City Secretary r 1 142 CITY OF'SOUTHLAKE REGULAR MEETING OF THE CITY COUNCIL AUGUST 19, 1975 The City Council of the City of Southlake, Texas, met in regu- lar session in the Council Chamber of City Hall, at 667 North Carroll Avenue in Southlake on Tuesday, August 19, 1975, with the following members present: Wade Booker, Mayor Sam Davis, Mayor Pro Tem W. 0. Nunn, Councilman James Winfrey, Councilman ' Ben H. Berry, Councilman Absent: Billy Joe Knox, Councilman Staff members present: William D. Campbell, City Attorney Douglas R. Hughes, Police Chief ® R. P. Steele, Fire Chief Also present: Vernon Henderson, Lone Star Gas. Mayor Booker called the meeting to order at 7:30 P.M. The invo- cation was given by Councilman Nunn. The Minutes of the last regular meeting were approved as read. LONE STAR GAS representative, Vernon Henderson, appeared before ' the Council regarding the rate increase request. Having been reviewed by the City Attorney, Councilman Nunn moved that Ordi- nance No. 221 be approved and adopted granting an increase of 11.8•x6 average in rates charged by Lone Star Gas Company; seconded by Councilman Davis. Councilmen Nunn, Davis and Winfrey voted "For"; Councilman Berry voted "Against". Motion paraidd. (Ordi- nance No. 221 is attached hereto and made a part hereof.) Mr. Henderson thanked the Council. FIRE DEPARTMENT report was turned over to Fire Chief Steele, who informed the Council Unit #3008 was in need of repair to the exhaust system amounting to approximately $50. Councilman Nunn moved that such repair to Unit No. 3008 not exceeding $50 be ® approved; seconded by Councilman Davis. Motion passed unani- mously. Chief Steele then advised Unit No. 3001 was also in X43 need of repair to the front end at an approximate cost of $125. The Mayor asked the Council to authorize him to have such repair made leaving the cost of same to his discretion in determining a reasonable price. So moved Councilman Davis; seconded by Councilman Nunn. Motion passed unanimously. Chief Steele reported that Tarrant County has placed a dry powder unit (for high intensity fires) in our Department for use in Precinct 3. POLICE DEPARTMENT report was given by Councilman Nunn. WATER DEPARTMENT report was given by Councilman Davis who ad- vised Project No. 6, Continental Blvd. 8" main extension in the 172 Bond Program, was now completed. The Mayor informed the Council of an anticipated price increase in PVC pipe and suggested Council grant approval to order a truckload of 6" l pipe at current prices to stockpile for next year's main ex- tensions. So moved Councilman Winfrey; seconded by Councilman Nunn. Motion passed unanimously. The Mayor also asked Council for approval to purchase an auxiliary pump as provided for in the current Budget. So moved Councilman Winfrey; seconded by Councilman Berry. Motion passed unanimously. ZA-75-4, recommended for denial by the Planning & Zoning Com- mission, wherein Ruth Harris is requesting a change in zoning on her land described in said application from AG District to F District, was set for public hearing September 16th at 7:30 P.M. Councilman Davis moved that the bills presented as per the at- tached list be approved for payment; seconded by Councilman Nunn. Motion passed unanimously. Slut REGULATIONS was brought before the Council by the Mayor who advised that the Texas Highway Department was wanting to know what the City's intention is concerning same no later than September 1st. Councilman Winfrey moved that the City of Southlake regulate signs within its corporate limits and that the City Secretary direct a letter to the Highway Department so advising; seconded by Councilman Berry. Motion passed unani- mously. Them being no further business, the meeting adjourned. Mayor ATTEST: JA; City Secretary Regular Council Meeting - 8;/19/75 - Page 2 of 2. wwwwoo ORDINANCE NO. 221 ® AN ORDINANCE FIXING AND DETERMINING THE GENERAL SERVICE RATE ' TO BE CHARGED FOR SALES OF NATURAL GAS TO RESIDENTIAL AND COMMERCIAL CONSUMERS WITHIN THE CITY LIMITS OF SOUTHLAKE , TARRANT COUNTY, TEXAS, AND PROVIDING FOR THE MANNER IN WHICH SUCH RATE MAY BE CHANGED, ADJUSTED AND AMENDED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE: SECTION 1. Effective with the first gas bills rendered from and after thirty (30) days from the date of final passage of this ordinance, the maximum general service rate for sales of natural gas rendered to residential.and commercial consumers within the city limits of Southlake by Lone Star Gas Company, a Texas corpora- tion, its successors and assigns, is hereby fixed and determined as follows: First 1,000 Cu. Ft. or Fraction Thereof $3.1166 Gross; $2.8049 Net Next 2,000 Cu. Ft. @ $2.1277 Per Mcf Gross; $1.9149 Per Mcf Net Next 7,000 Cu. Ft. @ $1.8166 Per Mcf Gross; $1.6349 Per Mcf Net Next 15,000 Cu. Ft. @ $1.6277 Per Mcf Gross; $1.4649 Per Mcf Net Next 25,000 Cu. Ft..@ $1.5054 Per Mcf Gross; $1.3549 Per Mcf Net Next 50,000 Cu. Ft. @ $1.4499 Per Mcf Gross; $1.3049 Per Mcf Net No gas bill will be rendered to any residential or commercial consumer served under the above rate not consuming any gas during any monthly billing period, except that where customer's only use for gas service is in an outdoor grill and/or a fireplace starter, the amount shown for the first consumption block shall constitute a minimum monthly bill. ADJUSTMENTS The amount of each net monthly bill computed at the above- stated rates shall be subject to the following adjustments: Plus or minus the amount of any increase or decrease, respectively, above or below the $1.0399 per Mcf level in the intracompany city gate charge as authorized by the Railroad Commission of the State of Texas or other regulatory body having jurisdiction for gas delivered to Lone Star Gas Company's distribution system for sale to residential and commercial consumers where such changes are caused by increases or decreases in the cost of gas purchased by the Company; plus an amount equivalent to the proportionate part of any new tax, or increased tax, or any other govern- mental imposition, rental, fee or charge (except state, county, city and special district ad valorem taxes and taxes on net income) levied, assessed or imposed subsequent to July 1, 1975, upon or allocable to the Company's distribution operations, by-any new or amended law, ordinance or contract. Each gross monthly bill shall be adjusted proportionately. Company, at its option, may forego the application of any adjustment if such adjustment would result in an increase in the monthly bill; how- ever, failure of Company to apply any adjustment shall not constitute a waiver of Company's right from time to time, or at any time, to make any adjustment, in whole or in part, in any subsequent current monthly bill that may be applicable to such bill. Net rate shall apply to all bills paid within ten days from monthly billing date; gross rate shall be applicable thereafter. The above rate is applicable to each residential and commer- cial consumer per meter per month or for any part of a month for which gas is used at the same location. In addition to the aforesaid'rates, Company shall have the right to collect such reasonable charges as are necessary to conduct its business and to carry out its reasonable rules and regulations in effect. SECTION 2. The rate set forth in Section 1 may be changed and amended by either the City or Company furnishing gas in the manner provided by law. Service hereunder is subject to the orders of regula- tory bodies having jurisdiction, and to the Company's Rules and Regu- lations currently on file in the Company's office. SECTION 3. It is hereby found and determined that the meeting at which this ordinance was passed was open to the public, as required by Texas law, and that advance public notice of the time, place and purpose of said meeting was given.
