Approval of Bills 159 REGULAR MEETING OF THE CITY COUNCIL DECEMBER 1, 1970 The City Council of the City of Southlake, Texas, met in regular session in the Council Chamber of City Hall on Tuesday, December 1, 1970, with the following members present: J. L. Clow, Mayor Wade Booker, Mayor Pro Tem Thurman Hearn, Councilman Ralph Polson, Councilman Billy Joe Knox, Councilman Absent: Buddy Brown, Councilman Also present: William D. Campbell, City Attorney. Mayor Clow called the meeting to order at 7:30 P.M. Rev. Robert Stith gave the invocation. ZA-69-1 : Mayor Clow announced that this public hearing was for the purpose of considering the request of Alpha Develop- ment Corporation for H District zoning on property along State Highway 114 between Kimball andCarroll tSchool n Roads on the south side. Discussion followed. Councilman Booker moved that approval of said request be granted as recommended by the Planning & Zoning Commission; seconded by Councilman Knox. Motion carried unanimously. (Copy of Ordinance No. 161-22 attached hereto and made a part hereof, together with copy of Agreement and Contract pertaining to right-of-way.) Mayor Clow called for a motion to have the Council hear two items not on the Agenda, i.e., Ordinance No. 179, per- taining to signs proposed by the Texas Highway Department, and the petition of J. R. Keeton, Jr., for annexation of his property. Councilman Booker so moved; seconded by Councilman Hearn. Motion carried unanimously. U. S. Corps of Engineers Representative, Mr. Rex Boyd, appeared before the Council to inform them their attorney is prepared to present a petition spelling out the metes and bounds annexing territory to the City of Southlake as soon as such line can be established as oee%..a mutually agreed upon by the City of Grapevine and the City of Southlake. Mayor Clow thanked Mr. Boyd for coming. 160 In the absence of Chief Bob Steele, no Fire Department Report was given. or The monthly Police Department Report was turned in by Chief O Doyle Ince. (Copy attached.) No action taken on the contract proposed by Carter & Burgess ik since all the Council had not had an opportunity to study it. Discussion followed regarding the proposed ambulance ordinance. No action taken until such time as the Council has had an opportunity to study it. ORDINANCE, NO.1 79 pertaining to the Texas Highway Department traffic sign at SH 114 and Carroll School Road was adopted on motion of Councilman Knox, seconded by Councilman Booker; carried unanimously. (Copy attached and made a part hereof.) The petition of J. R. Keeton, Jr., to annex certain property owned by him in the Dart and Martin Surveys was presented to the Council. Councilman Booker moved to accept said petition; seconded by Councilman Hearn. Motion carried unanimously. A public hearing on same was set for January 5, 1971, 7:30 P.M. Councilman Booker moved that December 15, 1970, be the date for a public hearing on the proposed 1971 Budget; seconded by Councilman Knox. Councilman Booker moved to approve for payment the bills presented; seconded by Councilman Hearn. Motion carried unanimously. Councilman Booker moved to spend $200 overhauling the 167 Ford patrol car; seconded by Councilman Knox. Motion carried unanimously. Mr. Campbell advised the Council that the City of Hurst had filed its motion for hearing in the Supreme Court. Discussion followed regarding a typewriter for the Police Department. The Council asked the City Secretary to take care of the matter. There being no further business, the meeting adjourned. The State will reimburse the City for the cost of the electrical ® energy used in operating the highway traffic signal(s) as measured by means of a meter installed to serve the highway traffic signal(s), or as determined by I same method other than a meter which is.mutually acceptable to all parties j 1. concerned. The State's payment for the electrical energy shall be based on the minimum unit rate charged the City under the City's contract with the power agency supplying electrical energy to the City. In the event the electrical energy is supplied through a municipally owned electrical power generation . j system, the State's payment for the electrical energy shall be based on the j` 1 { minimum unit rate appearing in the City's commercial rate structure. f The City will forward the State two copies of its existing contract ' with the power agency for electrical energy, and thereafter as the existing ® or governing control is terminated and new contracts are executed. I i All requests for payment for electrical energy shall be properly certified and submitted by the City to the District Engineer of the State High- way Department at Fort Worth Texas. Such requests for payment shall be in accordance with forms prescribed by the State and shall be submitted j at not less than monthly intervals. The City will maintain a system of records { necessary to support and establish the eligibility of all claims for payment under the terms of this contract. The State shall have the authority to make such changes in the > 1 design and operation of the highway traffic signal(s) as it may deem necessary and advisable to promote the safe, convenient, and orderly movement of traffic. 6. The City will be responsible for the police enforcement required for securing` obedience to the highway traffic signal(s). 7.
