EMERGENCY MEETING OF THE CITY COUNCIL
February 14, 1974
Mayor Booker called the meeting to order at 5:32 P.M. in the Council
Chamber of City Hall at 667 North Carroll Avenue in Southlake on
X 11 February 14, 1974. The following Councilmen were present:

R. D. Drummond, Councilman (arriving late)
Absent: Frank Tetrault, Councilman.
The Mayor informed the Council that the Fire Department tanker was
disabled and the repairs needed would involve, he thought, $500 to
$600. All agreed the necessary repairs must be made. Discussion
then followed concerning the need for a lighter weight tanker for
fighting grass fires, of which there were four in the past two weeks.
(Councilman Drummond entered the room at his point.)

Councilman N'(fth 1noV6d that the Fire Chief be authorized J:o check on
prices of available equipment to serve the above-mentioned purpose;
seconded by Councilman Knox. Councilman Nunn stated, "If you could
see what the Fire Department does, it gives you a much deeper appre-
ciation of our responsibility as councilmen which involves protection
of our Town and we must spend money to get decent fire equipment."
More discussion followed. The Mayor then called for a vote on the
motion. Motion passed unanimously.
Further discussion was had concerning State legislation now pending
whereby each individual city would have its own key rate for insur-
ance purposes and the classification of a city is partly based on
its fire department and firefighting equipment. He said our city's
present classification is "unprotected" which carries a high insur-
ance premium.
In answer to Councilman Davis' question, the Mayor advised the Fire-
men's Fund bank account is a type of "pal" fund for use by the
volunteers.
More discussion was had, this time concerning long range spending
for capital improvements needed by the City.
There being no further business, the meeting adjourned.

REGULAR MEETING OF THE CITY COUNCIL
FEBRUARY 19, 1974
The City Council of the City of Southlake, Texas, met in regular
session in the Council Chamber of City Hall at 667 North Carroll
Avenue in Southlake on Tuesday, February 19, 1974, with the fol-
lowing members present:
Wade Booker, Mayor
W. O. Nunn, Councilman
R. D. Drummond, Councilman
Sam Davis, Councilman
Absent: Billy Joe Knox, Mayor Pro Tem
Frank Tetrault, Councilman.

Also present: William D. Campbell, City Attorney.
Mayor Booker called the meeting to order at 7:32 P.M. The invo-
cation was given by Councilman Nunn.
The Minutes of the last regular meeting were approved as read.
The Minutes of the Emergency Meeting held February 14, 1974, were
approved as corrected.
ZA-73-9: Mayor Booker explained to those present at this public
hearing that this request for A-3 (residential) District zoning
was an attempt on the City's part to correct a non-agricultural
use of the land involved which had been previously subdivided by
the former owner improperly and without a plat of the subdivision
ever- having been filed. No one spoke either for or against the
zoning, whereupon, Councilman Nunn moved that Ordinance No. 161-
56 be passed and approved changing the zoning on 23 acres of land,
more or less, described by metes and bounds in said ordinance,from
Ag District to A-3 District; seconded by Councilman Davis. Motion
passed unanimously. (Ordinance No_ 161-56 attached hereto and made
a part hereof.)
The Proposed Updated Future Land Use Plan was next considered by
the Council as presented by Craig Eaton of Carter & Burgess, Inc.,
the City's consultant planning firm. Final adoption will be had
at the next regular Council meeting, March 5th. Mr. Eaton pointed
out that the City sh&uld seriously consider adoption of a housing
code to eliminate substandard housing which causes blight. He
advised the Council he will have all the work completed by February
28th.

Police Department report was given by Chief Doug Hughes. (Said
report being filed herewith.) Councilman Nunn moved that the
car to be used for investigative purposes be painted at an approx-
imate cost of $35; seconded by Councilman Davis. Motion passed
unanimously. He then stated for the record that Officer Armstrong
is to be commended for doing a good job in the drug abuse program.
Councilman Nunn moved that the Chief process applications for an
additional patrolman and to advise when he is ready to present an
application to the Council; seconded by Councilman Drummond. Motion
passed unanimously.
Resolution No. 74-8: calling for an election of city officers was
passed and approve on motion by Councilman Davis; seconded by
Councilman Nunn. Motion passed unanimously. (Said Resolution
being attached hereto and made a part hereof.)
Proposed septic tank regulations were tabled kt the request of the
Mayor because the full Council is not present and one of the
Council had not had time to study the resolution. He informed
the Council that Councilman Drummond proposed the City's next
budget include funds for the purpose of hiiing a full-time em-
ployee to administer septic tank regulations, as well as issue
building permits among other things. The City Attorney advised
he had reviewed the proposal of the Tarrant County Health Depart-
ment and had comments to be passed to the Council.
Counciolman Davis moved that the bills presented, including Invoice
#38829 of Rex-Tex Equipment Company for repair to Fire Unit 3001 in
the sum of $260.50 and Invoice #1153 of Fire Protection Service for
boots in the sum of $412.50, be approved for payment; seconded by
Councilman Drummond. Motion passed unanimously.
There being no further business, the meeting adjourned.

' ZONING CLASSIFICATION OF TWENTY-THREE AND
ONE-HALF ACRES OF LAND, MORE OR LESS, OUT
OF THE J. G. ALLEN SURVEY, ABSTRACT NO. 18,
FROM AG (AGRICULTURE) DISTRICT TO A-3 (RESIDEN-
TIAL) DISTRICT.
WHEREAS, after receipt of request for change of zoning, notice given
' to applicable property owners of public hearing, notice of public hearing
published, and public hearing having been conducted, all in compliance with
' Ordinance No. 161 of the City of Southlake Texas
,
' NOW, THEREFORE,
Be it ordained by the City Council of the City of Southlake, Texas:
' SECTION 1. The certain Ordinance No. 161 passed by the City Council of the
City of Southlake, Texas, January 1969, and being the "Comprehensive
' Zoning Ordinance" is hereby amended insofar as the twenty-three and one-
half acres of land, more or less, out of the J. G. Allen Survey, Abstract
No. 18, Tarrant County, Texas, more particularly described by metes and bounds
' as follows:
t BEGINNING at a steel rod in the Southwest corner of a 4.1547
acre tract as recorded in Volume 4430, Page 518, Deed Records,
Tarrant County, Texas, said point also being, by deed description,

' of the Northeast corner of said J. G. Allen Survey;
THENCE North 6 degrees 12 minutes West a distance of 985.21 feet
to a steel rod in the South R.O.W. line of County Road #4049

hereby amended to reflect the change in zoning classification made by this

. SECTION 3. The said Ordinance No. 161, except as amended by this Ordinance
No. 161-56 and prior ordinance amendments, remains in effect in all other
respects as originally passed. This ordinance shall take effect upon its
passage.

AN ORDINANCE DISANNEXING CERTAIN TERRITORY FROM THE
CITY OF SOUTHLAKE, TEXAS.
WHEREAS, under authority of Article 970a, Vernon's Texas Civil Statutes
of 1925, as amended, request has been made by the widow of Rufus Welch, Mary
Welch, that the real property, described on Exhibit "A", attached hereto, be
disannexed from the City of Southlake, Texas; and,
WHEREAS, the said property is solely owned by the widow of Rufus Welch,
Mary Welch, and, under existing facts, grounds for such disannexation have been
shown; and,
WHEREAS, the above described territory forms a part of the existing City
of Southlake, Texas; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS:
The land and territory described on Exhibit "A", attached hereto and made
a part hereof, such Exhibit "A" consisting of a survey of R. D. Hayes, dated a
June 18, 1973, with field notes attached dated June 18, 1973, showing 5.564 acres 17

of land and that strip of F-M Road 1709 and right of way in front of said Welch
property running east to the west right of way line of Pearson Lane is hereby
disannexed from the City of Southlake, Texas, and said territory shall hereinafter
be considered as outside the boundary limits of the City of Southlake, Texas, and I*
not within its corporate city limits.
This Ordinance shall take effect immediately prior to the annexation of
the said Welch property by the City of Keller.

RESOLUTION NO. 74-8
WHEREAS, pursuant to the provisions of Title 28,
Chapter 2, of the Revised Civil Statutes of Texas,
it is provided that there shall be held in each
municipality of the State of Texas on the first
Saturday of April of each year a general election
for the purpose of electing officers of said
municipality; Now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS,
THAT:
1. The City Council of the City of Southlake, Texas at a regular meeting
held this date does hereby order an election of officers of the City of
Southlake to be held on Saturday, April 6, 1974, for the purpose of elect-
ing Councilmen, for a term of two years, from April 6, 1974, or until their
successors are duly elected and qualified. Candidates for Councilmen for
Place 3, Place 4 and Place 5 receiving the highest number of votes for such
office and such places shall be elected for a term of two years.
2. For the purpose of said election, the entire City of Southlake is
hereby constituted one voting precinct and said election shall be held
at one polling place, to-wit: City Hall, 667 North Carroll Avenue, between
the hours of 7:00 A.M. and 7:00 P.M. on the aforementioned date, and the
following persons are hereby appointed as election officers:
Elsie McAlister, Presiding Judge
L. A. Casey, Alternate Presiding Judge
and the Presiding Judge at such election shall appoint no more than three
clerks, with the rate of pay for the Presiding Judge at $2.00 an hour and
a like amount for the Alternate Presiding Judge; and the rate of pay for the
clerks fixed at $1.50 per hour.
3. No person shall be eligible for the office of Councilman unless he is a
qualified elector of the City of Southlake and has resided in the City for
six months next preceding the election at which he is elected.
4. Any eligible and qualified person may have his name printed upon the
official ballot as an independent candidate for the offices herein provided
for by filing his sworn application with the Mayor not later than Midnight,
March 6, 1974. The application shall state the specific office being
sought by the applicant and that the applicant is eligible and qualified
under the Laws of the State of Texas, to become a candidate for and hold
_the office being sought, if elected.
5. Any other candidate for either of the offices herein provided
for may have his name printed upon the said ballot on application
to the Mayor, such application to be furnished by the City Secre-
tary and the same contain the signatures of five percent (5%) of
the qualified voters of the City of the entire votes cast in the
City at the last general election.
6. The names of all those who have filed their sworn application
to have their names printed on the official ballot as candidates
shall be posted by the City Secretary in a conspicuous place at her
office for the inspection of the public for at least ten days be-
fore she orders the ballots to be printed. All objections shall
be made within five days after such posting, all written notices
filed with the City Secretary setting forth the grounds of objec-
tions. In case no such objection is filed within the time pres-
cribed, the regularity or validity of the application of no person
whose name is so posted, shall not thereafter be contested. The City
Secretary shall preserve in her office for a period of two years all
applications, notices of objections and other related matters.
Any person eligible to the offices herein provided for who has
filed his sworn application in accordance with the provisions of this
resolution shall have his name printed on the official ballots. Any
such person may cause his name to be withdrawn at any time before
the official ballots are printed by filing in writing with the City
Secretary a request to that effect over his signature, duly attested
to by a Notary Public. No name so withdrawn shall be printed on the
ballots. Not later than ten days before the City General Election,
the City Secretary shall have the official ballots printed.
8. The ballots to be used in said election shall be prepared in the
manner and form in the election code of the State of Texas.
9. All qualified voters within the meaning of the Constitution and
Laws of the State of Texas, shall be entitled to vote at such election.
10. voting by absentee ballot in said election shall commence on
March 18, 1974, at the office of the City Secretary, 667 North Carroll
Avenue; voting by absentee ballot shall close at five o'clock P.M.,
April 2, 1974.
11. The election officers above named shall make and deliver the returns
of said election in triplicate, one being retained by the Presiding
Judge, one delivered to the Mayor of the City and one copy with ballot
boxes and all election supplies shall be delivered to the City Secretary
of the City, the ballot box containing the signature stubs from ballots
used in said election shall be delivered to the District Court of
Tarrant County, Texas, and other ballot boxes and election records and
supplies shall be preserved by the City Secretary in the proper office

1974, for the purpose of canvassing said ballots.
12. The Mayor is hereby directed to give notice of said election which
shall be signed by the Mayor and City Secretary and shall state the
purpose of the election, and the Police Chief shall post a properly
executed copy of the election proclamation at the polling place
herein provided and two copies at two other public places within
the City. Such notices shall have attached thereto a certified
copy of this resolution.
13. Said election shall be held and conducted in accordance with the
laws of the State of Texas for the holding of general elections for
state and county offices except as otherwise provided by Chapter 2,
Title 28, of the Revised Civil Statutes of Texas.
By approving and signing this Resolution, I, wade Booker, Mayor of
the City of Southlake, Texas, officially confirm as my action all
matters recited in this Resolution which by law come within my
jurisdiction.
