MEMBERS PRESENT: Fred Joyce, Chairman; Lloyd Latta, Dennis Minder, Art Sorenson, John Moore, Alternate #1. MEMBERS ABSENT: Jon Michael Franks, Alternate #2. STAFF PRESENT: Karen Gandy, Zoning Administrator; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. A motion was made to approve the minutes of the February 29, 1996 regular meeting. Motion: Sorenson Second: Moore Ayes: Moore, Minder, Sorenson, Latta acting Chairman Nays: None Vote: 4 - 0 to approve Agenda Item #3 Administrative Comments. Karen Gandy reported the next meeting will be April 25, 1996. Agenda Item #4 ZBA Case #251 Approval of the height of two ornamental towers. ZBA Case #251 approval of the height of two (2) ornamental towers for The Home Depot per Section 33.5a, Ordinance No. 480, "Exceptions to Height Regulations," of approximately 43' 2" on the northern tower and 39' 6" on the southern tower. The request is being made for the property proposed as Lot 4, Block 2, Village Center Addition Phase II. The location is South of State Hwy 114, North of State Hwy 1709 and West of Walmart. The applicant is Emilou Barnes, Architect for Greenberg Farrow. A presentation was made by Karen Gandy, Zoning Administrator. Ms. Gandy presented pictures from the applicant to the board and reported that four (4) notices were sent to property owners within 200 feet. There was no response. Public Hearing. Donald Silverman, developer, of the Midland Group stated that the ornamental towers would not be used for storage, mechanical, or any other use as it was for design only to create balance. Mr. Joyce was seated as chairman. A motion was made to grant the approval of the height (approximately 43' 2" on the northern tower and 39' 6" on the southern tower) of two ornamental towers as requested. Motion: Sorenson Second: Latta Ayes: Moore, Latta, Minder, Sorenson Nays: none Abstained: Joyce Vote: 4 - 0 - 1 to grant as requested Agenda Item #5 ZBA Case #252 Special Exception ZBA Case #252 approval of a Special Exception Use permit for family quarters in the "SF- 1A" Single Family Residential District per Ordinance No. 480, Section 44.12 (1) for the property located at 1861 North Sunshine Lane, being legally described as Tracts 3A1E1 and 3A1E7 of the F Throop Survey No. 1511, and being approximately 3.12 acres. The owner/applicant is J. A. and Cheryl Taylor. A presentation was made by Karen Gandy, Zoning Administrator. Ms. Gandy reported that nine (9) notices were sent to property owners within 200 feet and there were four (4) response, three (3) in favor and one (1) undecided to the request. Public Hearing. J. A. Taylor, owner/applicant, was present and said he was requesting mother-in-law quarters northeast of his home. Lisa Thompson, 1855 E. Dove, was present and questioned if the family quarters could ever be rented. The board answered her that it would be for family quarters only and was not to be rented. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. Board of Adjustment Meeting page 3 March 28, 1996 Agenda Item # 5 continued. The findings were stated by Mr Sorenson. A motion was made to grant ZBA Case # 252 a Special Exception Use permit for family quarters as requested. Motion: Sorenson Second: Moore Ayes: Moore, Latta, Minder, Sorenson, Joyce Nays: None Vote: 5 - 0 to grant Agenda Item #6 Meeting Adjourned. With no objections the Chair deemed the meeting adjourned.
