REGULAR MEETING OF THE CITY COUNCIL
OF SOUTHLAKE, TEXAS
September 21, 1971
The City Council met in regular session Tuesday, September
21, 1971, in the Council Chamber of City Hall with the follow-
ing members present:
Wade Booker, Mayor
Ralph Polson, Mayor Pro Tem
Billy Joe Knox, Councilman
W. 0. Nunn, Councilman
R. D. Drummond, Councilman
Absent: Thurman Hearn, Councilman
Also present: William D. Campbell, City Attorney.
Mayur Bouxer cal ied the meeting to order at 7:30 P.M.
Rev. Mike Stovall gave the invocation.
Minutes of the last special meeting held September 11, 1971,
were approved as reau.
The Highway Report was given by Roger Baird. He recommended
that the City of Southlake have a Transportation Committee
appointed to keep abreast of highway developments planned for
our City. The Mayor commended him for the fine report.
Resolution No. 71-19, calling for an annual audit to be made
by R. W. Mussina, C.P.A., was passed on motion by Councilman
Polson; seconded by Councilman Knox. (Attached hereto and made
a part hereof.) Motion carried uanimously.
Ordinance No. 158-C, approving the Budget for January 1, 1972,
througn Setpember 30, 1971,, was passed on motion by Councilman
Knox; seconded by Councilman Nunn. Motion carried unanimously.

Ordinance No. 158-1~, levying taxes for the use and support of
the municipal government for the year 1971, was passed and
approved on motion by Councilman Polson; seconded by Councilman
Nunn. Motion carried unanimously. (Copy attached and made a
part hereof.)
Ordinance No. 147-A, changing the date of the tax levy and date
of payment, was passed and approved on motion by Councilman Knox;,
seconded by Councilman Polson. Motion carried unanimously.

The bills presented were approved for payment on motion by
Councilman Knox; seconded by Councilman Nunn. Motion '
carried unanimsouly.
Work Authorization #2 from Carter & Bur§ess, Inc., for the
total engineering re Well No. 2, the 12 main and the ele-
vated storage tank was presented. The Mayor was authorized r
to sign same on behalf of the City of Southlake on motion I
by Councilman Knox; seconded by Councilman Drummond. Motion
carried unanimously. or
The Council was informed that Mr. Bourland of Tarrant County t
has advised W. E.,Tucker uy letter that the street put in by
Mr. Tucker orf Sunshine Lane meets County approval. IF
The Sanguinet matter was next discussed. Mayor Booker ad-
vised he woulcL call Mr. Sanguinet to inform nim ne nas two
weexs to remove the house trailer from his premises which Yw
is there in violation of City Ordinance No. 161. The two
week limit was set up on Motion by Councilman Knox; seconded
by Councilman Polson. Motion carried unanimously. If the
Mayor cannot reach Mr. Sanginet by phone, the City secretary
is to se.na a letter advising him of the Council's action.
There being no further business, the meeting adjourned.

of Southlake to have an audit of the
City's financial affairs annually; Now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE., TEXAS, THAT:

The City Council of the City of Southlake does hereby
authorize the Mayor to employ R. W. Mussina, Certified
Public Accountant, to prepare such audit for presenta-
tion to the Council following the close of said current
fiscal year.

AN ORDINANCE APPROVING THE BUDGET SUBMITTED
BY THE MAYOR OF THE CITY OF SOUTHLAKE,TEXAS
FOR THE PERIOD OF JANUARY 1,1972 THROUGH
SEPTEMBER 30, 1972.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS:
SECTION 1. That the Budget prepared by the Mayor of the City
of South ake, Texas, for the City of Southlake for the year
commencing January 1, 1972 through September 30, 1972, is,
hereby approved and ordered filed with the City Secretary of
the City of Southlake, Texas.
SECTION '2. The City Secretary is hereby ordered. to file a
copy of said Budget with.'the'County Clerk of Tarrant County
at Fort Worth, Texas,,and with the Comptroller of Public
Accounts at Austin, Texas.

ORDINANCE NO. 158-4
AN ORDINANCE LEVYING TAXES FOR THE USE AND
SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE
CITY OF SOUTHLAKE, TEXAS, FOR THE YEAR 1971;
PROVIDING FOR THE TIME AND MANNER OF PAYING
THE AD VALOREM TAXES LEVIED: AND PROVIDING
FOR A PENALTY IF SAID TAXES ARE PAID AFTER
BECOMING DELINQUENT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS:
SECTION 1. That there is hereby levied and there shall be
collected for the use and support of the municipal government
of the City of Southlake, Texas, for the year Nineteen Hundred
Seventy One (1971) upon all property, real, personal and mixed
within the corporate limits of said City subject to taxation,
a tax of fifty cents (50) on each one hundred dollars ($100)
valuation of.property, said tax being so levied and apportioned
' to the specific purposes herein set forth in Exhibit "A" attached
hereto and made a part hereof, for the maintenance and support of
the general government and for the operation of the City Govern-
ment to be placed in the General Fund, 100% of the total amount rec4`_
eived, being 50¢ on each one hundred dollars ($100) valuation
of property.
SECTION 2. All monies collected under this ordinance for the
specific items set out in Exhibit "A" be and the same are hereby
appropriated and set apart for the specific purpose indicated in
each item and that the Collector of Taxes, the City Treasurers and
the Finance Officer shall keep these accounts so as to readily and
j distinctly show the amount collected, the amounts expended and the
amount on hand at any time belonging to such funds, it is hereby
made the duty of the Tax Collector and every such person collecting
money for the City of Southlake to deliver to the Finance Officer
and the City Treasurer at the time of depositing any monies, a
statement showing to what fund such deposit should be made and from
what source received. All receipts for the City not specifically
apportioned by this Ordinance are hereby payable to the General
Fund of the City.

SECTION 3.
A. it said taxes are paid one-half (1/2). on or before
November 30, 1971, then the taxpayer shall have until and '
including the 30th day of the succeeding June within which
to pay the other one-half (1/2) of said taxes without
penalty or interest.
B. If said taxpayer, after paying said one-half (1/2)
of his taxes on or before November 30, 1971, shall fail or
refuse to pay, on or before June 30th next succeeding said
November, the other one-half (1/2) of said taxes, a penalty '
of 8% of the amount of said unpaid taxes shall accrue thereon.

the following penalty shall be payable thereon, to-wit:

During the month of June, five percent (5%); and on and after
the first day of July, eight percent (8%).
D. As provided above, in the event such taxes become
delinquent, the same shall bear interest &the rate of 6% per
annum from the date of their delinquency. j'
SECTION '4'. The taxes herein levied shall be a first and prior
lien against the property upon which they are assessed and the.
said first lien shall be superior and prior to all other liens, '
i charges and encumbrances, and this lien shall attach to personal
property to the same extent and with the same priorities as to
real estate. '
SECTION 5. The liens provided herein shall attach as of
January 1,,1971.
SECTION 6. Should any part of this ordinance be declared
invalid, or any reason, that invalidity shall not effect the
remainder of this ordinance,. which remainder shall continue in
full force and effect.

Gentlemen:
This Budget is prepared and submitted in conformance '
with the Revised Civil Statutes of Texas. It is for
the City of Southlake, Texas, and for the fiscal year
of January 1, 1972, through September 30, 1972. This
is in accordance with the change of our fiscal year
from January 1st through December 31st of each year
to October 1st through September 30th. While the fig- ,
ures are set up on a twelve month basis, they are in
fact for a nine month period.
For the past two years, the City has been faced with '
a shortage of funds which in turn has caused a shortage
of capable personnel. It was evident to me that if the
people of Southlake were to be served properly, we would '
need more funds with which to provide proper fire and
police protection and administer the City's business.
Also, the City's pay scale should and must be upgraded ,
and some fringe benefits provided in the name of social
justice. Therefore, you will note in this Budget, for
the first time, hospitalization will be paid for those
employees requesting it. Though small, it is a step in '
the right direction. For these reasons, I am requesting
a small increase in the tax rate from 35G to 50(~ on the
$100, fifty per cent of fair market value. This slight '
increase will do much in alleviating some of the pressure.

Paragraph 1 of Ordinance 147 of the City of Southlake, Texas is
hereby amended by substituting they following paragraph 1 in lieu thereof:

At the first regular meeting of the City Council in September of
each year beginning in 1972 or as soon theraefiter as practicable in each
year,, the City Council shall, by ordinance.. Ion an ad valorem tax for
the current year on all real and personal property in the City of Southlake
on the first day of January of such current year and against the owners
thereof, for the purposes of paying the current operating expenses of the city, the construction or purchase of public buildings p water works, sewers
and other permanent improvements, within: the limits of such city, and for
the construction and improvement of the reads, bridges and streets within
the limits of said City, and for interests and sinking fund on new and
outstanding in8eebtedrAss and may levy any special tax authorised by law
for any lawful purpose at any time, said levy shall not etx+ceed one and
one-half percent (1-1/2) on the One Hundred Dollars ($100.00) Valuation
of taxable property situated within the City of Southlake, Texas."
Paragraph 2 of ordinance 147 of the City of Southlake, Texas is hereby
amended by substituting the following paragraph 2 in lieu thereof:

The annual levy made by the City Council shall constitute a special
lien: on all property taxable by law, real and personal, in the City of
Southlaka on the first day of January of each current year beginning with.
this year of 1971, and all such property shall stand charged with a lion
in favor of than city, superior to all other liens except 'Federal and
State taxes to seem the payment of such taxes, together with such
penalties and interest and other costs as provided in the applicable laws
of the State of Texas from time to time. Provided that a homestead shall be liable only for the taxes, penalties, interest and costs assessed
agaist it.*
Paragraph 14 of Ordinance 147 of the City of Southlake, Texas is
hereby amended by substituting the fallowing paragraph 14 in lieu thereof:
"14.

All city taxes levied and assessed may be paid at any time after
completion of rolls but shall be paid before the first day of February of

Ordinance 147 as originally passed, except for amendment by this said
ordina r d any other later ordinances of the City of Southlake, Texas a
shall remain in full force and effect.
