Report on Proposed Metal Structures Mini- System - Delores Quinn. 146 CITY OF SOUTHLAKE, TEXAS REGULAR MEETING OF THE CITY COUNCIL n SEPTEMBER 18,1973 The City Council of the City of Southlake met in regular session in the Council Chamber of City Hall in Southlake, Texas, on Tues- day, September 18, 1973, with the following members present: Wade Booker, Mayor Billy Joe Knox, Mayor Pro Tem W. 0. Nunn, Councilman Frank Tetrault, Councilman Sam Davis, Councilman Absent: R. D. Drummond, Councilman Also present: William D. Campbell, City Attorney. Mayor Booker called the meeting to order at 7:30 P.M. The invoca- tion was given by Councilman Nunn. The minutes of the last regular meeting were approved as corrected. The Mayor asked Planning & Zoning Commission Member Llold Wolf if he like to give his report first on the seminar on planning that he attended in Austin. Several good points were made, i.e., if Com- mission members keep failing to show up, appoint new ones who are move interested; talk up planning and zoning to get citizens more interested; require planning and zoning commission members who cast negative votes state for the record their reason for so voting. The Mayor thanked Mr. Wolf for the good veport. Mayor Booker next introduced Mr. Cliff Davidson of the Tarrant County Planning Department. Mr. Davidson spoke to the Council about a planned soil survey for Tarrant County and showed slides depicting the uses of such a survey. He informed the Council that local par- ticipation is being sought to pay for the work and spoke of how Southlake could benefit from it. Mssrs. Howard McDaniel and Dick Coffee of the U.S. Soil Conservation Service appeared with Mr. David- son and joined in the discussion that followed. The Council was assured by Mr. Davidson that priorities would definitely be estab- lished in the northeast part of Tarrant County. Councilman Nunn then moved that the City of Southlake go on record as being inter- ested in such a survey and that a letter expressing such interest be directed to Jodge Howard Green of the Tarrant County Commissioners Court with a copy of it to Commissioner Dick Lewis and the Tarrant County Planning Department; seconded by Councilman Knox. Motion passed unanimously. 147 Mayor Booker thanked the men for coming out. t ORDINANCE NO. 199, annexing property owned by John Love, Trustee, in the o i.ngsworth & Barnett Survey, Abstract No. 797, contain- ing approximately 133 acres of land, more or less, described by metes and bounds therein, was passed and approved on motion by Councilman Nunn; seconded by Councilman Knox. Motion passed un- animously. (Ord. No. 199 attached hereto and made a part hereof.) Resolution No. 73-23, calling for approval of partial Payment No. 3 to Chicago Bridge & Iron was passed and approved on motion by Councilman Knox; seconded by Councilman Tetrault. Motion passed unanimously. (Said Resolution being attached hereto and made a part hereof.) Resolution No. 73-24, calling for payment to Carter & Burgess, Inc., the City's consultant engineering firm, of Project Authorization No. 2, dated September 21, 1971, involving the 12" main and over- head water tank construction, was passed and approved on motion by Councilman Knox; seconded by Councilman Nunn. Motion passed un- animously. (Said Resolution being attached hereto and made a part hereof.) Resolution No. 73-25, calling for appointment of M. E. Whiteside as Tax ASsessor or the City of Southlake, was passed and approved on motion by Councilman Nunn; seconded by Councilman Knox. Motion passed unanimously. Resolution No. 73-26 calling forccancellation of certain tax items because o errors, was passed and approved on motion by Councilman Tetrault; seconded by Councilman Knox. Motion passed unanimously. (Said Resolution attached hereto and made a part hereof.) Ordinance No. 200, adopting the 1973-74 Budget, was passed, approved and adopted on motion by Councilman Knox; seconded by Councilman Nunn. Ordinance No. 201, le*ng a tax for the use and support of the municipal government of the City of Southlake, was passed and approved on motion by Councilman Davis; seconded by Councilman Nunn. Motion passed unanimously. (Ordinance No. 201 attached hereto and made a part hereof.) I Councilman Davis moved that the bills presented be approved for payment; seconded by Councilman Tetrault. Motion passed unanimously. I Mrs. Delores Quinn reported on the meeting in Duncanville at the Texas Water Quality Board regarding the proposed mini-sewage system I of Metal Structures Corporation. Following discussion, the Mayor thanked her for the report and requested that she attend any future Council Mtg. 9/18/73. Page 2 148 40 hearings. Mayor Booker informed the Council of a county-wide police com- munications system going into effect after the first of the year. Councilman Knox suggested a closer look at the requirements be- fore any money is spent. The City Attorney advised the Council of the progress made in entering a judgment in the Southlake/Grapevine boundary matter. Some discussion followed pertaining to the proposed amending to Ordinance No. 161 regulating alcoholic beverages. There being no further business, the meeting adjourned. Mayor ATTEST. Mayor ATTEST cl fty Secretary X55 RESOLUTION NO. 73-25 WHEREAS, the City of Southlake is em- powered under the Revised Civil Statutes of the State of Texas to levy taxes for the use and support of the Municipal Government; And WHEREAS7 such taxes are to be levied on a fair and equitable basis; And WHEREAS, the City Council of the City of Southlake needs to employ the professional services of a qualified tax assessor for the purpose of determining property values for tax purposes; Now THEREFORE,,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: 1. The City Council of the City of Southlake does hereby authorize the employment of M. E. Whiteside, a qualified Tax Assessor, to assess property values for the 1974 Tax Roll. 2. PASSED AND APPROVED this the 18th day of September 1973, ATTEST: MAYOR Cit Secretarv 157 ORDINANCE NO. 200 AN ORDINANCE APPROVING AND ADOPTING A BUDGET FOR THE CITY OF SOUTHLAKE, TEXAS, FOR THE FISCAL YEAR BEGINNING OCTOBER 11 1973, AND ENDING SEPTEMBER 30, 1974, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTH- LAKE, TARRANT COUNTY, TEXAS: THAT, the Mayor of said City has heretofore duly and timely filed, in accordance with the law, a budget for said City covering the fiscal year running from October 1, 1973, to September 30, 1974, that due and timely public notice that a public hearing on such budget would be held on August 21, 1973, was given and made in accordance with the law and within the time limits set forth by law; that such public hearing-was held in accordance with the law on August 21, 1973; and that it was the opinion and judgment of the City Council that such bud- get which is attached hereto be, and same is hereby, in all things approved and that same is proper and correct. WHEREFORE, said budget is here and now and hereby in all things approved and adopted, and it shall be effective as of October 1, 1973. This ordinance is hereby declared to be an emergency measure which shall have and take effect from and after its present reading for the reasons that the fiscal year commences October 1, 1973, and fixing the rate and levy of taxes for the year 1973 must be had prior to October 1, 1973, and after approval and adoption of this budget; it is for the immediate preservation of public property and business, and provides for the daily oper- ation of all municipal departments and lays a predicate for the appropriation of money to defray current and other expenses. Drummond, Councilman Frank Tetrault, Councilman Sam Davis, Councilman September 18, 1973 To the Honorable City Council and Citizens of Southlake: In accordance with the prescribed laws regulating the expenditures of the people's funds, I submit the 1973-74 Bum for adoption. The rise in expenditures is appropriately tied to the rise in our City's growth-and the increasing demands put upon municipal services. But also included in this rise is a reflection of our national economy wherein • inflation has cowed operating costs to jump upward. Because of this, new services are not seen in this Budget,although some expansion of exist- ing services, i.e., the Police Department, is to be noted. A line item, new for us, entitled "Reserve for Continengies" is for absorbing further cost increases. Should a check in rising prices occur, it is hoped this item can be used for employing an additional police officer which I feel will be necessitated by outside factors such as an influx of people from the Regional Airport, as well as the sale of alcoholic beverages in near- by areas. Because of ruing land values and an equalization of tax appraisals, no increase in the tax rate will be needed to cover the cost of this Budget even though this Budget is greater than last year's Budget by almost $26,500. Therefore, the tax rate will remain 50~ on the $100 valuation. Hopefully, next year a Citizens Goals Committee will point the way to new services our people want and are willing to pay for. In the meantime, this Budget will serve the City's current needs. THAT there is hereby levied and there shall be collected for the use and support of the municipal government of the City of Southlake, and to provide Interest and Sinking Fund for the year Nineteen Hundred and Seventy-tie upon all property, real, personal and mixed, within the corporate limits of said City subject to tax- ation, a tax of Fifty Cents (500) on each One Hundred Dollars ($100) valuation of property, said tax being so levied and apportioned to the specific purposes here set forth: 1. For the maintenance and support of the general government (General Fund), twenty-nine cents (290) on each One Hundred Dollar ($100) valuation of property; 2. For the interest and sinking fund of the 1972 General Obligation Bonds, twenty-one cents (210) on each One Hundred Dollar ($100) valuation of property. Section 2. All monies collected under this ordinance for the specs i.c items therein named, be and the same are hereby appropri- ated and set apart for the specific purpose indicated in each item and that the Assessor and Collector of Taxes, the City Treasurer and the City Secretary shall keep these accounts so as to readily and distinctly show the amount collected, the amounts expended and the amount on hand at any time, belonging to such funds; it is here- by made the duty of the Tax Assessor and Collector of Taxes and every person collecting money for the City of Southlake, to deliver to the City Treasurer and the City Secretary at the time of deposit- ing any monies a statement showing to what fund such deposit should be made and from what source received. All receipts for the City not specifically apportioned by this ordinance are hereby made pay- able to the General Fund of the City. Section 3.
