PROJECT: Sign Variance for Burger King
EXECUTIVE
SUMMARY: Fire Restaurants Management LLC is requesting approval of sign variances to Sign
Ordinance No 704-J, as amended, for Burger King, located at 125 N. Kimball
Avenue.
DETAILS: The purpose of this request is to seek approval for two signs: a freestanding order
sign/canopy and a menu board sign. The applicant originally requested approval to
allow the two existing signs that were installed without permits to remain in place. A
variance was requested for the freestanding order sign/canopy because this type of
sign is not permitted under current regulations. Additionally, a variance was
requested for the menu board because it does not include the required masonry
framing around the sign face.
At their August 21, 2025 meeting, the Sign Board recommended approval (3-2;
Springer, Gunter), recommending that the applicant submit conforming sign
applications before the upcoming City Council meeting. At the September 2, 2025
City Council meeting, Council tabled the variance request and advised the applicant
to revise their request to more closely align with the Sign Ordinance.
Per Council’s direction, the applicant has submitted three revised options for the
sign variance request for Council’s consideration:
• Option 1: Freestanding order sign/canopy with a screen and new masonry
framing around the existing menu board. Variance approval is required for
the freestanding order sign/canopy as this is not a permitted sign type. No
variance approval is required for the menu board.
• Option 2: Freestanding order sign/canopy without a screen and new
masonry framing around the existing menu board. Variance approval is
required for the freestanding order sign/canopy as this is not a permitted sign
type. No variance approval is required for the menu board.
• Option 3: Ordering speaker (in lieu of the freestanding order sign/canopy)
and new masonry framing around the existing menu board. No variances
are required for this option.

HISTORY: February 2, 2010; City Council approved a sign variance for Burger King
grating variance to allow for two backlit signs on the front fin of the building
with the agreement that no other signs will be placed on the building. (SV10-
001)
SIGN BOARD: August 21, 2025; Approved (3-2; Springer, Gunter) subject to the Staff
Report dated August 21, 2025, recommending that the applicant submit
conforming sign applications before the upcoming City Council meeting.
CITY COUNCIL: September 02, 2025; Motion made to table (7–0) at the applicant’s request
until the October 7, 2025, City Council meeting.
October 7, 2025; Motion made to table (7–0) at the applicant’s request until
the October 21, 2025, City Council meeting.

City Council consideration of this item is scheduled to be held on December
02, 2025.
STAFF COMMENTS: City Council approval of this request does not waive the requirement to
obtain a sign permit prior to installation. All signage must be reviewed and
approved through the City’s permitting process before any installation takes
place.
