Council Meeting

The regular meeting of the City Council was called to order by Mayor
John R. Tate. Answering roil call were councilmen W H. Crumbakeri Earl
Williams, J. D. Cate; Keller Austin, marshal, Ben McClure, city attorney,
and a number of visitors were present.
Mr. G. W. Hagardine appeared as spokesman for the group of visitors
and presented a petition in protest of the recent action of council in
approving permit for construction of a four-plex unit of housing by E. P,
Allison. After some discusssion along the line of content and intent of
city ordinance 119, Mr. Gene Wallace spoke of the restrictions contained
in his own deed of trust from the company headed by Mr. Allison, wherein
was stated that only single family dwelling of approved specifications could
be erected on land in the area. It was assumed that similar restrictions
applied to the total property in Mr. Allison's name,
After long deliberation and general discussion, Council decided to
stand by its' decision to Mr. Allison. Namely, the permit to erect the
first unit of the proposed several, would not be revoked. W. H. Crumbaker
made the motion: that since no violation of the conditions on which the
permit was issued appeard to have been broken, therefore, the matter should
' be allowed to stand as originally granted. J. D. Cate seconded the motion,
and vote was unanimous.
Mr. Tate assured the visitors that their plea for rezoning the area
to read strictly for residential purposes for one family units would be
turned over to the newly appointed zoning and planning commission for early
consideration.
On this note, the names of the men on this commission were heartily
approved by council members. No chairman was designated by Mayor Tate,
so the order of listing does not indicate the usual sign. Henry Ridings,
G. W. Hagardine, L. A. Ca4, Frank Croy, H. M. Hunter.
The matter of additional maps and copies of ordinances was again
discussed. Mr. Crumbaker elected to make another tracing of the city's
area and add the new homes which have been built. the secretary was in-
structed to proceed in as economical manner as possible to obtain the
necessary copies of the needed ordinances, especially of the number 119,
which has to do with zoning and planning.
A request for franchise for installing a water supply system throughout
the area was read. No action was taken except that it was suggested that the
writer present his plan in person at the next regular council meeting.
Routine bills were approved. Financial statement of 1963 read and
approved. Permit was granted to Mr. Yates for his store-park, It was explained
r that Mr. Yates did not realize he was within the city limi#,$ until just recently
and he hastened to correct his error. A plat was submitted and approved on
motion of Earl Williams, seconded by J. D. gate, Ouretion of J. D. Cate, seconded
by W. H. Crumbaker, an additional $730.00 was transferred to the City interest-bear-
ing account with Tarrant Savings and Loan Assoextion. Motion to adjourn REW, J. D. C.

TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF SOUTH
LAKE, TEXAS
We, the undersigned, being resident citizens and home-
owners or householders of the City of South Lake, Texas, hereby
register our protest of the action of the City Council and City
officials in issuing a building permit to Mr. E. P. Allison for
the erection of apartments upon his property in the Francis
Throop Survey abutting upon County Road.No. 3080, because said
action is detrimental to the general welfare and morals of the
community, will have a depressive effect on property values
and the desirability of the neighborhood for residential pur-
poses, and is contrary to the representations and scheme of
development heretofore made and followed by the said E. P.
Allison in erecting and selling single-family dwellings in the
same area; and we hereby respectfully petition the City Council
to reconsider such action and to revoke said building permit,
and if the existing Zoning Ordinance of the City of South Lake
does not now restrict property in the said Francis Throop Sur-
vey to single-family residential uses and purposes, we further
petition the City Council to immediately take such steps as
are necessary to hold public hearing and amend said ordinance
to so restrict such area, refusing the issuance of building
permits therein for any 9ther type construction until such a-
mendment can be accomplished.
