Carroll Avenue BOARD OF ADJUSTMENT MEETING October 24, 1996 7:00 p.m. MEMBERS PRESENT: Fred Joyce, Chairperson; Art Sorenson, Vice Chairperson; Sally Hall, John Smart, Alternate #2. MEMBERS ABSENT: Karen Cienki, Ron Troy, William (Bill) Kemp, Alt #1. STAFF PRESENT: Karen Gandy, Zoning Administrator; Stefanie Sarakatis, Zoning Assistant; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. With no objections the minutes of the regular meeting October 10, 1996 were deemed approved by the Chair as amended. Agenda Item #3 Administrative Comments. There were no comments. Agenda Item #4 ZBA Case #262 Special Exception ZBA Case #262 a request for a Special Exception Use Permit per Ordinance No. 480, § 44.12 (1) for family quarters containing approximately 1,000 square feet. The location is 1740 Sunshine Lane, legally described as approximately 2.93 acres situated in the Francis Throop Survey, Abstract No. 1511, and being Tract 3A1F1. The owner/applicant is Martin R. Hawk. Karen Gandy, Zoning Administrator, reported the current zoning is "SF-lA" Single Family Residential District. Ms Gandy said ten (10) notices were sent to property owners within 200 feet and there were four (4) response received all opposed to the request. Public Hearing. Martin R. Hawk, owner/applicant, was present and reported on the changes made on the revised plot plan and pictures of both his and his neighbor's property. Mr. Hawk stated he needed the Special Exception for his son and his family. Raymond Hawk, 1740 Sunshine, was present and expressed his need for the family quarters for hiself and his two (2) daughters. Mr. Nathan Hight, 1700 Sunshine, was present and expressed he was opposed to the request. Zoning Board of Adjustment Meeting Page 2 October 24, 1996 Agenda Item #4 continued Mr. Hight presented pictures and stated, the request does not meet the specifications set forth in the deed for his property and the adjoining properties; it would be creating another health hazard (septic) for the area because sewer is not available. Mr. Robert Bledsoe, 1600 Sunshine, was present and expressed he was opposed to the previous site location. Mr. Bledsoe said he was not prepared for the new plot plan. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Sorenson. Pursuant to the finds set forth in this case, a motion was made to Grant a Special Exception ZBA Case #262 as presented on the revised plot plan. Motion: Sorenson Second: Hall Ayes: Smart, Hall, Sorenson, Joyce Nays: none Vote: 4 - 0 to approve Agenda Item #5 ZBA Case #265, Special Exception. ZBA Case #265, a request for a Special Exception Use Permit per Ordinance No. 480, § 44.12(1) for family quarters containing approximately 992 s.f. The location is 710 South White Chapel Blvd., being approximately 1000 ft. north of the intersection of South White Chapel Blvd. and Princeton Park and being legally described as Lot 2, Block 1, Bull Run Lakes Addition, 5.199 acres situated in the Hiram Granberry Survey, Abstract No. 581. The owner/applicants are Pat and Cheri Summerall. Karen Gandy, Zoning Administrator, reported that ten (10) notices were sent to property owners within 200 feet and there was no response. Public Hearing. Ron Parks, Interwoven Design and Construction, representing Pat and Cheri Summerall as their builder. Mr. Parks said the owners would be occupying the quarters until their home is completed and afterwards the quarters would be used for caretakers or aging family members. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Sorenson. Pursuant to the finds set forth in this case, a motion was made to Grant a Special Exception ZBA Case #265 as requested. Motion: Sorenson Second: Smart Ayes: Smart, Hall, Sorenson, Joyce Nays: none Vote: 4 - 0 to approve Agenda Item #6 ZBA Case 266, Variance. ZBA Case #266, is a request for a variance for front and side yard setbacks per Ordinance No. 480 § 14.5(b), requiring side yards to be not less than fifteen (15) feet. The applicant is requesting a front yard of twenty-five (25) feet and a side yard of ten (10) feet. The location is 1319 Village Green Drive, being legally described as Lot 10, Block 1, Country Walk Addition and being approximately 0.911 acres situated in the Samuel H. Thompson Survey, Abstract No. 1504. The owner is Heatherwood Custom Homes and the applicant is Bryan P. Tunink. Karen Gandy, Zoning Administrator, reported that four (4) notices were sent to property owners within 200 feet there was no response. Public Hearing. Mr. Bryan P. Tunink, applicant, was present and said the beautiful two (2) foot diameter oak tree will not live if the house is built on its roots and the floor plan they have selected would require a variance to save the tree. Mr. Tunink further said, there is a fifteen (15) foot drainage easement down the entire right-side yard which prohibits splitting the difference and allowing a 12.5 foot setbacks on each side. Valerie Tunink, was present and said this was their one story dream house, which restricts placement on the lot. Zoning Board of Adjustments Meeting Page 4 October 24, 1996. Agenda Item #6 continued. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Sorenson. Pursuant to the findings set forth in this case, a motion to grant a Variance to ZBA Case #266 as requested. Motion: Sorenson Second: Hall Ayes: none Nays: Smart, Hall, Sorenson, Joyce Vote: 0 - 4 failed to approve Agenda Item #7 Topics of discussion for future training session with City Attorney. A discussion was held on a future training session with City Attorney. Ms. Gandy reported that Allen Taylor would not be available until after the end of the year and she has requested the first available for January 1997. Agenda Item #7 Meeting Adjourned. With no objections the Chair deemed the meeting adjourned.
