Approval of Bills 88 CITY OF SOUTHLAKE, TEXAS REGULAR MEETING OF THE CITY COUNCIL JUNE 6, 1972 The City Council of the City of Southlake met in regular session in the Council Chamber of City Hall in Southlake, Texas, on Tues- day, June 6, 1972, with the following members present: Wade Booker, Mayor Ralph Polson, Mayor Pro Tem Billy Joe Knox, Councilman Frank Tetrault, Councilman Absent: W. O. Nunn, Councilman R. D. Drummond, Councilman Also present: William D. Campbell, City Attorney The meeting was called to order by Mayor Booker at 7:35 P.M. The invocation was given by Councilman Polson. The minutes of the last regular meeting were approved as read. Solid Waste Franchise Proposal present c~ y Mr. Hall was tabled e r all the Counciliresent. 1.9-a t3ante Mayor Booker thanked Mr. and Mrs. Hall for appearing. Hilltop Acres representative for the Messina Brothers failed to appear. Mr. Bart Bradford of Carter & Burgess, Inc., was requested to write them a letter advising them to enter into a Community Facilities Agreement with the City whereupon the plat could be given final approval and then filed. Police Department report was given by Chief Doug Hughes (attached hereto) an he a so reported on repairs made on the patrol cars as well as on the seminar he attended at the Regional Police Academy. The Council gave him permission to join the Texas Narcotics Officers Association having annual dues of $10 on motion by Councilman KikQx seconded by Councilman Polson. Motion carried unanimously. Open Space Program was next discussed and the City's need for out- door recreational facilities. Mr. Bradford will present some cost figures to the Council in order that they may incorporate them in the 1973 Budget. ZA 72 5;•.had its public hearing set for July 18th, 1972, 7:30 P.M. Q Southlake Estates Community Facilities Agreement was approved and moo 89 i signed by the Mayor on motion by Councilman Polson; seconded by Councilman C- Knox. Motion carried unanimously. [Copy attached.] Theft Guard Program was explained by Councilman Tetrault. It was move by Councilman Polson that the Police Department pur- chase 100 window stickers at a cost of $10 to be sold for ~9t each; seconded by Councilman Knox. Motion carried unanimously. Councilman Polson moved to appoint Councilman Tetrault to the County Library Study Committee; seconded by Councilman Knox. Motion carried unanimously. Councilman Knox moved to Approve the bills presented for payment; seconded by Councilman Tetrault. Motion carried unanimously. Mayor Booker informed the Council that there will be no regular council meeting July 4th, a national holiday. The City Secretary was directed to send a letter to Mr. Don Wilson regarding the need for additional water taps on his property. There being no furtherbusiness the meeting adjourned. Gentlemen: is It is recommended that the City of Southlake enter into a Community Facilities I Agreement with the owners of the Hilltop Acres Addition to assure the adequacy l of the community facilities. Such an agreement would be similar to that of the Southlake or Dove Estates and would contain the following points: 1. 6-Inch water line be extended from Dove Road to the perimeter of the addition. In such a case the city would have a certain obligation as well as the developers f 2.4-Inch water mains installed in the interior of the addition. f i 3. All streets would be paved under the same criteria as the Southlake i Estates. ' 4. At least two 6" fire hydrants would be installed within the close proximity to the area to assure adequate fire protection. 5. Street signs meeting the City of Southlake's criteria. _6. Street lights located at the proper intervals would be installed. Ifthe City Council concurs in the recommendation that the Community Facilities Agreement should be entered into, our office in coordination with the City Secretary, would prepare the proper documents and submit them to the owners of the property as well as the city for their signatures. M. Gordon, seconded by Gail Hargadine and passed that the zoning application of Howard Thrasher be approved requesting a change in zoning from Ag District to L District on land described by metes and bounds.in ZA-72-5, consisting of two acres, more or less. Love-Henry $ Associates, Inc., the Developer, hereby agrees to install water facilities to serve the lots as shown on the attached Exhibit "A", all in accordance with plans and specifi- cations to be prepared by the Developer's engineer and approved by the City. Further, Love-Henry $ Associates, Inc., agrees to complete this installation, at its own cost and in accordance with.Ordinance No. 170, within five years from the date of the signing, by both parties; of this agreement. Prior to commencing work the Contractor to whom the Developer awards the contract for such work shall furnish a maintenance bond in favor of the City of Southlake covering the facility to be constructed against defects in materials and/or workman- ship for a period of one year after completion of the facility ' and its acceptance by the City. The Contractor may, at his option, post a "blanket maintenance bond" in the amount of. Ten Thousand ($10,000.00) Dollars in favor of the City covering all water facilities constructed by his in the City against defects ' in materials and/or workmanship for a period of one year after acceptance by the City. The Contractor shall also furnish to the City a performance bond and payment bond in an amount equal to one hundred per cent (100%) of the contract price, conditioned upon the faithful performance of the contract and upon payment of all persons supplying labor or furnishing materials to the project. ' B. The City of Southlake hereby agrees to issue two building permits for said lots upon the signing, by both parties, oflithis agreement. ' C. It is further agreed and understood that the.Developer shall be responsible for all construction cost, materials and engineering, and that upon completion and acceptance the City shall own, ' operate and maintain the said water facility, subject to the applicable maintenance agreement and bonds in connection therewith. D. It is further agreed and understood that all supply mains and ' distribution mains installed within a developer's platted and filed area of development must extend to the borders of its development as required for future extension of the City's ' system regardless of whether or not such extensions are required for service within the area of development. 1. ■ 9 3` II. STREETS AND DRAINAGE: Fes, A. Love-Henry & Associates, Inc., hereby agrees to construct streets including gutter and drainage facilities to the lots as shown on the attached Exhibit "B", all in accordance with the plans and specifications to prepared by the Developer's engineers and approved by the City. Further, Love-Henry $ Associates, Inc., agrees to complete this construction at its own cost, within five years from the date of the signing, by both parties, of this agreement. Love-Henry $ Associates, Inc., agrees: 1. Fkva;=(S) street lights will be installed by the Developer, as shown on Exhibit "B", with Developer responsible for electricity costs until acceptance by the City. 2. No construction will begin on the subgrade treatments, pavement or Sumer within the limits of any street included herein, and as shown on Exhibit "B", prior to the installation of all underground utilities, including service lines. 3. All utility lines will be placed underground. 4. No work will begin on any street included herein.prior to the paving contractor's execution and delivery of a one year ' maintenance bond to the City of Southlake for the.repairing and/or reconstruction in whole or in part of said streets. The surety will be a surety company duly authorized to do business in the State of Texas and acceptable to the City ' Council. The Contractor shall also furnish to the City a performance bond and payment bond in an amount equal to one hundred (1000 per cent of the contract price, conditioned ' upon the faithful performance of the contract and upon payment of all persons supplying labor or furnishing materials to the project. The Contractor shall furnish to the City satisfactory ' carriage of insurance in accordance with the City's standard requirements of contractors doing work for the City. S. It is agreed and understood by the parties hereto that the Developer shall employ a civil engineer, licensed to practice in the State of Texas, for the design and preparation of plans and specifications for the construction of all facilities covered by this agreement. B. It is further agreed and understood by the parties hereto that upon acceptance by the City, title to all facilities and improvements mentioned hereinabove shall be vested at all times.in the City of Southlake, and Developer hereby relinquishes any right, title,,or interest in and to said.facilities or any part thereof. C. On all facilities included in this agreement for which the Developer awards his own construction contract, the Developer agrees to follow the following procedures: 1. To employ a construction contractor who is approved by the City and who is qualified in all respects to bid on public projects of similar nature. 2. To require the Contractor to furnish to the City payment, performance and.aaImsenam0e bonds in the name of the City for one hundred (100%) per cent of the contract price pf the facility, said bonds to be furnished before work is co'mended. ' 3. To secure approval by the City of any and all partial and final payments to, the Contractor, said approval is made, in accordance ' with requirements of this agreement, and is not to constitute approval of the quantities on which payment is based. 4. To delay connections of buildings to service lines of water ' mains constructed under this contract until said water mains and service lines have been completed to the satisfaction of the City. IV. SEWERS: ' It is understood and agreed that sewer facilities shall be constructed in such a manner as to comply with all the following minimum require- ments: Health Department requirements, Tarrant County, Texas; State Department of Health, State of Texas Requirements, Texas Water Quality ' Board regulations, State of Texas, and any applicable City ordinances concerning sewer facilities. 3. 4s.;»A The attached Exhibits A and B are made a part hereof for all intents and purposes.
