1973-04-09 69 CITY OF SOUTHLAKE, TEXAS SPECIAL MEETING OF THE CITY COUNCIL APRIL 9, 1973 The City Council of the City of Southlake met in special session in the City Secretary's office in City Hall, Southlake, Texas, on Monday, April 9, 1973, with the following members present: Wade Booker, Mayor Billy Joe Knox, Mayor Pro Tem W. 0. Nunn, Councilman Frank Tetrault, Councilman Absent: R. D. Drummond, Councilman J. A. Perez, Councilman Mayor Booker called the meeting to order at 7:30 P.M. The reading of the minutes of the last regular meeting wasp tabled to the next regular meeting. Mayor Booker advised the Council that this special meeting was for the purpose of canvassing the results of the Regular Municippl El- ection held April 7, 1973, in the City of Southlake. He further advised there were two sets of returns, one for the results of the ® election for city officers and one for the results of the proposi- tions regarding the city sales and use tax. Councilman Nunn moved that Resolution No. 73-9 be passed and approved wherein the winners of said election were declared to be Wade Booker for Mayor, W. 0. Nunn for Councilman Place 1, R. D. Drummond,for Councilman Place 2 and Sam Davis for Councilman Place 3; seconded by Councilman Knox. Motion carried unanimously. Councilman Tetrault moved that Resolu- tion No. 73-10 be passed and approved wherein the majority o? Me votes cast was for the city sales and use tax; seconded by Council- man Knox. Motion carried unanimously. (Resolutions attached hereto and made a part hereof.) Mayor Booker stated that there were seventeen various write-ins receiving one or two votes which caused the vote tabulation to be delayed an extra hour. The opinion was expressed that hopefully the voters will refrain from this practice. There being no further business, the meeting adjo rned. ' The above canvass be and the same is hereby in all things approved. 1 2. Wade Booker be and is hereby declared to have been elected to ' the office of Mayor to serve until April, 1975; W. O. "Bill" Nunn be and is hereby declared to have been elected to the office of City Councilman Place One to serve until April, 1975; ' R. D. "Dick" Drummond be and is hereby declared to have been elected to the office of City Councilman Place Two to serve until April, 1975; and Sam Davis be and is hereby declared to ' have been elected to the office of City Councilman Place Three to serve until April, 1974. APPROVED: Mayor t ATTEST: ' City Secretary I 1 2. 1 p 72 1 1 RESOLUTION NO. 73-10 RESOLUTION AND ORDER CANVASSING RETURNS AND DECLARING RESULTS OF REGULAR ELECTION HELD ' IN THE CITY OF SOUTHLAKE, TEXAS, ON APRIL 7, 1973, WHICH INCLUDED THE QUESTION OF ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX 1 WITHIN SAID CITY. WHEREAS, there was held in the City of Southlake, Texas, on the 7th day of April, 1973, an election for city officers ' and at which there were submitted to the duly qualified resi- dent electors of said'City, for their action thereupon, the following propositions: ' FOR adoption of a one percent tax within the city. (1%) local sales and use AGAINST adoption of a one percent (1%) local sales use tax within the city. and And; f WHEREAS, there were cast at said election 379 votes, of 1 which number there were cast: FOR adoption of a one percent (1t) local sales i and use tax within the city. i ' 233 votes AGAINST adoption of a one percent (1%) local sales and use tax within the city. 103 votes 1 Majority FOR adoption of a one percent local sales and use tax within thecity. lg) ' 130 votes I as shown in the official election returns heretofore lawfully submitted to the City Council of the City of Southlake, Texas, and filed with the City Secretary of said City; And 1 WHEREAS, only duly qualified resident electors of said City voted at said election, and said election was called and held in I ' strict conformity with the laws of the State of Texas, Now therefore BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF I ' SOUTHLAKE, TEXAS: Section 1. That the election described in the preamble to this ' resolution and order was duly called and notice thereof given in with law; that said election was held in the manner required by I . 1. 7 ' law; that only duly qualified resident electors of the City of Southlake, Texas, voted at said election; that due returns of said election have been made by the proper officers; that said ' election resulted favorably to the proposition: FOR ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX WITHIN THE CITY; and that a majority of the qualified voters of said City of Southlake, ' Texas, voting at said election, have voted in favor of approving and adopting a One Percent (11) Local Sales and Use Tax within said City. Section 2. That the City Council of the City of Southlake, Texas, hereby officially and affirmatively declares that said One Percent (1%) Local Sales and Use Tax *ithin said City has been properly ' and lawfully adopted in accordance with the provisions of Article 1066c, Vernon's Texas Civil Statutes (Acts 1967, 60th Legislature, Regular Session, Chapter 36, Page 62). ' Section 3. That the City Secretary is hereby authorized an directed to transmit to the Comptroller of Public Accounts of the State of Texas, in Austin, Texas, by United States Registered ' Mail, or by United States Certified Mail, a certified copy of this Resolution and Order Cw the Returns of Regular Elec- tion, under the official seal of the City of Southlake, Texas, showing the approval of said Local Sales and Use Tax by the qualified voters of said City, together with a map of said City, clearly showing the boundaries thereof as of the date of said t election.
