Approval of Bills for Payment w 69 REGULAR MEETING OF THE CITY COUNCIL MAY 19, 1970 The City Council of the City of Southlake, Texas, met in regular session in the Council Chamber of City Hall on Tuesday, May 19, 1970, with the following members present: ' Wade Booker, Mayor Pro Tem Thurman Hearn, Councilman W. B. "Buddy" Brown, Councilman Ralph Polson, Councilman 1 Billy Joe Knox, Councilman Absent: J. L. Clow, Mayor Also present: W. D. Campbell, City Attorney ' Mayor Pro Tem Booker called the meeting to order at 7:30 P.M. The invocation was given by Rev. Robert Stith of the Carroll Road Baptist Church. 1 The minutes were approved as read. • ORDINANCE NO. 174 was read to the Council by Mayor Pro Tem ' Booker wherein certain property consisting of one ae,rd of land, more or less, out of the Leonard Lincoln Survey, Abstract No. 981, is to be annexed to the City of Southlake. Mayor Pro Tem Booker called for comments from anyone in attendance at this public hearing regarding this ordinance. There being none, Councilman Brown made the motion to adopt said Ordinance annexing the property described therein; seconded by Council- man Knox. Motion carried unanimously. (Copy attached and made a part hereof.) ORDINANCE NO. 161-12 was next introduced by Mayor Pro Tem Booker who explained that this ordinance designates the zoning ' of the property described in Ordinance No. 174 as "Ag" Agri- culture District. The motion was made by Councilman Hearn to adopt Ordinance No. 161-12 designating the zoning on an ' acre of land, more or less, in the Leonard Lincoln Survey, Abstract No. 981, owned by Robert L. Norman and wife, as "Ag" Agriculture District; seconded by Councilman Brown. Motion carried unanimously. Petitions for Annexation froi J. W. Keeling, Owen Barnett, J. R. Keeton, Jr., and H. E. Swaim were next presented to the Council. All the property described therein is located in the Christopher Dart Survey, Abstract No. 2003, and the W. N. Martin Survey, Abstract No. 1068. Motion was made,by ME— F FIR ORDINANCE NO. 171 AN ORDINANCE RECEIVING AND ANNEXING TERRI- TORY ADJACENT AND CONTIGUOUS TO THE CITY OF SOUTHLAKE, TEXAS, PROVIDING THAT SUCH AREA SHALL BECOME A PART OF SAID CITY AND THAT THE OWNERS AND INHABITANTS THEREOF SHALL BE ENTITLED TO ALL THE PRIVILEGES OF THE OTHER CITIZENS OF SAID CITY, AND BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TO BE HEREINAFTER ADOPTED: FURTHER PROVIDING FOR AMENDING AND COR- RECTING THE OFFICIAL BOUNDARIES OF SAID CITY AS HERETOFORE ADOPTED AS AMENDED AND " DESI GNAT ING THE ZONING AS "AG" AGRICULTURE DISTRICT, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the provisions of the Acts of 1953, 53rd Legislature, Page 357, Chapter 93, codified as Article 974-G, Revised Civil Statutes of Texas, Robert L. ' Norman et ux, Shirley Norman, owners of the real property hereinafter described, having made application as by law provided to the Mayor and City Council of the City of Southlake, Texas, for annexation of a tract of land situ- ' ated in Tarrant County, Texas, and being one acre, more or less, out of the Leonard Lincoln Survey, Abstract No. 981, Tract B, more fully described by metes and bounds as follows: BEGINNING at a point 855 feet South of a steel stake in the Northwest corner of a 1014 acre tract of land deeded tD Leona Tanner, said stake being 1,438.2 feet North and 2,616.1 feet West of the Southeast corner of the Leonard Lincoln Survey; THENCE North 0 degrees 3 minutes West along the East line of County Road No. 3061, 95 feet to a stake; THENCE North 89 degrees 35 minutes East 460, to a stake; THENCEjSouth 0 degrees 3 minutes East 95' to a stake; THENCE West 460 feet to the point of BEGINNING, containing one acre of land, more or less. A plat of said land showing its location with respect to the boundary of the City of Southlake, Texas, is attached hereto marked EXHIBIT "A"; And WHEREAS, it appearing to the City Council of the City of Southlake, Texas, that all statutory requirements in connection with said proposed annexation have been fulfilled 71 r and that the above described area is not more than 2 mile in widt4 that not more than three qualified voters reside thereon, and that the same is adjacent to the present city limits of the City of Southlake, Texas, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: 1. THAT, the property hereinabove described being adjacent and contiguous to the city limits of Southlake, Texas, be and is hereby annexed and brought within the Corporate Limits of said City and is hereby made an integral part thereof. r 2. THAT, the owners and inhabitants of the area herein annexed be entitled to all of the rights and privileges of other citizens and property owners of said City and be bound by all of the acts and ordinances made in conformity thereto, now in full force and effect and that which may be here- after adopted. 3• r THAT, the official map and boundaries of the City of • Southlake, Texas, as heretofore adopted and amended, be and is hereby amended so as to include the aforementioned territory as part of the City of Southlake, Texas. 4• THAT, in accordance with Section IV-4 of Ordinance No. 161, the land made the basis of this annexation proceeding is hereby zoned "Ag" Agriculture District. THIS ordinance shall become effective from and after its passage and approval. Motion carried unanimously. A public hearing on the annexation of said property was set for June 16, 1970. (Said petitions are attached hereto and made.a part hereof.) Planning & Zoning Commission recommended to the Council that the City Attorney be directed to amend Ordinance No. 161 to establish a separate district detailing regulations ' for cemeteries, crypts and mausoleums, including require- ments as to size, parking, screening, etc., and that a development plan be required. Mayor Pro Tem Booker so dir- t ected the City Attorney. Little League request was not acted upon by the Council as Mr. Al Middaugh was not present. Dove Estates presentation was made by Mr.. David Moak after which much discussion followed. A public hearing on the ' request for change in zoning from Ag District to A-2 District was set for June 16, 1970, 7:30 P.M. at City Hall. ' City Matters: Mayor Pro Tem Booker informed the Council of the NCTCO G Meeting May 27th and urged that someone attend. • Councilman Hearn suggested a letter be written to the Chair- man of the upcoming Pioneer Celebration advising of Southlake's willingness to participate. No action was taken on Louis Messina's request regarding a building permit pending further information as to which lot he had in mind and also the re- sults of the test on the roadbed made by the County. Motion to approve the bills presented for payment was made by ' Councilman Knox; seconded by Councilman Brown. Motion carried unanimously. Howard Moffat requested information on how to obtain zoning.
