CITY OF SOUTHLAKE
REGULAR MEETING OF THE CITY COUNCIL
FEBRUARY 18, 1975
The City Council of the City of Southlake, Texas, met in regular
session in the Council Chamber of City Hall, at 667 North Carroll
Avenue in Southlake on Tuesday, February 18, 1975, with the fol-
lowing members present:
Wade Booker, Mayor
W. 0. Nunn, Mayor Pro Tem
Billy Joe Knox, Councilman
Sam Davis, Councilman
James Winfrey, Councilman
Absent. R. D. Drummond, Councilman
Staff members present: William D. Campbell, City Attorney
W. G. Cline, Water Superintendent
Police Chief Douglas R. Hughes
Mayor Booker called the meeting to order at 7:30 P.M. The invo-
cation was given by Councilman W. 0. Nunn. The Minutes of the last
regular meeting were approved as read.
Mayor Booker introdhced Mr. John Lowrey of Carroll High School
who spoke about courses that will be offered under the Community
Education Program. He asked the Council to assist in the program
by supplying information or input from citizens who may be inter-
ested, and stated that with the cooperation between the school
and city the program should be highly successful. Mayor Booker
thanked Mr. Lowrey for appearing.
GENERAL TELEPHONE RATE INCREASE request was once again brought
before the Council by Mr. Marcus Pritchett. He answered several
questions asked by the Councilmen. Following a short discussion
Councilman Knox moved that the matter be tabled until an indiv-
dual rate brew-down for Southlake could be obtained; seconded
by Councilman Winfrey. Motion passed unanimously.
RESOLUTION NO. 75-4: Calling for an election of Municipal officers
to be held on April 5, 1975 was unanimously passed on motion by
Councilman Winfrey; seconded by Councilman Knox. (Said Resolution
® attached hereto and made a part hereof.)
LOOSE LIVESTOCK CONTROL was brought before the Council by
Mrs. Sharon Callan who related some of her problems in this

regard and requested that something be done. The City Attor-
ney advised that is now under consideration in the vlay of an
ordinance. Discussion followed. The Mayor thanked Mrs.
Callan for her interest.
Mrs. Karen Lawrence asked the Council several questions
and on receiving answers, she thanked the Council for their
time.
FIRE DEPARTMENT REPORT was liven by Councilman Winfrey, He
presented Resolution No. 75-5 which calls for entering into
a contract with Tarrant County for the payment of fire ser-
vices rendered outside our city limits. He moved that said
resolution be adopted; seconded by Councilman Nunn. Motion
passed unanimously. (Resolution No. 75-5, attached hereto
and made a part hereof.)
POLICE DEPARTMENT REPORT was given by Councilman Nunn who
stated that the Department was doing a good job and commented
that patroling the back roads seems to have an affect on
reducing the number of burglaries.
WATER DEPARTMENT REPORT was given by Councilman Davis who ad-
wised that the No. 1 ground storage tank was in the process
of being repainted and that the No. 2 tank and the overhead
tank will be taken care of at a later date.
AMBULANCE SERVICE was next discussed with the Council by the
Mayor who advised them of the bids received to provide such
service in the Cities of Grapevine, Colleyville, and Southlake.
He recommended that the bid submitted by J. E. Foust be ac-
cepted. Mrs. J. E. Foust, Jr., representing the company, an-
swered several questions the Councilmen asked of her. The
length of service to be rendered would be for seven (7) months
and the Council expressed the view that hopefully the three
(3) cities would continue to work together to provide ambulance
service in the coming fiscal year. Councilman Knox moved that
the Mayor be authorized to remain Southlake's representative
on the three (3) cities committee; seconded by Councilman Davis.
Motion passed unanimously. Further discussion was had regard-
ing state requirements, E.M.T. training, and back-up service.
Councilman Davis then moved that the Mayor's recommendation
to accept Foust's bid be accepted; seconded by Councilman Knox.
Motion passed unanimously.

Councilman Knox moved that the bills presented as per the
attached list be approved for payment; seconded by Council-
man Davis. Motion passed unanimously.
Councilman Knox moved to table the Agenda item pertaining,
to fencing along Right-of-Ways; seconded-by Councilman Davis.
Motion passed unanimously.

The item on the Agenda pertaining to a closed session re-
garding personnel matters was also tabled by general agree-
ment of the Council.
There being no further business, the meeting adjourned. a

RESOLUTION NO. 75-4 23
' WHEREAS, pursuant to the provisions of Title 28,
Chapter 2, of the Revised Civil Statutes of Texas,
it is provided that there shall be held in each
' municipality of the State of Texas on the first
Saturday of April of each year a general election
for the purpose of electing officers of said
t municipality; Now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF SOUTHLAKE, TEXAS
' THAT
1. The Mayor of the City of Southlake, Texas, at a regular meeting
' held this date, does hereby order an election of officers of the
City of Southlake to be held on Saturday, April 5, 1975, for the
purpose of electing Councilmen, for a term of two years, from
April 5, 1975, or until their successors are duly elected and
qualified. Candidates for the offices of Mayor and Councilmen
for Place 1 and Place 2 receiving the highest number of votes
for such office and such places shall be elected fora term
of t-dears.
2. For the purpose of said election, the entire City of Southlake
is hereby constituted one voting precinct and said election shall
be held at one polling place,,to-wit: City Hall, 667 North Carroll
Avenue, between the hours of 7:00 A.M. and 7:00 P.M. on the
aforementioned date, and the following persons are hereby appointed
as election officers:
Elsie McAlister, Presiding Judge
Glayds Joyce, Alternate Presiding Judge
and the Presiding Judge at such election shall appoint no more
than three clerks, with the rate of pay for the Presiding Judge
at $2.00 an hour and a like amount for the Alternate Presiding
Judge; and the rate of pay for the clerks fixed at $1.50 per hour,
3. No person shall be eligible for the office of Mayor unless
he is a qualified elector of the City of Southlake and has resided
in the City for one year etc.; and no-ppreon shall be eligible
for the office of Councilman unless he is a qualified elector of
the City of Southlake and has resided in the City for six months
next preceding the election at which he is elected.
4. Any eligible and qualified person may have his name printed
upon the official ballot as an independent candidate for the offices
herein provided for by filing his sworn application with the
Mayor.not later than Midnight, March 6, 197§. The application
' shall state the specific office being sought by the applicant
and that the applicant is eligible and qualified under the Laws j
of the State of Texas, to become a candidate for and hold the J
' office being sought, if elected.
5. Any other candidate for either of the offices herein pro-
vided for may have his name printed upon the said ballot on
application to the Mayor, such application to be furnished by
' the City Secretary and the same contain the signatures of five
percent (5%) of the qualified voters of the City of the entire
votes cast in the City at the last general election.
6. The names of all those who have filed their sworn applica-
tion to have their names printed on the official ballot as candi-
dates shall be posted by the City Secretary in a conspicuous
place at her office for the inspection of."':fhe public for at least
ten days before.she orders the ballots to be printed. All objec-
tions shall be made within five days after such posting, all
written notices filed fth the City Secretary setting forth the
grounds of objections. In case no such objection is filed within
the time prescribed, the regularity or validity of the application
of no person whose name is so posted, shall not thereafter be
contested. The City Secretary shall preserve in her office for
a period of two years all applications, notices of objections and
other related matters
7. Any person eligible to the offices herein provided for who
has filed his sworn application in accordance with the provisions
of this resolution shall have his name printed on the official
ballots. Any such person may cause his name to be withdrawn at
any time before the official ballots are printed by filing in
writing with the City Secretary a request to that effect over his
signature, duly attested to b? a Notary Public. No name so with-
drawn shall be printed on the ballots.. Not later than ten days
before the City General Election, the City Secretary shall have
I the official ballots printed. f
8. The ballots to be used in said election shall be prepared in
I the manner and form in the Election Code of the State of Texas.
9. All qualified voters within the meaning of the Constitution
and Laws of the State of Texas, shall be entitled to vote at
such election.

10. Voting by absentee ballot in said election shall commence on

' March 17, 1975, at the office of the City Secretary, 667 North
Carroll Avenue; voting by absentee ballot shall close at five
o'clock P.M., April 1, 1975.
11. The election officers above named shall make and deliver
' the returns of said election in triplicate, one being retained
by the Presiding Judge, one delivered to the Mayor of the City
and one copy with ballot boxes and all election supplies shall
' be delivered to the City Secretary of the City, the ballot box
containing the signature stubs from ballots used in said election
shall be delivered to the District Court of Tarrant County, Texas,
' and other ballot boxes and election records and supplies shall
be preserved by the City Secretary in the proper office as by
law provided. The City Council will meet at 7:30 P.M. on April 7,
' 1975, for the purpose of canvassing said ballots.
12. The Mayor is hereby directed to give notice of said election
which shall be signed by the Mayor and City Secretary and shall
state the purpose of the election, and the Police Chief shall
post a properly executed copy of the election proclamation at the
polling place herein provided and two copies at two other public
places within the City. Such notices shall have attached thereto
a certified copy of this Resolution.
13. Said election shall be held and conducted in accordance with
the laws of the State of Texas for the holding of general elections
for state and county offices except as otherwise provided by
Chapter 2, Title 28, of the Revised Civil Statutes of Texas.
By approving and signing this Resolution, I, Wade Booker, Mayor of
the City of Southlake, Texas, officially confirm as my action all
matters recited in this Resolution which by law come within my
jurisdiction.

RESOLUTION NO. 75-5

WHEREAS, pursuant to the provisions of Article
r 2351A-3, Revised Civil Statues of Texas, the
Commissioners' Court of Tarrant County, Texas,
has tendered to the City of Southlake, Texas,
' the sum of $3,000.00, in consideration of the
Volunteer Fire Department of said city to fur-
nish fire protection to real and personal pro-
perty located outside of the boundaries of said
City and within such distance as such volunteer
Fire Department may reasonably be expected to
' reach and render service in case of fire, and
has submitted for consideration its contract
r in connection therewith; Now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:
That the offer of the Commissioners' Court of Tarrant County,
Texas, be, and is hereby accepted and that the Mayor of
Southlake, the city under the attest of the Secretary and
seal of the City, be, and is hereby authorized to deliver
said contract to the Commissioners' Court of Tarrant County,
Texas, for its approval.

referred to as COUNTY, and the city of Southlake Texas,

WITNESSETH:

The above namedcITY has a volunteer fire department rel op~nized by
the Insurance Commission of the State of Texas, and has by anorder or
resolution of its governing authorities, petitioned by the Commissioners'

M.-Court of COUNTY to enter into a contract with said CITY for the use of the
fire truck and other fire fighting equipment of said cityfor, the purpose
of fire protection to real and personal property located outside of the
boundaries of said CITY and within. such distances as such volunteer fire
department may reasonably be expected to reach and render service in case
of fire, and said COUNTY has agreed to enter, and does by these presents
entered into a contract by the terms of which TARRANT COUNTY acting by its
Commissioners' Court will pay to said CITY for the purposes aforesaid, the
sum of THREE MiOUSAND DOLLARS ($3,000.00) DOLLARS per annum, such amounts
to be paid in a lump sum or in equal monthly installnents'within the
discretion of the Commissioners' Court of Ta at t County, taking into
consideration the needs and demands of said CITY and its volunteer fire
department.
Said COUNTY shall be under no obligation with respect to providing fire
fighting aquipment or any other expense incidental to the carrying out of
this contract, and shall have no right, title or interest in and to the fire
fighting equipment belonging to siad CITY.
This contract shall be in full force and effect for and during the
entire period of 1 9 7 S and no longer, unless renewed or
extended by further contract.

The funds to be paid by said Tarrant County for the use of

the fire fighting equipment, and the use and service thereof by
the fire department of such CITY for fighting fires joutside of the
limits of said CITY shall be paid out of the Genera Fund of
Tarrant Count and
