buildings to approximately, 1315 square feet; and C.
