PERMANENT DRAINAGE EASEMENT

That I, Alan Kay Custom Homes, GRANTOR herein, for and in consideration of
the sum of Ten ($10.00) Dollars and other good and valuable consideration in
hand paid by the CITY OF SOUTHLAKE, home rule municipal corporation of
the County of Tarrant, State of Texas, GRANTEE herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, do hereby grant, sell
and convey unto the said GRANTEE a permanent and perpetual easement for the
purpose of installing, repairing, maintaining, altering, replacing, relocating,
rebuilding, removing, and operating drainage facilities in, into, upon, over, across,
under and through all that land in Tarrant County Texas described as follows, to-
wit:
A variable width Permanent Drainage Easement containing approximately
0.108 acres within the Francis Throop Survey, Abstract No. 1511, with
property addresses of 1363 and 1333 E. Dove Road, and as more
particularly described in Exhibit "A", and shown on Exhibit "B" attached
hereto and incorporated herein.
together with the right of ingress and egress as necessary for such purposes.
GRANTOR covenants and agrees that GRANTOR and GRANTOR's heirs,
representatives, successors and assigns shall at no time erect, place or construct,
or cause to be erected, placed or constructed in, into, upon, over, across or under
any easements granted herein any temporary or permanent structures, and it is
further agreed that GRANTEE shall have the right to excavate and fill upon said
permanent easement and to remove from said permanent easement, any fences,
buildings or other obstructions as may now be found upon said permanent
easement.
It is further intended that the Permanent Drainage Easement herein granted to the
GRANTEE shall run with the land and forever be a right in and to the land
belonging to GRANTOR, and GRANTOR'S successors and assigns, and said
grant is expressly excepted from any right of reversion of said premises under any
prior deeds in GRANTOR's chain of title. The Permanent Drainage Easement,
rights and privileges granted therein are exclusive, and GRANTOR covenants that
it will not convey any other easement or conflicting rights within the area covered
by the grant to any other person.

Being a 0 108 of an acre tract of land situated within the Francis Throop Survey,
Abstract No. 1511, and being a portion of a called 1.5 acre tract of land described to
Alan Kay Custom Homes, LLC by deed recorded in Instrument No. D206204116 and a
portion of a called 1 acre tract of land described to Alan Kay Custom Homes, LLC by
deed recorded in Instrument No. D206333115, Deed Records, Tarrant County, Texas,
and being more particularly described by metes and bounds as follows
BEGINNING at the northwest comer of said 1.5 acre tract, from which a 3/8 inch iron
rod found for the northeast corner of a tract of land described to Marjorie Thomas White,
by deed recorded in Volume 11505, Page 2038, of said Deed Records, bears South
01 °56'47" West, 5.95 feet, same being on the south right-of-way line of East Dove Road
(a variable width right-of-way);
THENCE South 89°57'24" East, with the north line of said 1.5 acre tract, a distance of
137.19 feet to a point for the north common corner of said 1.5 acre and 1 acre tracts,
from which a 1/2 inch iron rod bears South 01°56'47" West, 16 14 feet;
THENCE South 89°58'43" East, with the north line of said 1 acre tract, a distance of
91.42 feet to a point for the northeast corner of same;
THENCE South 01 °56'35" West, with the east line of said 1 acre tract, a distance of
45.51 feet to a point, from which a 5/8 inch capped iron rod stamped "LBS 3946" bears
South 01 °56'35" West, 433.59 feet;
THENCE over and across said 1 acre and 1.5 acre tracts the following courses and
distances,
North 71 °35'28" West, a distance of 7.03 feet to the beginning of a curve to
the left, having a radius of 670.00 feet, and a chord that bears North
80°48'23" West, 214 59 feet;
Along said curve to the left, an arc length of 215.52 feet;
South 89°58'42" West, a distance of 8 87 feet to a point on the west line of
said 1.5 acre tract;
THENCE North 01 °56'47" East, with said west line, a distance of 9.13 feet to the POINT
