BOARD OF ADJUSTMENT MEETING

MEMBERS PRESENT: Fred Joyce, Lloyd Latta, Dennis Minder, Jon Michael Franks,
Alternate #2.
MEMBERS ABSENT: John Moore, Alternate #1 MEMBER RECUSE: Art Sorenson
STAFF PRESENT: Karen Gandy, Zoning Administrator; Stephanie Sarakatis, Asst. to the
Zoning Administrator; Wayne Olson, City Attorney; Jean Bryson, Secretary.
Agenda Item #2 Approval of the Minutes.
A motion was made to approve the minutes of the May 16, 1996 meeting as presented.
Motion: Latta
Hearing no objection the Chair deemed the minutes approved as presented.
Agenda Item #3 Administrative Comments.
Ms. Gandy reported the next meeting will be June 13, 1996 and there will be two (2) cases to
consider.
Agenda Item #4 ZBA Case #253, Special Exception Use Permit.
ZBA Case #253, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (5) for
in-home day care. The location is 1201 Scenic Drive being legally described as lots 12 and
13R, Block 2, Continental Park Estates Addition and being approximately 0.803 acres situated
in the M. M. Freeman Survey, Abstract No. 533. The owner/applicant is Kimberly M. Todd.
Karen Gandy, Zoning Administrator, reported that twelve (12) notices were sent to property
owners within 200 feet and there was one (1) response in favor and five (5) response opposed
to the request. There was three (3) response outside the 200 feet and there were opposed tothe
request.
Public Hearing.
Ms. Kimberly M. Todd, owner/applicant, presented to the Board a copy of Training for
Registered Family Home, Minimum Standard Evaluation Check List Texas Department of
Protective and Regulatory Services and a copy of Criminal Back Ground Check on herself and
other family members.

Agenda Item #4 continued.
Ms Todd said she is requesting in-home daycare with hours of operation 6:00 a.m. to 6:30 p.m.,
with approximately 6-8 infants and toddler-age children, including three children of her own.
Dave Sampson, 1438 Ottinger, said he was a Southlake property owner and he spoke in favor
of the request.
Debra Cherry, 1305 Oakhurst, said she is opposed to the request and her concern is the safety
of the children and the legal responsibility of the private lake property owners..
Joseph Boyle, 1206 Scenic Dr., said his concerns are the private lake, animals, snakes, and the
danger to the children and he does not believe the back yard is fenced.
Michael Herald, 1203 Scenic Dr., said he opposed the request and his concern is child safety
because the property contains a private lake, stream and boat dock. He also said the request
would alter the residential nature of the 20 year old community.
Charles McRae, 1206 Timber Ct., said he opposed the request and his concern is for his fellow
lake owners and against the liability issue and the idea controlling the odds. Mr. McRae also
expressed his concern with the signage on Continental Blvd.
Judy Barnes, 1318 Oakhurst, said she opposed the request and her concern is the joint ownership
of the lake, the safety for the children and that the sign offended her.
Annette Benbow, 1202 Scenic Dr., said she opposed the request and her concern is for the
children's safety and the common drainage area involved.
David Aurzada, 1204 Scenic Dr., said he is opposed to the request and has concern for the
neighborhood.
Ms. Todd rebuttal: she said the back yard is totally fenced and all gates are pad locked.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
Pursuant to the finds set forth in this case, a motion was made to Grant a Special Exception
ZBA Case # 253 as requested..
