The regular meeting of the City Council was held on April 15, 1961 at 2 PM,
April 15, 1961. Mayor John Stevenson, Councilmen John Cope, C. M. Gordon, J. J. P
Carlile, answered roll call. C. M. Gordon administered the oath of office to
John M. Stevenson, elected mayor for a second term on April 4. 1961, and J. J.
Carlile, elected Councilman, Place Two. Mr. W. C. Cummings, Councilman Place One, PP
was not present.

Mayor Stevenson reappointed the following special committees and officers:

Schultze, H. M. Hunter, Harold Knight.

Minutes of the last meeting were read and approved.
Statements were presented for current expenses: $25.00 to Frank Lanford,
for seven cases in Corporation Court for traffic violations; $18.56, Stafford.
Lowden, for election supplies; fees for election officials: Judge, L. T. Cathcart,
$12.00; clerks, Mmes. Cleo Howard and Doris Hall, $10.00 each. °

The Council approved these bills for payment.
A proposal for speed control in construction areas was read by Mr.
Stevenson. The State Highway Department asked the City to enforce such
regulations as it deemed necessary in the course of construction. The Council
approved the request and signed copy was returned to Mr. R. A. Bossy, Highway
Engineer; the original was added to the permanent files as Ordinance fiber ~
125. Mr. Keller Austin was to be notified of the City's action and instructed
to see that the regulations were observed. PP
Donation to the Carroll School Athletic field was discussed and tabled for
one month, Mention was made that the Carroll PTA propsed donating $204.00; that
the Texas Power and Light Company had given help toward this project. Mr. J. J.
Carlile agreed to contabt REA for a contribution; John Stevenson, to ask the
Southwestern States Telephone Company for similar help.
The possibility of investing the City's surplus funds in an interest-bearing is
account was discussed. Also, a donation to the Civic Center of Grapevine was discussed
and tabled for further consideration. O•

WHEREAS, Section 8 of Article 827a., Vernon Penal Code of the State
of Texas, provides that whenever the governing body of the City shall deter-
mine upon the basis of an engineering and traffic investigation that any prima
facie speed therein set forth is greater or less than is reasonable or safe
under the conditions found to exist at arq intersection or other place or upon
any part of a street or highway within the City, taking into consideration
the width and condition of the pavement and other circumstances on such por-
tion of said street or highway, as well as the usual traffic thereon, said
governing body may determine and declare a reasonable and safe prima facie
°R speed limit thereat or thereon by the passage of an ordinance, which shall
be effective when appropriate signs giving notice thereof are erected at
such intersections or other place or part of the street or hiEftway, now there-
fore,

vehicles are hereby determined and declared to be reasonable and safe, and
such speed limits are hereby fixed at the rate of speed indicated for ve-
hicles traveling upon the named streets and highways or parts thereof,
described as follows:

SECTION 2. The City Council of the City of PP

SECTION: 3. It is hereby declared that the construction project on o

this shall remain in effect until the completion and acceptance of the said
construction project by the Highway District Engineer or until such time as
the construction project has progressed to a stage whereby, in the opinion
of the Highway District Engineer, traffic may safely travel the construction
project, or portions thereofj, at the rate of speed posted prior to the con-
struction. The Highway District Engineer vill have the authority to replace
the construction speed zone signs with speed zone signs reestablishing the
speed zoning prior to construction and the placement of such signs shall be
evidence of the governing speed zone or zones. The completion and/or accept-
ance of the said construction project by the Highway District Engineer shall
cancel the provisions of this ordinance and the Highway District Enineer PP
shall be authorized to remove all such signed usedcompliance with regul-
ations set forth in this ordinance.
SECTION 4. Any ordinance or any part thereof in direct conflict with this
ordinance is hereby superseded and the part of the ordinance in conflict
herewith shall be null and void so long; as this ordinance is in effect.
However, any ordinance or part of an ordinance superseded by this ordinance
shall automatically be reinstated in force upon the date of completion
and/or acceptance of the said construction project, when this ordinance
is no longer in effect.
SECTION 5. Any person violating any of the provisions of this ordinance'
shall be deemed guilty of a misdemeanor and upon conviction thereof shall
be fined in any sum not more than two hundred (4200.00) dollars.
SECTION 6. If any part of this ordinance be declared unconstitutional
or otherwise void by s court of competent jurisdiction, such decision
shall, in no way, effect the validity of any of the remaining parts of
this ordinance unless the part held unconsititutional or void is insepa-
ble from, and indispensable to, the operation of the remaining parts.
The City Council hereby declares that it would have passed those parts
of this ordinance which are valid and would have omitted any parts which
may be unconstitutional or void, if it had known such parts were uncon
stitutional or-void at the time of the passage of this ordinance.
