REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 4, 1969
The City Council of the City of Southlake, Texas, met in
regular session in the Council Chamber of City Hall on
Tuesday, November 4, 1969, with the following members present:
J. L. Clow, Mayor
Thurman Hearn, Mayor Pro Tem
J. D. Cate, Jr., Councilman
M. J. O'Brien, Councilman
W. B. Brown, Councilman
Absent: Wade Booker, Councilman
Also present: William D. Campbell, City Attorney
Mayor Clow called the meeting to order at 7:40 P.M.

Fire Department Report was given by Fire Chief Bob Steele.

APN frequency is in the near future and a change-over will have
m to be made at that time. Also, work has begun on the second
floor of City Hall. This room is to serve as a meeting room
and classroom for the Volunteer Fire Department, as well as a
recreation room for them.
Planning & Zonin Commission Recommendations, ZA-69-21,
ZA- 9-22 and ZA- 9-23 were set for public hearing by the
Council on Wednesday, December 3,1969. Discussion was had
regarding dedicating right-of-way.
In the matter of the Messina Brothers' Addition,
"Hilltop Acres", the recommendation was that the curb and
gutter regulation be lifted in this instance (see attached
copy of proposal from the Messinas). The motion was made by
Councilman Brown that the recommendation from the Planning &
Zoning Commission to lift the curb and gutter regulation in
40 "Hilltop Acres" be accepted; seconded by Councilman O'Brien.
The motion carried uananimously.

Council that the survey plat is the one to be approved by the
'j Council and it is this plat which is recorded.)
Police Department Report was given by Chief G. D. Ince (copy
attached). Discussion was had regarding the poor performance
of the 1969 patrol car. The Council instructed Chief Ince to
call Detroit alerting them as to the various problems connected
with the car and the service regarding it and, following this
call, the City Secretary to write a letter to the Ford Company.

PUBLIC HEARING OF THE CITY COUNCIL r
NOVEMBER 5, 1969
The City Council of Southlake, Texas, met for a public hearing
in the Council Chamber of the City Hall in Southlake, Texas,
Wednesday, November 5, 1969.
Present: Thurman Hearn, Mayor Pro Tem
Michael J. O'Brien, Councilman
J. D. Cate, Jr., Councilman
W. B. Brown, Councilman
Absent: J. L. Clow, Mayor
Wade Booker, Councilman
The meeting was called to order by Mayor Pro Tem Hearn at 7:40 PM.
ZA-69-19: The recommendation from the Planning & Zoning Com-
mossion was read aloud to the Council. The applicant, W. D.
Farrar, had requested a change in zoning from Ag District to
H District on his land described as follows:
69.14 acres of land in the City of Southlake,
Tarrant County, Texas, being Tract 6 of the
Thomas Mahan Survey, Abstract No. 1049.
The Commission recommended that this request be approved by the
Council with the provision for right=of-way on the east boundary
of said tract and also along the south line of SH 114 which
bounds this propei-ty on its north side, the right-of-way in
both instances to be 50 feet. Most of the discussion which
followed concerned that ROW along SH 114 and the amount of
land involved placing a severe penalty upon the owner. Mr.
Farrar, represented by his attorney, Mr. Stanford, was willing
to dedicate the requested ROW on the east boundary of said land.
The following agreement was reached at this time:
W. D. Farrar is to set aside a fifty foot strip along SH 114
for a period of ten years subject to be used by the City of
Southlake'.for street purposes; that this is not a dedication
but sets aside the land subject to condemnation by the City of
Southlake or State of Texas; and, further, W. D. Farrar agrees
to dedicate to the City of. Southlake by right-of-way deed a
fifty foot strip along the east boundary of said land for street
purposes with a reversing clause if not used s a

ZA-69-20: The request of W. R. Berk, M.D., for a change
in zoning from Agriculture to H District on his property
described as follows:
Being 32 acres of land, more or less, in the
Richard Eads Survey, Abstract No. 481, Tract
2, and the Thomas Mahan Survey, Abstract 1049, ~Y
Tracts 5 and 5C.
The recommendation from the Planning & Zoning Commission,
as read to the Council, was that the request be denied.
Councilman Brown made a motion that said request be denied;
seconded by Councilman O'Brien. Motion carried unanimously.
There being no further business, the meeting adjourned.

lake City Hall, the Commission, by majority vote, agreed I ho
to recommend to the Council that the application of Mr.
Joe Fechtel, ZA-69-21, requesting a zoning change from
Agriculture to "H" District (Heavy Commercial) and "F"
District (Light Industry) be approved on the property
described as follows:

agreed to recommend to the Council that the application
of Western Hatcheries,of Dallas, Inc., ZA-69-22, re-
questing a zoning change from Agriculture to "H"
District (Heavy Commercial) be approved on the property
described as follows:
Being approximately 77'h acres of land
out of the Richard Eads Survey, Abstract
No. 481, Tracts 3 and 3B
with the furtherrecommendation that sufficient right-
of-way be dedicated to widen Carroll Schobl Road to a
total of 100 feet (i.e., 50 feet from the owners on each
side of said road).

Fireworks Ordinance: Discussion was had regarding an ordi-
nance prohibiting the sale and shooting of fireworks in the
City of Southlake. It was pointed out that the Fire Chief,
Bob Steele, was in favor of this. No action was taken.
The City Secretary was directed to get the rates from the
two Grapevine newspapers regarding legal notices.
" The City Attorney informed the Council the Court will set
the date of trial in the McPherson matter the week of the
24th of this month; that he would meet with Keller the latter
part of the week regarding boundaries; that he would talk
with Mr. Moyer and have answers at the next meeting.
The City Secretary was instructed to call Larry Graham of
the Tarrant County Health Department regarding having some-
one from their office appear in Corporation Court in the
matter of the complaint against J. M. Woods; also, to call
Mr. Calhoun of Lone Star Gas regarding the plastic pipe
usage and then call Mrs. Elvie Carey to let her know the
Council will try to give her an answer as soon as possible.
There being no further business, the meeting was adjourned.
