REGULAR MEETING OF THE CITY COUNCIL
MAY .?5 , 1970
The City Council of the City of Southlake, Texas, met in
regular session in the Council Chamber of City Hall on
Tuesday, May 5, 1970, with the following members present:
J. L. Clow, Mayor
Wade Booker, Mayor Pro Tem
Thurman Hearn, Councilman
Ralph Polson, Councilman
Absent: W. B. Brown, Councilman
Billy Joe Knox, Councilman
' Also present: William D. Campbell, City Attorney
Mayor Clow called the meeting to order at 7:40 P.M. The
invocation was given by Rev. Gene Tyson of White's Chapel
Methodist Church.
The minutes were approved as corrected.
ORDINANCE NO. 173 was read to the Council by Mayor Clow
wherein certain property consisting of five acres, more or.
' less, owned by James Harrell, Raymond Davis and Joel Hedge,
out of the John Childress Survey, Abstract No. 254, is to
be annexed to the City of Southlake; WHEREUPON Councilman
Hearn made the motion to adopt Ordinance No. 173, annexing
said
' property to the City of Southlake; seconded by Council-
man Polson. Motion carried unanimously.
' ORDINANCE NO. 161-11 was then introduced by Mayor Clow who
informed the Council this ordinance designates the zoning
of the property described above as "H" District, Heavy Com-
mercial; WHEREUPON the motion was made by Coungilman Hearn
to adopt Ordinance No. 161-11 designating the property
described therein as being zoned "H" District, i.e., Heavy
Commercial; seconded by Councilman Booker. Motion carried

Fire Department Report was given by Fire Chief Steele (copy
' attached hereto . He further reported that the Fish Fry was
being planned, that Unit 3002 was still in the process of
being repaired, that Units 3001 and 3008 are okay, and he
requested and was given permission for space in the Police

PLANNING & ZONING COMMISSION
SOUTHLAKE, TEXAS
April 28, 1970
To the City Council of Southlake, Texas:
Re: ZA-70-2
On motion by Harold Knight, seconded by Manuel
Gonzales, the Planning & Zoning Commission recommends
that the City Council approve the request for a change
in zoning from Ag District to F District. The property
is located between SH 114 and Hood-Throop Road and is
commonly known as the "old antique shop". The owners
are Carey Lavender and Bob Taylor of Grapevine, Dr.
William Taylor of Dallas and Dr. John Clariday of
Southlake.

The purpose for said zoning request is to accommodate
an airport-related light industry, i.e., the manufac-
ture of masonry clips to be used in the construction
of the Regional Airport. The advantages for the City
to have such a business are many - employment, broaden
the tax base, etc. The location is not in keeping
with the Master Plan, however.

Councilman Booker directed the City Secretary to get bids on
insulating the upstairs portion of the building.

Planning & Zoning Commission recommendation concerning ZA 70-2
was read to the Council by Mayor Clow. (Copy attached. A
public hearing on same was set for May 22, 1970, at 7:30 P.M.
Crypts: Mr. Henry Golembiewski made a brief presentation of
the Episcopal Church's plans to build a church on certain
property in the City of Southlake under which burial crypts
' would be constructed. (The Council Chamber was filled with
interested citizens who were permitted to present their views
to the Council.) Mr. Campbell, City Attorney, advised that
our zoning ordinance would have to be amended to permit a
cemetery since there is no provision for same in it now and
that a cemetery is not legally construed as a church use.
City Matters: Motion by Councilman Hearn to permit the City
Secretary 20 gallons of gas a month for use in the course of
city business; seconded by Councilman Polson. Motion carried
16 unanimously. The City Secretary thanked the Council for their
generosity.
The City Secretary informed the Council that Mr. Jimmy Walker,
in response to a letter from the City, telephoned to say the
trailer was in the process of being sold and when sold would
be removed...' Councilman Hearn suggested that this matter be
followed up in thirty days.
The matter of a copy machine was tabled at this time.
' Motion by Councilman Hearn to approve the bills presented;
seconded by Councilman Polson. Motion carried unanimously.
Matters not on the Agenda: Chief Ince reminded the Council
five signs were needed to indicate truck routes. Motion was
made by Councilman Booker to purchase five such signs at a
cost of $3.75 each; seconded by Councilman Hearn. Motion
carried unanimously.
Dr. M. M. Vale informed the City Council that Glen Remer
is using his property for commercial purposes without proper
zoning. Mayor Clow advised that a non-conforming use, which
Mr. Remer's property has, does not permit expansion without
properzoning and that the matter would be checked into. Also,
Dr. Vale informed the Council that Reliable Transport Company
is causing oil to be washed along the road causing pollution
to the soil and stock tanks of nearby property owners, parti-

' AN ORDINANCE RECEIVING AND ANNEXING TERRITORY
ADJACENT AND CONTIGUOUS TO THE CITY OF SOUTH-
LAKE, TEXAS, PROVIDING THAT SUCH AREA SHALL
BECOME A PART OF SAID CITY AND THAT THE OWNERS
AND INHABITANTS THEREOF SHALL BE ENTITLED TO
ALL THE PRIVILEGES OF THE OTHER CITIZENS OF
' SAID CITY, AND BE BOUND BY THE-ACTS AND ORDI-
NANCES NOW IN EFFECT AND TO BE HEREINAFTER
ADOPTED; FURTHER PROVIDING FOR AMENDING AND
' CORRECTING THE OFFICIAL BOUNDARIES OF SAID
CITY AS HERETOFORE ADOPTED AS AMENDED, DESIG-
NATING THE ZONING AS "H" HEAVY COMMERCIAL
DISTRICT, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to the provisions of the Acts of 1953,
53rd Legislature, Page 357, Chapter 93, codified as Article
' 974-G, Revised Civil Statutes of Texas, James H. Harrell; Jr.,
Raymond C. Davis and Joel M. Hedge, owners of the real prop-
erty hereinafter described, having made application as by
law provided to the Mayor and City Council of the City of
' Southlake, Texas, for annexation of a 4.948 acre tract of
land situated in Tarrant County, Texas, out of the John
Childress Survey, Abstract No. 254, more fully described by
' metes and bounds as follows:
BEGINNING at a USA Corp of Engineers Monument
' #C228-2, said monument being 1,417.8 feet North
and 50.9 feet West from the Southwest corner of
the J. J. Dwight Survey, Abstract No. 455;
' THENCE South 36 degrees 08 minutes West, along
an Ely line of USA Tract #C228, 230.0 feet to
Monument #228-3;
THENCE South 46 degrees 33 minutes West 440.0
' feet to Monument #228-4;
THENCE South 2 degrees 46 minutes West 210.0
feet to a point in the North ROW of County Road
3061;
THENCE along said road North 89 degrees 08 min-
utes East 441.65 feet (to the P.T. of a curve
to the left having a radius of 50 feet);
THENCE around said curve 78.04 feet to its P.T.;
THENCE North 0 degrees 17 minutes East (along
said road) 645.05 feet to a point;
THENCE South 89 degrees 48 minutes West 50.9
feet to point of BEGINNING.
A plat of said land showing its location with respect to the
City of Southlake, Texas, is attached hereto marked EXHIBIT
"All; And
' WHEREAS, it appearing to the City Council of the City of
Southlake, Texas, that all statutory requirements in connec-
tion with said proposed annexation have been fulfilled and
that the above described area is not more than 2 mile in width,
that not more than three qualified voters reside thereon, and
that the same is adjacent to the present city limits of the
City of Southlake, Texas,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS,
THAT, the property herei nabove described being adjacent and

' contiguous to the city limits of Southl ake , Texas, be and is
hereby annexed and brought within the Corporate Limits of
said City and is hereby made an integral part thereof.

THAT, the owne m and inhabitants of the area herein annexed

citizens and property owners of said City and be bound by
all of the acts and ordinances made in conformity thereto,
now in full force and effect and that which may be here-
after adopted.

Texas, as heretofore adopted and amended, be and is hereby
amended so as to include the aforementioned territory as part
1 of the City of Southlake, Texas.

the land made the basis of this annexation proceeding is
hereby zoned "H" Heavy Commercial District.
